(Aliran) - The only punishment for Tun Ahmad Fairuz, the former chief justice is to strip him of his Tun-ship and all awards ever bestowed on him, says Sarajun Hoda Abdul Hassan.

He has not only turned out to be a disgrace to the legal fraternity and the Malaysian people but also brought shame and dishonor to the Yang DiPertuan Agong, the highest royal institution of the country who appointed him to the post, to the institution of the prime minister, who recommended him, and to all the sultans who bestowed on him awards.
V K Lingam must also be stripped of all the awards bestowed on him and debarred from ever practicing law in the country. All the judges appointed by the controversial bargains should either be retired or demoted in order that the Malaysian judiciary is cleaned up in order that it regains its veneration.

The Malaysian people whose legal privileges has been compromised and transgressed by Ahmad Fairuz’s immoral actions pray that Prime Minister Abdullah Ahmad Badawi will not miss this opportunity to improve people’s impression on him and prove that he is a man of credibility and integrity.

For that, his government must give Ahmad Fairuz a fitting punishment so that no judge in at least a thousand years will ever dare to compromise the judiciary. The prime minister must prove that his Islamic Hadhari teachings do not tolerate such obnoxious demeanor.

This is a question of national integrity. The whole world is watching us. Ahmad Fairuz brought humiliation and shame to the country, to the judiciary and to all lawyers. He and those who were involved together with him in this crime must therefore be severely condemned.

The people also are asking for all the cases where selective judgment was delivered to be re-heard including the million dollar defamation cases. These cases heard by a compromised judiciary must be reviewed and corrected. Those who won these controversial cases or those who escaped scot-free due to compromised judgments must be brought back to court.

The Istana Terengganu is said to have nearly withdrawn the Datukship titles from three people for the recent menteri besar crisis. The Sultan of Pahang revoked the titles of two ‘Datuks’ in 2004 and the Selangor Sultan also recently withdrew six Datuk titles for much lesser sins when compared to the shame and disrepute brought by Ahmad Fairuz to the institution of the Malaysian royalty. The withdrawal of his Tunship and all other titles is fitting. And it must be done at once.

Anyhow, the same should also be done to the other rascals - Mahathir & Eusoff Chin (for undermining the Royal Highness/ citizens of Malaysia), Vincent Tan & Tengku Adnan (the same and more importantly, playing a big part in not only fixing judges but cases as well)

All person(s) implicated in the Royal Commission report should be thoroughly investigated and prosecuted to the fullest extend of the law.

If found guilty, they should be stripped off all titles awarded and pension payments should be revoked.

If Fairuz had done what he did in Singapore you can be assured he would face criminal chrges and get a custodial sentence. The benchmark in Malaysia is so much different. Simple reason. The UMNO-led Barisan Government is always soft and lenient to their own sidekicks. And they use the sledgehammer on all their critics. That is how democracy works in Malaysia. 2 systems of laws for different people. The cronies, goons and political affiliates always get away with their henious crimes. We can get charged for sedition when you get too close to the source. Started all with TDM. What an outright shame and disgrace for all those named and implicated. From the richest business tycoon to the political cloutheads.

Just stripping him off the titles will not do justice to all who had suffered at his cruelty and mercy. All such person and cases must be given a proper hearing and justice administered swiftly. If the new Law Minister and gomen is to have any impact on judiciary reforms, correction must seen to be done and not just said. So when can we see justice done?

Stripping of titles on its own achieves little - dig up case he presided.

for travesties and miscarriages of justice and make him pay:
a) make restitution to the individuals/families
b) commensurate jail terms for every individual offence, ie make sure he doesn't see daylight ever again.

Charge them in a court of law. Let them defend themslves.

Do not hang both of them just like this. There are not convicted yet. They are still innocent in the eyes of law until proven guilty.

More could come out.

Disgrace is one, but to openly lie to the public is worse.

The crimes the supposedly committed while being CJ are subjected to arguement but the fact he denied he was the man VK Lingam talked to is clearcut crime. There is prosecution needed. Either he lied or the Commission lied.

You guys are missing the plot. The one who is the cause of the whole fiasco is Mahathir Mohamed. All these Fairuz, Lingam, Tan, Eusoffe Chin etc are merely his instruments while the folks who voted and kept him in power for 22 years were his accomplice.
Now that some of the shit is in the open and we have taken the first step ( denying the corrupt govt the 2/3 maj), our next step is to get PR into power and embark on our cleaning up of the whole country.

Aliran, have you considered how many lives have been destroyed by this injustice?
How Fairuz's actions have brought odium and contempt to one of the pillars of our government?
People have been sent to jail for contempt of court, and in this case, a chief judge has more than committed contempt, it a serious breach of public trust! And you are asking for merely stripping him of his Tun-ship?
How do we know if he had sent any innocent persons to gallows? Maybe he did? And all you are asking for is to strip him of his Tun-ship?
Dr. Mahathir accused Anwar of screwing people's backside and the court sent him to jail for that, which later was found to be untrue. And this Fairuz fella only gets his Tun-ship revoked? He screwed the whole justice system!!!

Hello? I think a minimum of 10 years jail with no parole is more like it!

These titles are suppose to be bestowed to respectable people but turn out to be the other way around and as such has created much disgrace to other recipients of such awards including our country itself. I have always respected
many bestowed with awards of Datukship and etc, but somehow it looks like the greater the awards they have, the greater crooks they are. I am not too sure who writes the biography of the recipients these days.

Is that all there is to it? Merely to strip him of all his "honours"? As a former Chief Justice, I'd say that he needs to be "judged" himself. Why doesn't the current judiciary charge him in court and let go through the entire legal process? If we need to clean up the entire Malaysian judiciary system, why not start here?

This is the problem when politician has a finger in every pie. Conferring of title also has to have the recommendation of politicians or the government that be. The title comes from the rulers. Then let the rulers a persons detached from politics be the judge as to who merits the conferment of titles. Its given in the ruler's name but the say as to who deserves comes from the politician. Not justified at all. By having this system, power gets accumulated in the hand of the politicians.

As to who should be conferred what, and if its in the name of the rulers, then the rulers as independent parties will view from their point of view who merits the award.

This is a pathetic piece. Stripping him of any honors is the easiest thing to do, but does it do justice to the many who have been wronged and hurt? Surely Aliran stands for greater accountability. Fairuz must be tried in open court, for all possible misdemeanors, crime, commissions and omissions, fudiciary and judiciary abuses, and punished to the full extent of the law.. Nothing less.
There is only one law for everyone, and he is equally subject to it. Lets not talk about stripping this shameful man of his titles, these have nothing to do with justice.
Everyone who has had a part to play in the abuse and descreation of our justice system should be brought to book, tried and punished. Until this is done, its all mere talk only.

The crime that Ahmad Fairuz and other judges or person/persons involved in the miscarriage of justice is absolutely very serious and its implication is beyond comprehension. Stripping their titles to offset this level of crime is highly unacceptable as it only amount a slap on their wrist. The weight of the crime will lend credence that they should be hanged till death as they cannot mitigate that they do not know the law for they are all highly trained in the field of legal jurisprudence. They are worst than murderers as fixed up verdict can put an innocent person to death and vice versa and we do not know how many innocent person had been “murdered” by them...

The Royal Commission findings has proved without any doubt that the main players must include TDM. He is in the main actor, and must be included for punishment. He had brought a lot of development to the country as PM but the shame to be involved in the Judicial fiasco is a different matter all together. The Tun-ships, the Tan Sri-ships, etc., are only titles. That is not punishment. But what these buggers have done are criminal activities of the highest order, as all other injustices stemmed from it.

Revoke their pensions would be considered necessary. Trial by open court is necessary. ISA may be necessary going by the standards of the BN govt, since this is most damaging to the good name of our nation, and therefore is a threat to our security and sovereignty.

And may I suggest that all cases heard by Eusoff Chin and Fairuz, and where Lingam is involved, will now automatically be overturned and verdict will automatically be the opposite to what the original one was. So, MG Pillai has won the case against Vincent Tan, by this default.

These people as named in the Lingam Tape report are damn lucky that Malaysia is not like Pakistan, otherwise mob rules will surely end their lives.

Imagine this, the Chief Judge in Pakistan was sacked and the lawyers took to the streets which was then followed by massive demonstrations by mobs.

It doesn't take much more to imagine that if this horrendous scandal had happened in the same environment, there would have been humongous crowds demonstrating and baying for blood. Wouldn't be surprised that they would be lynched from the nearest tree.

How could anyone, especially the Prime Minister entrusted with care and proper governance by the people, could participate in such a scandal???

Its almost treasonous (maybe it is?), considering he has subverted justice at the highest level and left the nation open to denial of fair justice. Its tantamount to selling the nation's dignity and government down the drain.

And the BN government wants to investigate RPK and Karpal Singh for sedition?

And continue to incarcerate the ISA detainees in Kamunting indefintely?

If you guys are talking so much about loss of Melayu political power, then I think its about time our Malay brethen storm the walls of injustice and bring these traitors to account for their misdeeds! Don't forget that the Malays comprise more than 50% of the population which means that there is a higher probability of more Malays who brought their grievances to court and were shortchanged by the Judiciary!

If this government do not follow the recommendation fo the Royal commission, they should all be held for contempt of Court. This in itself should be a jailable offence. I expect them to persecute all those involved. In fact we the people demand that. What these guys colluded to do is a dastardly act. An act of treason. Perversion of Justice is an inexcusable and heinous crime. It affects the lives of so many. These guys are pariahs.
All those who suffered injustices under this should make their claims to have their justice restored and compensated generously.

Just stripping him his Tunship is equivalent to letting him get away scot free. He should be charged with the appropriate law, and if found guilty, the appropriate sentence be imposed on him.
