Fumbling denial of of the Najib-Altantuya connection PDF Print

What alarmed the public was the extreme sensitivity displayed by the public prosecutor whenever the name of Najib Razak cropped up and the very aggressive obstruction he put up to ensure that the name stayed out of the court proceeding.

A statement by Deputy Prime Minister Najib Razak’s press secretary to deny any connection between Najib and the Altantuya murder case has failed to quell public skepticism over official handling of the case. This statement dated 30th April 2008 by Tengku Sariffuddin Tengku Ahmad was in response to an article titled “Let’s send the Altantuya Murderers to Hell” written by Raja Petra Kamarudin in the Malaysia Today website.

A core issue of the controversy is: Is it true or not true that Najib was acquainted with the Mongolian beauty? An affirmative answer would have disastrous consequences on Najib, for he had repeatedly denied any knowledge of this girl (to the extent of invoking the name of Allah) during mass rallies in the Ijok by-election in April 2008, in response to intensive attacks by Anwar Ibrahim.

Reading through Tengku Sariffuddin’s nine-paragraph statement, one is uncertain whether Najib actually denies or merely “reserves the right” to deny acquaintance with the girl. I quote from para 3 of the statement:

“While it is up to the judiciary and police to deal with these allegations, Dato Sri Mohd Najib reserved the right in this ‘public opinion’ court to reiterate his earlier comments that he did not know and has never met the deceased. As such all these allegations are unfounded and designed to tarnish his standing within the Malaysian public.”

If Sariffuddin means Najib does not deny but merely reserves the right to deny this acquaintance, then how could Sariffudin follow this by saying “As such all these allegations are unfounded and designed to tarnish his standing within the Malaysian Public”?

If however Sariffudin means this statement to be an outright denial by Najib, which appears to be the case, judging from the general trend of the statement, then the present denial is in conflict with Najib’s previous stand to refuse comment on the basis of subjudice when an alleged photograph showing Najib having a meal with Altantuya was first asserted in court last year. Why didn’t Najib deny then when the news broke out, if in fact such comment is not subjudice? Isn’t Najib contradicting himself now by his present denial?

EXPLOSIVE PHOTO

In any case, it is pertinent to re-visit the explosive revelation that took place in the court on 29th June 2007 (Day 10 of the trial). Answering a question from Karpal Singh (lawyer for Altantuya family), prosecution witness Burmaa Oyunchinmeg (cousin of Altantuya, also known as Amy) testified that she was shown a photograph by Altantuya upon the latter’s return to Hong Kong from France. In the photo were Altantuya, Razak Baginda (third accused) and Najib Razak having a meal at a round table. Amy, 26, said she could distinctly remember the name of Najib Razak because she asked her cousin whether the two men were brothers, since they had the common name Razak.

In para 4 of Sariffuddin’s statement, he dismissed the said photo as hearsay, saying that it was not produced in court and that the claim of Altantuya having dinner with Najib and Razak was never corroborated. Such assertion by Sariffuddin was dishonest as it gave the impression that the court had failed to establish the existence of the photo. Whereas the truth is: Karpal was disallowed by judge Zaki Yasin from further examining Amy regarding the photo amidst heated argument and protest from prosecutor Mazid Hamzah and defence councel Hazman Ahmad (for first accused, chief inspector Azilah Hadri), who objected to Karpal’s line of questioning. Judge Zaki then dismissed Amy and ordered for a recess of 15 minutes before calling the next witness.

It is therefore not a case of not being able to establish a Najib-Altantuya link as implied by Sariffuddin, but a case of the court not allowing such a subject to be pursued.

What alarmed the public was the extreme sensitivity displayed by the public prosecutor whenever the name of Najib Razak cropped up and the very aggressive obstruction he put up to ensure that the name stayed out of the court proceeding.  Such conduct betrayed ulterior motives, for a conscientious prosecutor, whose ultimate objective being to seek truth and serve justice, would not only refrain from blocking such new evidence but would on his own initiative probe into it.

STARTLING REVELATIONS

In fact, the court was duty bound to pursue such new lead involving Najib, considering the startling revelations made by Razak Baginda in his affidavit to the court earlier last year. In a desperate effort to secure bail, Razak’s lawyer Wong Kian Kheong read out an affidavit in court on 20th January 2007, which revealed among others, the following:

  • On 17th Oct 2006, Razak sought the help of Najib’s aide de camp DSP Musa Safri to deal with Altantuya’s harassment against Razak. Musa then promised to send one of Najib’s bodyguards, chief inspector Azilah Hadri to help Razak.
  • On 18th Oct 2006, Azilah met Razak for the first and only time at the latter’s office. Azilah told Razak that he had killed more than six people in the past and that he could help Razak.
  • On 19th Oct 2006 (the day of murder), Razak called Azilah for help when Altantuya created a commotion in front of Razak’s house.

Later, three plainclothes police personnel were seen taking Altantuya away in an unmarked car at Razak’s house.

The same night, Azilah phoned Razak and said: “Sir, you can sleep well tonight”.

  • On 20th Oct 2006, when Razak met Musa in Najib’s office, he enquired about Altantuya, and Musa replied that he had not been updated by Azilah yet.

The first and second accused (Azilah and Sirul) who were both Najib’s bodyguards were charged with killing the girl, and the third accused (Razak) who was a close friend of Najib but not a government official was charged with abetting the murder.  The question now arises: how could the first two accused have obeyed the order to kill from the third accused when the following facts are taken into considerations?

a) these bodyguards who were from the Police Special Action Force were trained  to carry out extreme duties and to obey orders absolutely from the superior like a “robot”, as testified by the deputy commandant of the police unit earlier in court.

b) Razak who met Azilah for the first time was no superior of these bodyguards.

WHO GAVE THE ORDER?

Considering these bodyguards did not know the girl, and hence had no motive on their own to kill her, the next question that begs for answer is: Who gave the order to kill and to destroy the body in such bizarre fashion?  Tracing the sequence of events, the first target of investigation should naturally be Musa Safri, as he was the one who sent Azilah to Razak. And since Musa works directly under Najib and has limited authority himself, shouldn’t the next object of investigation be Najib the ultimate boss?

Why didn’t the police investigate Musa and Najib? Without such investigation and without their presence in court to answer critical questions, can any one blame the public for calling the police investigations flawed and court proceedings compromised (to borrow the expressions from Sariffuddin)?

And what about the shameful spectacle of the prosecution case, originally scheduled for one or two months, now dragging on and on to almost one year with no end in sight while time voids are filled with witnesses and testimonies of doubtful necessities?

Prime Minister Abdullah Badawi has announced big steps to restore judicial integrity; how about starting with a small step by removing the eyesore at hand that may soon become the infamous Altantuya trial?

The pertinent question, who gave the order was supposedly Azilah's defence until the script was changed (his former lawyer excused himself)....now they are re-working on the script not to get Najib to do his cameo appearance as well as grand entrance as the accused.
The state of denial continues even, syed hamid accused RPK of lying on reason to leave sg buloh...

Najib is not going to be the next PM, Altantuya did not die in vein, and Malaysians are NOT going to forgive a BN leader for MURDER!

Najib's hell will be here in Malaysian, when he single handedly (actually with Rosmah, his side kick) bring about the downfall of BN. Just think of it, who is the right mind, is going to vote for a guy who is strongly linked to a murder case?

UMNO/BN will eventually be forced get rid of Najib, he is a freakin' liability to them! This case is a wake up call to right thinking and God Fearing Malaysians - which is the majority! We have taken enough of bullshit from our government for 50 years - we are all awake and well aware of the going ons. You can't hide the truth anymore. Your jesters in the courts today are just too stupid - they don't have the brains to twist and turn and hide anymore. These jokers are up against the best brains around - the rakyat (who do you think the bloggers are - its The RAKYAT. We are much more educated then those morons!)

Justice will prevail and the murders (all of them, especially the indirect ones) are certainly going to hell!

in countries where "rule of law n justice" r upheld in every sense of d word, "subjudice" n "prejudice" r often cited to ensure d accused is provided wit a fair trial.

in capital cases where decisions of guilt or innocence r pronounced by a jury, d whole idea is to insulate these ppl from any external pressures n influence dat may steer d outcome one way or another.

but in malaysia, where trial by jury no longer exists, v need to ask whether d above same standards need apply. first, v need to examine whether it is true dat v r totally prohibited from publicly discussing d details of an ongoing trial? r v not allowed to examine, form n write opinions based on details provided by our press n other public media?

wud such opinions constitute any pressure or influence on our judge/s to call d case in a certain way? does d public not hv d right to ensure justice is properly carried out?

let's examine n answer all these first before anyone comes out to threaten "subjudice" in order to silence wat is essentially a basic ppl's right to fairness n justice.

Judging from what is going on. it will prolonged again until UNNO general Election. the timing of the verdict will be made only after najib takes over. cos it's premediated that the trial will be concluded as a mistrial. just as the public sentiments is slowing down, RPK raise it up.
they tried to silence him but instead it creates more publicity and attention toward the case.now with worldwide attention, it will be hard not to raise an eyebrow.
look like it's going for a mistrial cos if any of the 3 if found guilty , they will squeal out the truth, najib is trying to protect those 3 with the help of AG.anyone that's being charge will ultimately blow the whistle so to aqquit all 3 will be ideal verdict for najib.when the trial commences, the media will be controlled in order not to give publicity towards the case and it will be a long one before the timming is right.

if badawi recommends the commision report to be made public,the judiciary will look bad and the altantuya's verdict will hang doubts over najib's involvement.it's an issue tussle amongs those in badawi's camp, najib's and pakatan rakyat and not counting those umno warlords who's interested in the country leadership. if he runs for presidency in the Umno elections. someone will hold a TRUMP card to bring him down.

The whole case stinks to high heaven right from the very beginning. There are too many holes in the story. Any layman can tell that there is hidden hands trying to cover up the real culprit or culprits. No courts or lawyers in any democracy would believe the story now being spinned about the case. The question is, why? The picture will be a lot clearer after the verdict. Poor Altantuya.

If prosecution witness Burmaa Oyunchinmeg said she saw the photo I think she has no reason to lie. This photo is very likely to be in Mongolia waiting to be exposed at the right moment and it must be worth millions to some poor souls.

No one believe before the elections when RPK mentioned that BN will lose 5 states. After the elections 5 1 states were won by PR.

No one believe that Altantuya case will be fair. But someone in BN is helping RPK to reveal the facts on Altantuya case by charging RPK with sedition which facts on Altantuya and Najis relationship/relevance will have to be presented. Whatever Altantuya case wants to hide shall be reveal in RPK's sedition case.

One more thing, please do not help Najis & his evil half in shutting down MT by mentioning their names. Whatever excuses by BN will be used to shutdown MT before the sedition case.

(b)Bill Clinton denied he had extra-marrital sex with Ms. Lewensky.
(3)MB with 2 Mohds.in his name denied he married his Sultan's daughter.

1) PDRM wannabe. Total disgrace to the royalty name. Mostly the higher up PDRM officers are BN goons
2) Sedition Act - Still think rakyat doesn't know ow to interpret this word
3) ISA - This only should apply to those that steal rakyats tax dollars
4) Judiciary system. Not all but unfortunaly most of the higher up

From the above look like the only chance we got is to count on that 30 or so katak politicians. We can really count on them now... DSAI. If we are to wait for another five years Malaysia might be the worst country in SEA.

They have dragged their feet on the trial because they are buying time...If any of you noticed re: the cellphone records have been tampered with,spurious recording records and rubbish technical explanations by the Cellcom and Digi technical staffs. If they can't place the 2 accused at the scene of the crime, since nobody witnessed the murder, then they did not commit the murder. End of case.

A lot of evidence won't be presented in court because the OSA will be invoked. The only way we can seek any justice is for PR Government to take over. Only then we can clean up the judiciary and send all the corrupt BN leaders to jail.

Is this another kangaroo court? After all, the judge, prosecutor, in fact the whole team was changed at the last minute. Why? What I am trying to say is, can we trust this court to be fair and just?

I have grave doubts regarding the way "justice" is served in our courts. Note that Najib is not called as a witness. Why? He should be a key witness. After all it was his two bodyguards who were involved? It was the same with Anwar's trial. Why wasn't the Tun called as a witness? There were a lot of questions the defence lawyers could have asked the Tun, but instead the judge just ignored this and pushed this aside. The same judge, a junior judge, has since been promoted, together with the others(the then DPP, Patail) who were in that case.

The public will continue to have no faith in our judiciary. Sorry Zaid, there ain't nothing you can do about it. Only a change of Government can change anything in this country.

A lot of truth is being hidden and kept out of view in this case of Altantuya.
Even the court can STOP or CUT OFF a witness from giving evidence of the whole truth and defense lawyers stopped on their tracks from fielding probing questions to get a clearer picture.
Are the courts collaborating with certain powers that be to deny justice and protect certain individual(s) in this instance.

Hell...Justice in Malaysia CAN be bought for a price..bungalow, overseas holiday trips, handbags and what not as revealed in the Lingamgate RC hearing.

JUSTICE IS REALLY BLIND IN MALAYSIA

The honorable thing for Najis to do, is to take responsiblility of the damning evidence pointing to him and resign first. Only after the case clears him without a shadow of a doubt that he was NOT somehow involved, can he proceed to take the PM seat. Then again, can anyone name a just, honorable, incorruptable BN Minister? I sure would like to know this/these great, towering Msian/Msians and wish them joy and blessings

whatever it is, a young woman was murdered on our soil. why isnt our government remorseful or even hospitable to the father of the victim? have we no longer any heart left ? shouldnt we be feeling for the family left behind after a gruesome murder? i have not read any news of of one of our ministers with a brotherly hand on altantuya's father. what have we become?
