Respect for Loyal Opposition Essential for Democracy PDF Print

The Civil Society Initiative for Parliamentary Reform (CSI-Parliament) stresses that a loyal opposition is a legitimate and necessary part of any system of democracy, including our constitutional monarchy.

We strongly criticise the threatened use of the Sedition Act 1948 and the leveling of accusations of treason against anyone who has a critical view of our political system, regardless of whether the person is a parliamentarian, a member of the royalty or an ordinary citizen, especially by those who would take offence for purely populist or politically-partisan purposes.

CSI-Parliament stresses that the democratic space for debate and deliberation on issues of national interest is now more important to protect as the country makes its ways through uncharted waters of deeper democratization and more extensive political plurality at the state government level. 

The initial sacking of Perak Religious Department Director Datuk Jamry Sury by the Pakatan Rakyat state government, the subsequent order by HRH the Sultan of Perak to reinstate him, and the consequent criticism by Karpal Singh MP of HRH the Sultan of Perak’s order have resulted in different perspectives of the law and constitutional convention brought to public attention. 

Let us not forget a similar situation faced by the Barisan Nasional in attempting to nominate its candidates for the post of Menteri Besar in Perlis and Terengganu.  Political convention and processes in the latter cases - hitherto taken for granted - were then called into question by many, including Government and Barisan leaders.  While at the end of the day there can only be one lawful position on the matter, there must be sufficient room for legitimate public discussion and deliberation of what exactly that position is.

In connection with the new controversy over various statements of Parliamentarian Karpal Singh, CSI-Parliament condemns political manoeuvres which are bent on manipulating a complex though legitimate difference of opinion on constitutional law and the position of the Malay Rulers into a so-called stand-off between the palace and the opposition.  Just as dangerous is the attempt by some quarters to portray this incident as a potentially seditious and treasonous questioning of royal prerogatives, and consequently a perceived slighting of the position of one particular community.

CSI-Parliament is confident that wise counsel shall prevail and that the unacceptable attempt by certain parties to take advantage of this situation to promote ill-will and hostility between the races will fail miserably.  It is these irresponsible parties who are the real threat to peace and stability in this country. 

To ensure an inclusive process of democratization and the liberty to engage in healthy and open debate free from threats of sedition and accusations of treason, CSI-Parliament takes this opportunity to echo the longstanding call by the Bar Council and other civil society organizations to abolish the Sedition Act 1948. 

More pertinent legislation to bring genuine threats against the public order before the courts of our land is already available in our statute books.

True as it is but in Bolehland UMNO is above the law. To overcome it the only option is to sent the party to the thrash forever.

UMNO's arrogance is very much alive, the law does not apply to everyone, UMNO is above the law, even RPK (royal blood) can be handcuffed and put behind bars, BUT UMNOputras are spared the law when they flout it, MMT, AAB, Najib, Kerisham, KJ and a long list of them should be charged with sedition, BUT nothing happened, PDRM is helpless when it comes to arresting UMNO morons even when police reports has been lodged, this is the professionalism of our police force.

Whatever the BN/UMNO is doing or appear to be doing seem not enough to strengthen their erroded position, simply because UMNO as a commander of BN has never been sincere to benefit the peasant. All they and their cronies interested in is continue to wield their political power and wealth.

PR and its component members, on the contrary, understand the needs of rakyat. So, while they are strengthening their political standing, PR governments put rakyat's welfare in the forefront. Look around, in a matter of 2 months, PR state governments in Perak and Selangor have implemented more people friendly policies. They especially understand that the "non-Malays" had been sidelined and sufferred under BN/UMNO rule for the past so many years, so the PR governments actively resolve many of the issued faced by the Indians and Chinese. (Not that the PR is unfair to the Malays, but is to put in place the fair treatments that the Indians/Chinese were deprived over the years.)

Observing all these unfolding, I am in agreement with DSAI that we Malays need not worry that we will lose our rights. Instead it boosts the equal rights and oppotunities for all Malaysians, and secure the confidence of our non-Malay sisters/brothers towards a better future in this country.

We began to see the light for the future of the Malaysians under PR, and grow more confident should the PR assumes the federal government. The PR is practicing "Ketuanan Rakyat" instead of "Ketuanan Melayu."

The role of opposition was never appreciated all thru history. A politically and racially strong ruling government arouse issues pertinant to dominant race in the hope that they garner support of the race as long as possible. So, in the case of Karpal's statement, it has become very sensitive, not withstanding whether the ruling politicians and interested racial affliations understood the law, these elements are there to create confusion among the dominant race so that the opinion and efforts of the opposition will be kept at a low profile. The solution could be true legal clarification that has to be publicised widely so that citizens will understand clearly on the issue raised. The process is long and require a sincere media coverage to tell the truth.

UMNO is a leech, a parasite that only bleeds the nation's resources dry. PR is the antidote to remove this cancer from our soceity. UMNO is desperate as it senses impending doom, so it resorts to arcane laws like the sedition act to suppress the Opposition.

I support the comments by the quintet of Dr Lim and company. In a democratic society, we must draw a clear line between destructive comments and constructive comments. Do not try to play around with mystical connoctations and interpretations. Thats where the ill informed will be dragged into the foray and explode. Our leaders must speak up and cannot remain silent as it is the situation now. Kapal is surely trying to emphasise the rights of the state govt. of the day and it certainly has got nothing to do with anyone even the rights of any individual or head of state. Maybe all they want is ask we the rakyat to remain dumb and let the stupid govt. do what it likes and fancy.

Let's retreat to our respective corner and then meet half way. I am sure our royalties know this and the rakyat know this.

Only Umno don't. They are using the royalties to rile Malay support to save the party. Sorry, Malaysians have awaken.

The boisterous & self-hair pulling reactions of the Umno leaders, in response to the sacking of a religious director by the Perak MB and the subsequent remarks by Mr.Karpal has set in motion a very serious controversy wit sinister motives.
With those loud calls for criminal action against poor Mr.Karpal by you know WHO smacks clearly of instigation & manipulation of the masses by local & federal warlords, using this opportunity to cut the opposition down to size.
This episode wo't be the last.
The opposition should beware the warlords will create more of such incidents
to divert attention from the serious infighting within the party.
The demise of Umno is imminent.

UMNO is like a drowning man clutching even to the finest straw trying to keep himself afloat.That is exactly how they are trying to exploit the Karpal/Perak Sultan issue to the hilt. The standoff between UMNO and the Sultan of Perlis and Trengganu is a clear testimony that they are free to do what they like, but you are not allowed to say anything even though you are right.

The only way to prevent chaos in this country is to exterminate UMNO once and for all.
