And this is what the federal government has been doing all this while. It unilaterally changes the terms of the agreement and forces the states to agree to these changes. If also forces the states to sign contracts that are one-sided and a breach of the Federation Agreement or the 20-point Agreement.

THE CORRIDORS OF POWER

Malaysia Today

Kedah approves logging activities
By EMBUN MAJID, The Star

The Kedah Government has approved logging activities at the Pedu, Muda and Ahning dam catchment areas, a move that is expected to generate about RM16 billion in revenue for the state. Mentri Besar Azizan Abdul Razak said the move was necessary to cover the high expenditure incurred by the state following the petrol price increase.

He added that the state would call for tenders soon and award the logging contract to the highest bidder. “We will discuss the logging method to be used with the Forestry Department,” he told newsmen after chairing the state executive council meeting yesterday.

He added that the Federal Government had promised to pay an annual compensation of RM100 million in 2003 following the state’s decision to cancel its proposed heli-harvesting project to log timber in catchment areas. “However, until now the payment has not been made. We have also asked the Federal Government for financial assistance for the water supply to Penang and Perlis and for the rice we are producing for the country. Since the Government cannot assist us financially, we will carry on with the logging activities,” Azizan added.

*************************************************

This is what happens when the federal government squeezes the opposition-led states and denies it the funding it requires. The federal government seems to forget that the granting of funds to the states should not be tied to which political party is running those states. The granting of funds to the states is a clause in the Federation Agreement.

At one time, the Malay states were independent and were known as the Straits Settlements, the Federated Malay States, or the Unfederated Malay States. Then they all agreed to merge into the Federation of Malaya. In doing so the states agreed to relinquish certain rights like national defence, security and foreign policy while they retained certain rights like land matters, natural resources and religion. Each state would then be given an annual grant plus loans for development, calculated based on the size of its population.

These were the terms agreed in the Federation Agreement and which was the basis for all the states to merge under the Federation of Malaya. And any first-year law student can tell you that an agreement made on the basis of mutual consent can no doubt be changed with the signing of a supplementary agreement, but must also be based on mutual consent. One party can’t unilaterally change the terms of the agreement without the consent of the other party. In the event one party violates the terms of the agreement, then the aggrieved party can either give notice for the termination of the agreement or sue for specific performance, with or without damages (unless there is a specific clause in the agreement that stipulates what happens when there is a breach -- like going for international arbitration, etc.).

Therefore, in this spirit, the federal government has no choice but to give the states grants and loans for development. If the federal government fails to do so then, for all intents and purposes, the federal government has violated the terms of the Federation. And the states will therefore also have no choice but to fend for themselves the best way they can -- which will include cutting down all the trees to turn them into much-needed cash with which to pay for the cost of running the states and to finance development.

Oil and gas is a state resource. Under the terms of the Federation Agreement, oil and gas, which is a state resource, belongs to the states, 100% (just like water, timber, tin, iron, gold, coal, etc.). However, in 1974, the federal government nationalised oil and gas and then forced all the 13 states to sign an agreement with Petronas -- whereby the newly created national oil company will become the owner of all the oil in gas and the states would just enjoy a 5% ‘commission’. Later, the states were forced to sign a supplementary agreement stating that the 5% ‘commission’ would be officially and legally called ‘royalty’.

The states really had no choice in the matter. This was not mutually agreed. What the federal government did was to pass a law in Parliament called the Petroleum Development Act 1974. By law, the states had to relinquish all rights over oil and gas and the federal government, through Petronas, took what belonged to the states ‘by force’. That not being enough, the federal government even violated the Petroleum Development Act plus also the agreement that the states were forced to sign with Petronas. In 2000, the federal government cancelled the 5% royalty due to Terengganu and handed it over to Umno to manage. And they also changed the name ‘royalty’ to ‘goodwill money’ -- which does not appear anywhere in the Petroleum Development Act or the agreement the states were forced to sign with Petronas.

Yes, the federal government has, time and time again, violated the terms of the Federation Agreement. And they violated it again in 1974 by nationalising a state resource -- oil and gas. And they violated it yet again in 2000 by cancelling the 5% royalty in spite of the 5% being morally wrong in the first place (but made legally right through an Act of Parliament). And now, after the 8 March 2008 general election, the federal government is up to its tricks again by denying the opposition-led states the funds it is legally obligated to give the states.

Sure, the states can’t send the federal government a notice of breach of agreement with 30 days notice to terminate the federation or to sue the federal government for specific performance and possibly for damages as well. But it can do the next best thing. The states still have land, water, timber, tin, gold, iron, coal, and much more. The jungles bordering Kedah, Perak and Kelantan are rich in resources, much of it explored but untouched since the beginning of time. The states can open up these lands and exploit whatever they can find there, timber included. The states have no choice but to do this. But what a great loss to the world when after some time not a single tree is left standing in this country and Malaysia eventually turns into a hot desert and Malaysia’s contribution to global warming will turn this world into a mess.

What will happen when there are no longer any trees in the catchment areas? Well, there will no longer be any rain and the dams will dry up. Then water will cost more than petrol like in Saudi Arabia. And this will happen because Umno wants to punish the opposition-led states by denying it funds although, when these states joined the Federation of Malaya in 1957, it was agreed that the states would receive funding and the agreement did not say that funding will be given only on condition that Umno rules these states.

Sabah too has been expressing its unhappiness all these many years but the grumblings of the Sabahans have fallen on deaf ears. But Sabahans no longer want to take any shit just like how the Sultan of Terengganu decided he too will no longer take any shit and he made this very clear by rejecting Umno’s choice of Menteri Besar. Now, Umno is going to return the 5% oil royalty it stole from Terengganu since 2000. But Terengganu does not want just the 2008 royalty. They want the royalty stolen since 2000, which comes to about RM7 billion, or RM8 billion with this year’s included.

Okay, if Umno does not want the eight Members of Parliament and 28 State Assemblymen from Terengganu to leave Barisan Nasional and become ‘independents’, then the federal government has to hand over RM8 billion this year. If not, then Terengganu Darul Ehsan will become the Independent Sultanate of Terengganu. The ball is at Umno’s feet.

Sabah too is pressing for the federal government to not only honour the Federation Agreement but the 20-point Agreement as well. Under the 20-point Agreement, Sabah is not one of the states of Malaysia equivalent to Kedah, Kelantan, Penang, Perak or Selangor. Sabah is equivalent to Malaya.

This is what Wikipedia has to say about the matter:

The 20-point Agreement was written for the main purpose of safeguarding the interests, rights, and the autonomy of the people of Sabah upon entering the Federation of Malaysia. It was originally envisaged that Sabah will be one of the four entities in the Federation, the others being Malaya, Singapore, and Sarawak. However, as times passed, Sabah and Sarawak ended up being merely one of the 13 states in the Federation.

Many do not understand this very important fact. Sabah is not a state as such. Sabah is of the same status as Malaya. Sabah lawyers can freely practice in Kuala Lumpur but Kuala Lumpur lawyers need permission to practice in Sabah. Sabahans can freely travel to West Malaysia but West Malaysians can be denied entry into Sabah (once upon a time West Malaysians needed to show their international passport before they could enter Sabah).

Is this unfair and smacks of double standards? This was what was agreed when Sabah teamed up with Malaya, Sarawak and Singapore to form Malaysia. Whether it is fair or not is not the issue. The issue is: this was what was agreed and if it is not fair then why agree to it? You can’t agree to something, fair or unfair, just to entice a state to join the Federation and then, after it has joined, you scream about the terms being unfair and unilaterally change the terms against the wishes of the other party.

And this is what the federal government has been doing all this while. It unilaterally changes the terms of the agreement and forces the states to agree to these changes. If also forces the states to sign contracts that are one-sided and a breach of the Federation Agreement or the 20-point Agreement. But now the states are fighting back. Now the states will no longer take any shit. And this is what is happening in the Terengganu, Kedah and Sabah situations. The aggrieved parties are fighting back as they rightfully should. And Terengganu wants back its RM7 billion. Kedah is going to cut down all its trees. Sabah will go for a new government that can increase its 5% royalty to 20% (which should be 100% in the first place) plus a government that can honour the 20-point Agreement, which was the basis for it to team up with Malaya to form Malaysia.

*************************************************

Yong: Problems remain unsolved
The Star

The continued insensitive attitude of the Government towards serious issues in Sabah is the main reason Sabah Progressive Party (SAPP) decided to move a motion of no-confidence against the Prime Minister. Its president Datuk Yong Teck Lee said the party had to make a stand before the “window of opportunity” closed by August after which Sabah would be forgotten again.

“The nation’s attention will switch to MCA and Umno elections, people will be pre-occupied with the fasting month, Hari Raya, school exams and year-end events,” he said in a statement yesterday. “Political fatigue in the national mainstream over 'Sabah-Sabah-Sabah' issues will set in.”

He said the momentum for Sabah to recover autonomy, obtain 20% oil royalties instead of the present five per cent and the return of Labuan would be lost. “Unfair federal laws, excessive taxes and structural imbalances in the economy will remain entrenched. Sabah will remain the poorest state subservient to central leadership. The illegal immigrant problem will reach boiling point. With our political move today (yesterday), SAPP hereby initiates the political process to claim 20% in oil royalties, which is after all the natural resource of Sabah,” he added.

Yong said the extra billions could be invested in agriculture, education, capacity-building and achieve self-sufficiency in many areas. “We can therefore insulate ourselves from external shocks or an economic tsunami,” he said.

He added that the people of Sabah were also suffering from high inflation because of recent “astronomical” and “unexpected” fuel price hikes, which was contrary to a Barisan election promise. He said fuel prices have caused the business sector to stagnate and predicted that unemployment and social problems would rise. “But the Government’s responses seem ad-hoc, flip-flop and lacking in foresight with a fire-fighting style.”

Among the problems that Yong said would remain unsolved were poverty eradication, rural development, racial politics, illegal immigrants, crime and drugs.

*************************************************
The Sabah 20-point agreement

Point 1: Religion

While there was no objection to Islam being the national religion of Malaysia there should be no State religion in North Borneo, and the provisions relating to Islam in the present Constitution of Malaya should not apply to North Borneo.

Point 2: Language

    * a. Malay should be the national language of the Federation
    * b. English should continue to be used for a period of 10 years after Malaysia Day
    * c. English should be an official language of North Borneo for all purposes, State or Federal, without limitation of time.

Point 6: Immigration

Control over immigration into any part of Malaysia from outside should rest with the Central Government but entry into North Borneo should also require the approval of the State Government. The Federal Government should not be able to veto the entry of persons into North Borneo for State Government purposes except on strictly security grounds. North Borneo should have unfettered control over the movements of persons other than those in Federal Government employ from other parts of Malaysia into North Borneo.

Point 11: Tariffs and Finance

North Borneo should retain control of its own finance, development and tariff, and should have the right to work up its own taxation and to raise loans on its own credit.

Point 12: Special position of indigenous races

In principle, the indigenous races of North Borneo should enjoy special rights analogous to those enjoyed by Malays in Malaya, but the present Malays’ formula in this regard is not necessarily applicable in North Borneo.

Point 15: Education

The existing educational system of North Borneo should be maintained and for this reason it should be under state control.

Point 17: Representation in Federal Parliament

This should take account not only of the population of North Borneo but also of its seize and potentialities and in any case should not be less than that of Singapore.

Point 20: Land, Forests, Local Government, etc.

The provisions in the Constitution of the Federation in respect of the powers of the National Land Council should not apply in North Borneo. Likewise, the National Council for Local Government should not apply in North Borneo.

So Sabah and for that matter Sarawak has been hoodwinked all this while and cheated from whatever rights which is rightfully theirs?
If that is so, what took them so long? why it took the such a long time to realise this fact and yet throw in 100% support for BN government????
I believe the answer lies in the personal gain expected by the politicians there. The same goes for the state leaders here, there must be some kind of benefit in it for them to happily agree with whatever conditions put forth by the Federal government.
I just hope all this facts will open up the eyes of the affected people of the misdeeds and misleads by the present leaders who has done more harm than good to the welfare of ALL Malaysians!

Let us hope ,the enlightenment will encourage them for once to do the RIGHT thing and change the future path of our nation to a brighter one.

Let us work together and propel this nation to its glory in true sense.
Ditch Be End and let it be THE END for them!

Let the new dawn shine upon us all! I know it is still a gamble, but it is worth a try. I for once couldn't stand the fact that we have a weakling leading the nation blindly into oblivion!

Let us stand up and be counted and be acknowledged as people who CHANGED HISTORY of a nation.

God bless all true Malaysians!

You did not mention the oil and gas in the Joint Development Area with Thailand that the Federal Government under TDM land it in South Thailand and piped it from the East coast across the Thai Southern Province to Kedah robing 100% of potential income to Kelantan. Just because Kelantan was under PAS and Kedah was under BN then.

Well time to correct what is wrong.

I think there are many reasons lead us to our current mess-up state. One of the biggest reasons is we allow BN administration to have 2/3 majority in the parliament. With such a powerful BN administration, we essentially have no enough political counter balance to what BN administration can do. Another fatal stroke on judicial branch with 1988 Tun Salleh case had cemented the fate of the nation. We have not collectively realized the fate is mostly due to the good fortune of the "black gold" which allowed some reasonable economy growth despite massive corruption and mis-management. A painful lesson here is that people should never ever allow a government (especially the executive branch) to be too powerful -- 2/3 majority should never be given. Another painful lesson is the need for people to stand up to ensure judicial institution is of equal footing and power comparable to the BN administration (or future administration). Judicial branch is not supposed to be reporting to BN administration. By the power bestowed by the Constitution, the Parliament can create laws. We should allocate additional power to the supreme court for deciding the constitutionality of the laws passed -- this will effectively create an effective situation to counter the power of the legislative and executive branch. It will take a long time to undo the fate of this nation, just like it took quite a long time to decent into such a rotten state. We have no choice but to correct this sorry state, one item at a time.

"North Borneo should retain control of its own finance, development and tariff, and should have the right to work up its own taxation and to raise loans on its own credit."

then Sabah could possibly afford what Brunei people had been enjoying all these years : Free from paying Income Tax with all the oil reserve!!

The problem is that our UMNO taiko in BN has forgotten the spirit of Federation of Malaysia. Compounding the problem is that current members with some position of authority (real or imagined) lacked respect for constitution or agreement that make a democratic Federation of Malaysia.

All in UMNO has lost direction and much needed courage to rein in the 'intelligent' or 'influential' ones. Such as these ones: http://mylivingwall.com/v3/ind...y-dan-Ezam

Collective leadership in BN must be reinstated by today's BN Supreme Council meeting. I give Ong Ka Ting full permission to push this and send this message on my behalf. Also, please don't forget to tell UMNO that BN must listen to rakyat and make life happy for rakyat. Cooperate with people to make sound national policies and drive it properly. (keyword is 'drive') All within the BN must monitor and sound each other if any runs off track.

What's so difficult for BN to say "Sorry, we will make it up for Rakyat of Malaysia?"

We await strong Pakatan Rakyat and Barisan Nasional. Otherwise no meaning or self driven improvement with only one party monopoly the political landscape.

Will it be possible for the disgruntled states to get their own "state TV" and air all the discontent and treachery involving the federal gov?

For instance, Kedahans will want to know why the Federal gov didn't send them any money and the main reason behind logging in catchment areas. I mean, Kedahans will not want to blame the state gov in 20 years for water shortage right?

So all state governments should get their own state tv and broadcast the truth.

Please enlighten me:
The Federation Agreement of Malaysia is an agreement between Malaya, Sabah, Sarawak and Singapore.

Does that mean exit of Singapore from the Federation in 1965 effectively "voided" the Federation Agreement of Malaysia, and The Federation of Malaysia ceased to exist?

If you look at the 20-point agreement posted:

"Point 17: Representation in Federal Parliament

This should take account not only of the population of North Borneo but also of its seize and potentialities and in any case should not be less than that of Singapore."

I believe this "clause" is no longer valid since the reference to Singapore could no longer apply (since Singapore is no longer part of Malaysia Federation). Does that mean the 20-Point Agreement too "voided" and cease to exist when Singapore withdraw from Malaysia Federation?

I am no law student, please advise. smilies/grin.gif

Everyone will be happy.

The Malayan's with get their PR in government.
The Filipinos and the remains of the Sulu Sultanate would have to get off our case.
Those that entered Sabah illegally, its ok, you can stay. We know you have loyalty to Sabah too as you did leave the Philippines and our histories are so entwined anyway.
We'll have 100% of our oil & plantation royalties back thank you very much, we'ld also like our pride and identity back as well if you dont mind.

Those of you who have been to Sabah know that we Sabahans are simple yet friendly and live in harmony with all races until Umno forced its politics and religion on us to divide and rule.

Let's kick Umno/BN out and make Malaysia truly Malaysia for all.

By the way, Sabah still want our rights on the 20-Point. No comprendo!

We were heavily oppressed mind you bit some of greedy leaders i.e Tun Mustapha and Datuk Harris Salleh are to blamed fully because they backed the federal decisions. Rakyat not consulted, otherwise we'll never lost our rights.

During that tine, anyone questioned the move would be imprisoned or they'll think of something to quite you down. That was our situation when we 'lost' our rights! Damn.

Wasn't it KuLi who masterminded the PDA and the formation of petronas?
Wasn't it Tun Razak, the ultra Bugis in Umno, who curtailed the states freedom and created a power based on malay politicians.
and that policy was further exploited by mahathir?
Better for states to have more power and less power in the hands of the few in fedral govenrment. All those oil and gas money actually benefited klang valley residents such as KLCC/Putrajaya etc. Nothing let for the kampung folks.

“We must maintain this precious unity to the best we can, coexisting together requires us to understand, respect and be tolerant with each other,” Tuanku Mizan Zainal Abidin.

Man, did the UMNO-led federation heed this advice from our beloved King? Yong's move gonna sparks interesting drama and hopefully more will join the party in turning a new page in Malaysia history.

You see, I'm not a supporter of two wrongs make a right policy, but to further debate on whatever agreements made prior the making of Malaysia is not going to be fruitful. Multi-racial Malaysia experiences unique peace with one side practicing undeniable tolerance while another UMNOputra sabotages everything, squeezing the resources of every state and now deny fund allocations to opposition states (not as a way to cut federation cost) but to further enrich themselves. Hidden clauses behind every agreement made were legalize in an unMalaysian fashion and must be stop once and for all for the good of the nation.

And what's the best way to start a change when it's best to happen from within the federation? We shall see...

The taxes and other revenue paid to the Federal Government should not be deemed by UMNO as its own money to do as they please. The revenue and taxes are collected from all citizens of Malaysia, irrespective of race or states, and hence funds for development should be handed over to each state on a need basis or in proportion of the taxes collected from each state. UMNO has absolutely no right to withhold or deny funding for any state just because the rakyat of that state voted in a different political party.

Don't forget we practise democracy and UMNO/Federal Government has to respect the choice of the people of that state. UMNO, stop being childish and immature, by punishing the rakyat who did not vote for you. Show maturity, wisdom and leadership. The Government money is not your own personal or UMNO's money. It belongs to the people, irrespective of whether they voted for you or the opposition.

Because Singapore is no longer part of the Federation, ie: zero, Sabah received nothing less than Singapore. Therefore, Sabah got ZERO! Way to go UMNO!

i think Sarawakians still do not like the idea of any West Malaysian party coming into Sarawak and Anwar as a leader. hopefully Anwar will come up with some good ideas how to ally the fears of Sarawakians against himself and PKR.

All Sabah MPs should think seriously where their allegiance lies- to unmo/bn or to Sabah and its people. The umnos have exploited Sabah, its people and its natural resources, and some Sabah MPs like Raymond Tan, a pure breed Sabahan, are still casting their support on those who have robbed them. As Yong T.L. said, this is the only window of opportunity available, and all Sabah MPs should rally behind him to demand what are rightfully theirs. It is not a question of supporting the vote of no confidence, but a question of regaining what was lost and that Sabah belongs to the Sabahans. Fight for it man.

http://sangkelembai2006.********.com/

Thank you Pete for the well researched article, very very informative, ---and i was thinking all the while there was something wrong with the states--------with the usual rhetorics by the Umnoputras.

I also realize how the Federal Govt brainwashed the Rakyat with disinformation, to suit their agenda of robbing the states in sheep's clothing-- with calls of treason , unpatriotic etc about the rights of the States and deals made in writing -----and the Ketuanan issue was their trump card to pull the innocent Malays into a cesspool.

I'm sure now --- we know March 8th was the opening of Pandora's Box , and the nail to UMNOs coffin is imminent .

Now we should fit the jig saw of why they kept the eduction standards low in a way for the Rakyat to remain as innocent, and to use the PDRM for even the slightest dissent!!!!!!! Umno failed to realise that nothing is forever if evil deeds are manifested with ugly rules in a game .

Im sure now Paklah and all his cronies are taking time to close their accounts to leave Malaysia for good . All this while the machinations of the UMNOPUTRAS with the help of the MSM did the job!!!!

Hope the Rakyat in the non Pakatan states wake up to this evil that was strung to our ears and give rise to change once and for all .

Thanks to you Pete for these truths!!! you take care .

My question is to why and who allowed UNMO into Borneo?
During the days of Mustapha & Harris, UMNO wasn't allowed.
When they were that was the end of the 20 point Agreement.
Now, (1) get them out of Borneo.(2) All component Parties of BN in Borneo should get out of BN. As independent Parties you will yield more power in National politics because you will carry the all important swing votes. Why should UMNOputras enjoy bumi status in Borneo? They and the illegal Indon/Filipinos should all be deported.

Take for example North-South Highway-haw many states can benefit if they are given the right to share some percentage of the toll collection which incur along their respective states. Now, under nego.garbage collection concession for 20 years to Alam Flora, SWJ and the like. What is the point of making this agreement? Our complain will not be heard-guarantee. SWJ in Johor-They not entertain any complaints. They sub contracted the collection to their cronies which in turn sub let it to others. What left of us is poor collection system and foul smell. Now, the so called Federal government will be making a deal with them. End to their stupid rule. To the Housing Minister - Don't make us suffer under those concessionare.

Recently, the trigger-happy DAP formed an organisation known as graftbusters, headed by top officials such as Tony Pua, & Gobind Singh Deo,to give the public a chance to expose corruption & inefficientcies of the barisan government. As such, I took the opportunity to write them a letter with regards to my experiences on the above mentioned. However, there has been no response whatsoever from these arrogant people. My letter to graftbusters is as follows:-

LETTER TO GRAFTBUSTERS,
APRIL 24TH 2008

Dear sir,

Congratulations on the formation of this organization which I hope will be a great help to the public at large. I wish to draw your attention to several matters that are of grave concern to me as a blind individual. Although they may not be related to corruption but I strongly feel abuse of power is involved.

Firstly, I lodged a police report about 2 years ago with regards to a cheating case and believe it or not, I have not heard from the investigations inspector even after several reminders to him for a progress report. In this particular case, I think that abuse of powere is involved because the person who swindled me claims to be related to Ali Rustam, the Chief Minister of Malacca.

At around the same time, I took a case against a trader in the consumer tribunal court for selling me a product that was not user-friendly to me as a blind individual. Furthermore, the trader even made false claims about the product which he sold me. The reason for my highlighting this problem is because I felt that the trial judge of the court was rather biased in his judgement and only sent me the written judgement after more than a year after numerous reminders, so that I had no recourse in contesting his judgement in the high court.

Finally, I wish to draw your attention to the fact that I was relieved of my job as a disc jockey with RTM for no apparent reason. I consequently wrote to the then Information minister, namely, Khalil Yaccob several times for assistance in the matter, but all my letters went unanswered. I also wrote to Suhakam and the Prime Minister himself to intervene in the matter but all my efforts came to zero. Last but by no means least, I approached the MCA complaints officer, namely, Michael Chong for assistance but was given the cold shoulder. I have also tried to highlight my predicament with the press but again, all neglected my pleas for assistance. Should you be interested to look into the problems which I have brought to your attention, please visit my blog and all will be revealed. My blog address is as follows:-

http://alfredhomusic.********.com

Looking forward to your early reply and may your organization grow from strength to strength.

Yours faithfully,

Alfred Ho.
