KUALA LUMPUR: "This kind of misbehaviour is so unprecedented that were it not for the release of the video clip, it may never have come to light."

This was a key conclusion of the Royal Commission of Inquiry into the Lingam video clip on questions revolving around the selection and appointment of judges.

The commission found not only outside influence in judicial appointments, but also sabotage and serious defaults in the constitutional process.

It said the misbehaviour ranged from acts and omissions which were morally objectionable, outside the norms of professional ethical standards and which constituted crimes.

Several instances of such misbehaviour observed by the commission were the appointment of the chief justice, chief judge of Malaya, Court of Appeal judges and High Court judges.

However, the question of the nature of sanctions provided by the law for this kind of misbehaviour remains unanswered.

The report, to be released to the public on Tuesday, said that there was extraneous evidence from Datuk V.K. Lingam that "he and his collaborators" sabotaged the late Tan Sri Malek Ahmad's candidacy for post of Chief Judge of Malaya.

It said this was done by influencing then prime minister Tun Dr Mahathir Mohamad.

"Not to put too fine a point on this exercise, TSMA (Malek) was a victim of character assassination by third parties who had an axe to grind, and which he had no opportunity whatsoever to counter."

The commission felt that this would not have happened if Dr Mahathir had consulted the then chief justice Tun Mohamed Dzaiddin Abdullah as to why Malek was considered an unsuitable candidate.

The report said this meant the mandatory requirement of consultation had not been complied with, and called it a serious default in the constitutional process.

The commission also made a note of the fact that the former chief secretary to the government, Tan Sri Samsuddin Osman, had considered himself entitled to nominate prospective High Court judges.

"He does not seem to have considered that such an act on his part was in default of the relevant Federal Constitutional requirements," the report said.

It also called attention to the oaths taken by former chief justices Tun Mohd Eusoff Chin and Tun Ahmad Fairuz Sheikh Abdul Halim when they were appointed.

"We invite attention to these oaths to underline the fact that members of the administration and judges are not merely bound by contractual obligations to keep their promises but are bound by a sacrament which has to be honoured with the utmost fidelity."

Lets not forget the Royal Commission was limited in its scope of enquiry. What we should be more concerned now is the number of cases and trials that these judges have tempered with! The injustice that were meted out by these judges!

At the end of the day it was greed, corrupted mind, lack of fear of God, lack of belief that there is life after this, lack of understanding of the law of karma, lack of the belief that there was absolute law of God. They may have all the belief and understandings on all the above but lack of conviction, along the way they subject to the impermanence materialist worldly attractions such as power, enjoyments and materialistic gains. This lead to their final self destruction, bring along with them shame.

When Raja Petra wrote and comment that "the tinted glass of car was not for the purposes of protection of their safety but they are too shame to be seen by the people they are , I was not quit understand what Raja's mean, but now I fully understand what he meant.

Asking this AG to investigate and take action is infact making sure that the investigations are watered down and files closed. Not enough evidence. Dont bet a sen that you are going see any of the six, let alone others, in dock. We will have to wait for the new non-BN government to come in and put things right.

For God's sake, for the country's sake, for the sake of Malaysians, for the sake of justice and integrity, take the AG, Ghani Patail, off from his term of office, request him to pre-retire or take the optional retirement.

If he still insists to finish his term of office, then charge him for dereliction of duty, impropriety, and collusion.

Do we still need to provide more evidences of his negligence and his lack of ethics and professionalism in discharging his duties?

Do we still need to put Malaysia to shame in the eyes of the international community?

as pm, didn't mahathir swear to protect our constitution. now it appears dat not only did he not protect it, he actually conciously violated it. isn't dat TREASON? i understand d punishment is death by hanging.

no wonder d mamak is so desperate to save his ass.

The fact is, we need to rise from the ashes again. Nothing less than a total revamp judiciary will do as even the current appointments of judges are tainted.

TDM said he wants to bring UMNO to her former glory. TDM wants to protect the rights of the Malays and said they no longer have the respect of the non-Malays. Is this the price the Malays and the rakyat are paying for TDM's illusory ideals? If Malaysia ever have a racialist politician to boot, TDM is the one person. He would destroy this nation. And he would destroy the people and citizens of this country. His near-sighted policies are taking a very heavy toll on Malaysia and her people. Dr Mahathir is now talking about the right of lobbying! Doesnt he know that the judiciary is the pinnacle and symbol of the nation's value system! Doesnt he know that judiciary cannot be tempered with and is not subjected to any lobbying by any individuals!If you can allow lobbyists to negotiate the directions of your judiciary then there is no difference between you and a father who brokers and determine the value of his own daughter's body!

This is just the tip of the iceberg , in the days to come, all roads will lead to Putrajaya. Then youll see the connections.These are the cheapest scums who did injustice to the people day in a day out . God knows how many died in want of justice. Pak lah has to pull up his socks. If he goes on these Imamish distraction -- there may be also surprises for him -of his can of worms !!

Wake up UMNO, are you having amnesia to charge the papers under the OSA. Just dig into your own backyard for the worms , its in tonnes.! So you want to keep everything as your trump card?

The reports of the Royal Commission on the Lingam video-tapes brought about a new dimension on the attitudes & misbhaviour of our high-profile figures in the Government & the Judiciary.
The testimonies under oath during the RC hearing itself had shown a very low ethical standard & behaviour of these professional who stooped so low in their responses when publicly:....
a) they tell lies.
b) they furiously deny.
c) they feign amnesia.
d) they try to twist the facts to cover their misdeeds..... Everyone trying to wriggle oneself out of suspicion of any wrong-doing

The China has Justice PAU, famous for for his capability to solve cases and brought true justice to the commoners, now we also have famous judges but but totally at the end of world. Those implicated will one day being remember non other than the Chinese running dog of the name " CHING KIU" who has single handled to plot the fall of the warrior " YIP FEI". "CHING KIU" and wife grave was spit and to remember them, the chinese has come up with the snak call" YOW CHA KIU", which is still easily available at any pasar malam, even the non Malay also know how to make them. This snack is make of flour and put together like husband and wife being tied in bundled and deep fried in a wok of boiling oil, this was to mean the "CHING KIU" and wife was fried in the wok of boiling oil. So you see know how chinese people remember them. I believe those implicated will be also remember the same way as Chinese remember "CHING KIU"

there has to be a much wider investigation.
all judges metioned during the hearing have to be investigated, eg the "honurable" low or lau who received an envelop - what was in the envelop, what was it for, which case was involved
there are still many unanswered questions

Hail, our hero with the video recorder! Mahathir may threaten. The innocent shall have no fear of favor. The guilty must pay the price (for their ill-gotten gains & favors. The unjustly blamed/prosecuted must be vindicated.

The present gov't will never do anything else beyond this step, ie. after the commission's findings. We need PR to take over, revamp the entire country, and proceed to nail all the culprits. If all six were to be convicted & jailed, it will be shattering & so exciting times in Msia Boleh. After all the fun they had for decades, time the rest of us have some fun too.

This is utter bullshit from Haider & the RCI!!

The ACA NFA'd the case even when there was clear evidence and VTL's brother made police reports and his secretary gave them evidence. They apparently paid her $3,000 and closed the file.

Everyone knew about the ex-parte hearing, others writing judgements for judges, judges & AG's holidaying with corporate tycoons and judges taking bribes as disclosed by Judge Aidid.

But, I Raja Polis, Corrup Assoc & A Gong Generalissimo just glossed over everything to cover up for their political masters.

Now they are worried they will be the next to be investigated by another RCI.

OOOOH! Judges in Malaysia actually I heard over the coffee table can be bribed anytime if get the right people connection! The guy actually boasted to his friends that he can do it for his friend that have a case in court!...He actually negotiate the price! He even mention case criteria! He says if he got case it's free!
