Rule By Law: by Malik Imtiaz Sarwar PDF Print

It has become manifest that the Rule of Law has collapsed in Malaysia.

Even if Anwar Ibrahim were to be found guilty of sodomy, the court of public opinion would have acquitted him. Even if the Deputy Prime Minister were shown to be wholly unconnected with the events underlying the Altantuya murder trial, that court would have already found otherwise. It would not matter if all the police officers, prosecutors and judges in the country were to say otherwise or if all the untruths, one way or the other, were undone. Malaysians, or at least a very large number of them, have lost faith in the system.

The Rule of Law does not exist merely for there being present the institutions of the administration of justice. Courts, prosecutors, a legal profession and a police force do not in themselves give rise to the Rule of Law. That can only occur if they collectively function in a manner that allows for the full confidence of the Malaysian public. Without such confidence, these institutions are nothing more than empty shells.

There is no longer a basis for continued public confidence in these institutions. Where the police and the Judiciary are concerned, this is a state of affairs that has for all purposes and intents been formally recognized by two Royal Commissions of Enquiry. The office of the Attorney General is suborned to the Executive and its impartiality has been put in doubt, its decisions and conduct having become increasingly questionable. The legal profession has been largely neutered by self-interest or the need for self-preservation.

We are getting fatigued by these 'revolting repulsive and filthy' mindsets of our politicians.

Malaysia needs to clear this cesspool of politicians, and get some real leaders.
If we can't find genuine capable leaders in Malaysia, outsource.
Same things goes for our judges and police.

The LAW IN MALAYSIA is in the hands of those top guns in the government!
It exists but is used to their advantage!
We need to change the corrupt government!

The kangaroo court and the AG dog are created by the Umno gormen. So even if they really found no evidence against Najib, no one will believe. Najib will just have to live with it, guilty by public opipnion. He is one of those who created the kangaroo court and AG dog, he must live the consequences.

Only a Royal Commission of Enquiry can help save our Malaysian Judicial System, in the eyes of the people of our country and the world.

The last 2 decades of near-despotic rule had caused our chief judges to be compromised, frequent complaints of selective prosecution by the AG's office and the questionable & biased investigation by the police. (Incidently, the IGP & the Attorney-General have been implicated in the Sodomy Trial, 10 years ago).

If no serious actions are being taken by the top executives of the government to addrss the above prolems, then Malaysia will be taking the same route as Zimbabwe.

Malik, what do we expect when both AG Gani Patail and IGP Musa Hassan got promoted not base on meritocracy but political means?

What do we expect when the judiciary itself is corrupt and politicians who know nothing about rule of laws, dictate everything?

I say the king should intervene now and dismiss the present government and call for a snap GE. Let's the rakyat make the final decision this time.

I'd suggest that someone come up with the list of most tainted judges ranked by reputations, malleableness of spine, the propensity to seek patronage, tacit supporters of racist extortion.

We should keep on publishing and updating this list, so the rakyat has some awareness of their chances and risks with these 'compliant' judges.

The rakyat, the private sector, foreign investors with domestic operations, need some sort of judge corruption benchmark, ranking and metrics to be able to defend themselves if possible.
