Zaid Ibrahim Contradicts Royal Commission of Inquiry-Lingam Tape PDF Print

1.    I refer to the Star news report dated 23rd May 2008 with the heading ‘’Zaid: Bill on JAC to be tabled soon’’.

2.    Zaid Ibrahim, the Minister in the prime minister’s department is reported to have said ‘’The Government is committed towards accountability and will not accept absolute power enjoyed under the term prerogative. Previously, a Prime Minister could say that he was not required to inform the Rakyat about his decision as he had the prerogative to make his decisions and need not explain anything’’.

3.    Zaid Ibrahim has knowledge and confirms that it is not wrong in law for a prime minister to enjoy prerogative powers when exercising his duties and functions in making decisions when administering the government. However in reality the prime minister does not have absolute power as the prerogative is exercised reasonably and sensibly by the prime minister in the interest of the government and the Rakyat in important or essential matters.  It is the norm for a prime minister when exercising this prerogative not to give reasons for his decisions to the Rakyat as there is a matter of ‘’confidentiality’’. If the prime minister is required to explain anything to the Rakyat on the exercise of his prerogative in the making of decisions then there would inevitably be a breach of confidentiality and it will not only act to the detriment of the interested party but also have serious repercussions to the prime minister and the government. If an explanation is required for good reasons to be given to the Rakyat by the prime minister, the proper platform would therefore be to the Dewan Rakyat in Parliament. The prime minister has always acted with accountability to parliament on similar lines with the Westminster-Parliamentary system.  

4.    Zaid Ibrahim is further reported to have said that ‘’the judicial reform was carried out to restore confidence in the judiciary and was not an effort to smear the name of former Prime Minister Tun Dr. Mahathir Mohamad’’. However, Zaid Ibrahim’s statement is absolutely contradictory and inconsistent with the findings of the Royal Commission of Inquiry-Lingam. The members of the commission, obviously have knowledge that the prime minister has the prerogative to make decisions but has deliberately decided to ignore this and instead stretched their minds and their hands to the very limits to drag Tun Dr. Mahathir in and throw the ‘’book ‘’ at him for alleged offences under various laws of the country. The so-called judicial reform to be carried out by Abdullah Badawi and Zaid Ibrahim as well as the setting-up of the Royal Commission to restore confidence in the judiciary is certainly politically motivated (and this is confirmed by Loh Gwo Burne, Kelana Jaya Member of Parliament, The Star, 17/5/2008) to disrepute and smear the former prime minister, Tun Dr. Mahathir Mohamad. Therefore for Zaid Ibrahim to say that ‘’………was not an effort to smear the name of former Prime Minister Tun Dr. Mahathir Mohamad’’, cannot be accepted as to the truth of the matter.

After reading this post, I have completely lost the meaning of "non-partisan". To me a non-partisan just sits and watches the events. He shuld not take part - neither by act or speech. Period.

TDM had openly shown his scorn and disdain for lawyers. So I'd suggest if you need to post any thread here, do not identify yourself as a lawyer. A mouthpiece for TDM is OK, but not like that barking lawyer who challenged the former Lord President who claimed he had 30 years practice experience with nothing to boot in the Law journals.

You may be right Yacob but we cannot use your arguement to undermine the raayat aspiration to see a more transparent and accountable judiciary system.

You can pack your bags and find a society that can accept your "legal arguement" and please take TDM along with you. Perhaps in one of the countries in South Africa where you can say or do anything under the sun.

Anyway it is timely that TDM be thrown the book for the offences relating to executive interference, abuse of power and conducted actions that are unconstitutional.

All this is just sandiwara. AAB and TDM playing games to give time for BN to take back what they lost to PR in the last PRU.

Dont be fool by all these "we have learned from the rakyat" from them. They are plotting something....

Hello "Non-partisan lawyer" - please read your article several times before you sign off as the above.

It is best for you to leave the "non-partisan" bit, well you can have the lawyer - glamour kan !!

Guess as a lawyer you have nothing else as a issue!!!!

The authority to given to the PM to use discretionary powers is a privilege, not a right. He also has to demonstrate that he uses this privilege with care, concern, accountability, ethically, and cleverly. If this privilege is abused, as it has been showned to be, then his power must be brought to account. This authority isn't a divine authority as this and other PM's may wish it was.

this is the side kick of the other mouthpiece... what do you expect? Non partisan my foot! It was clear to everyone that when questioned, TDM was hiding under the cloak of "prerogative" to avoid the truth, and not for any reason of confidentiality. The argument of authority, prerogative powers he is putting forward is irrelevant.

What's clear is this author is a Mahathir sympathiser. What's less clear is whether he is a non-partisan lawyer, or for that matter whether he is really a lawyer.

It is incredible that he thinks PM's exercise of prerogative means he does not need to answer to anyone because of confidentiality. Please lar. If it affects the people directly, what's there to be confidential about? Even if PM don't tell the journalists, people will find out on their own - it is not as if it is some secret economic masterplan or secret weapons development project. And when Zaid said the Lingam inquiry is not to sully the good name of Mahathir, he probably means it was not specifically intended to do so. But if the inquiry reveals misconduct on the part of the former PM, then we have to call a spade a spade lar, regardless of whether Mahathir's name will be dragged through the mud. Mahathir is one person. He should be responsible for his own actions because he's been taught to have a mind of his own since young. But Lingam inquiry owes the nation a responsibility to get to the truth so that we may regain confidence of the international community towards our judicial system and in turn our economic competitiveness. There's no two ways about this issue.

If there is any criticism to be levelled against Zaid or Badawi Administration in general, it should be this instead - WTF are they waiting for???? Is Badawi going to take another few years to read it???? We want to read the full Lingam inquiry report, now!
