JANGAN GUNAKAN AKTA HASUTAN UNTUK TUTUP MULUT KARPAL SINGH

Parti Rakyat Malaysia berpendapat isu kenyataan Karpal Singh, Pengerusi DAP mengenai tindakan Sultan Perak dan teks ucapan Yang Dipertuan Agong perlu ditangani secara bijaksana iaitu kesediaan untuk tampil berhujah dengannya secara rasional berdasarkan undang-undang dan fakta sejarah, bukannya berusaha untuk menekan dan menutup mulut Karpal dengan membuat laporan polis supaya Pengerusi DAP itu dikenakan tindakan di bawah Akta Hasutan.

Malaysia sudah lebih 50 tahun merdeka sebagai sebuah negara yang mengamalkan sistem demokrasi berparlimen dan Raja Berpelembagaan. Cepat atau lambat, Malaysia akan berdepan dengan isu-isu perundangan seperti yang dibangkitkan oleh Karpal Singh.

Apa faedah yang Malaysia dapat sekiranya Karpal Singh didakwa di bawah Akta Hasutan dan kemudiannya jika didapati bersalah dia dicampak ke penjara, sedangkan isu yang beliau bangkitkan tidak dijawab dan diberi penyelesaian?

Parti Rakyat Malaysia berpendapat apa yang dibuat oleh Karpal dan cara ia dilakukan tidak semestinya betul dan apa yang beliau cakap tidak semestinya benar.

Kita jangan jadi seperti orang pengecut takut membicarakan isu-isu yang Karpal luahkan dan kerana itu mahu segera mulut Karpal ditutup dengan ancaman Akta Hasutan.

Parti Rakyat Malaysia percaya sudah sampai masanya kita memikirkan dengan serius tentang keperluan menubuhkan Mahkamah Perlembagaan di Malaysia.

Isu-isu yang Karpal bangkitkan tentang apa yang berlaku antara Istana Perak dengan Menteri Besar Perak berhubung pemecatan dan perlantikan semula Datuk Jamry Sury sebagai Pengarah Jabatan Agama Islam Perak (JAIP) adalah isu perundangan yang mengaitkan bidang kuasa kerajaan negeri dan Sultan. Perlembagaan negeri Perak dan Perlembagaan Persekutuan Malaysia perlu dirujuk. Tidak cukup itu, amalan konvesi perundangan yang digunapakai selama ini juga perlu diteliti.

Karpal Singh perlu diperingatkan bahawa negeri ini bukan negara demokrasi ala Amerika Syarikat atau Perancis yang tidak beraja. Di Malaysia masih ada raja. Ada Sembilan Raja-Raja Melayu dalam persekutuan 13 negeri di dalam Persekutuan Malaysia. Raja-Raja itu juga ada kuasa-kuasanya yang tersurat dan juga tersirat di dalam Perlembagaan negeri masing-masing dan juga Perlembagaan Persekutuan. Kerajaan Persekutuan adalah atas nama Kerajaan Yang Dipertuan Agong manakala Kerajaan Negeri Perak adalah atas nama Kerajaan Sultan Perak.

Dalam hal ini maka kritikan Karpal Singh terhadap tindakan Sultan Perak tidak semestinya tepat. Karpal mungkin silap dari segi perundangan tetapi adakah dia menghina Sultan?

Parti Rakyat Malaysia percaya pihak-pihak tertentu tidak wajar dengan cepat menuduh seseorang itu menghina Sultan. Jika tanpa niat jahat tetapi demi kepentingan umum seseorang itu perlu mempersoalkan sesuatu tindakan Sultan dari segi perundangan, maka ia tidak patut dianggap menghasut atau menghina.

Kita perlu ingat di dalam semangat demokrasi, kita rakyat Malaysia mahu maju ke depan membebaskan diri kita dari belenggu sistem feudalisme.

Parti Rakyat Malaysia menghormati sistem kenegeraan Malaysia waktu ini yang bersifat dualisme iaitu Demokrasi Berparlimen dan Raja Berperlembagaan. Raja Berperlembagaan berbeza dengan sistem raja mutlak (absolute monarchy). Justeru itu, Parti Rakyat Malaysia membantah tindakan UMNO dan pihak-pihak tertentu yang cuba menggunakan Akta Hasutan atau ISA untuk menakut-nakutkan rakyat supaya jangan menyentuh bidang kuasa istana.

Parti Rakyat Malaysia berpendapat bahawa pihak-pihak seperti UMNO yang mahu mempertahankan status quo yang ada sekarang supaya jangan habiskan masa membuat laporan-laporan polis terhadap Karpal Singh.

Mereka boleh menjawab hujah-hujah Karpal Singh dengan mengingatkan Pengerusi DAP itu bahawa Semenanjung Malaysia yang dikenali sebagai Malaya dulunya dipanggil Tanah Melayu. Selepas 1957, ia digelar Persekutuan Tanah Melayu. Fakta sejarah menunjukkan 9 negeri di Semenanjung yang masih ada Sultan dan Raja tidak pernah terjajah secara terus di bawah Inggeris atau Jepun atau Belanda ataupun Portugis.

Sebab itulah Sultan dan raja-Raja Melayu masih ada kuasa hingga sekarang dan diiktiraf serta diperakui oleh Perlembagaan Persekutuan Malaysia. Karpal Singh tidak boleh cabut kuasa yang ada pada Sultan dan Raja kalau rakyat Melayu masih mahukan Sultan dan Raja mereka terus berkuasa seperti yang ada sekarang.

Hujah-hujah Karpal Singh sebenarnya boleh dikalahkan di Mahkamah Perlembagaan (jika ada) atau dalam pentas pendebatan perundangan pada bila-bila masa. Tidak perlu Akta Hasutan atau ISA digunakan untuk menutup mulut Pengerusi DAP itu yang kelihatannya agak celupar dan biadap pada sesetengah orang. Hadapi isu yang Karpal Singh timbulkan dengan berani.

Honestly speaking, before gunning down Karpal, recall back events unfolded a month plus ago. Almost the entire UMNO, its' leaders went against in their comments on royals, not one but two; the Terengganu sultan @ present Agung and Perlis Raja. Both ex-MBs of the concerned states issued statements after statements supported by other state leaders. The PM too and even the AG tried to interfere in Agung's decision. They were disrespecting the sultans. Their statements were obviously seditious against Rukun Negara principles.

Should the oppositions and NGOs were to make a similar police report on these people what will the AG do? If he decides to take action against Karpal, he should then do the same to the UMNO leaders and others, will he do that? I hope the opposition makes a similar report to see how the AG handles this case. Perhaps the opposition also waiting for the AG to act on Karpal, to reciprocate. It would be another interesting thing to see the AG shoots his own foot.

hmmmm...sebelum kita cakap apa-apa pasal encik karpal singh, ingatkah kita pada kisah kekalahan Gerakan di Penang; Tsu Koon TAMPIL ke HADAPAN mengaku kekalahan & bertanggungjawab.....masihkah kita ingat pada kontroversi pemilihan MB Perak; Lim Kit Siang TAMPIL ke HADAPAN menarik balik kenyataan dan memohon maaf kepada Raja Muda Perak....dan sudah tentunya kita masih lagi ingat dengan isu pemilihan MB yang sangatlah berlarutan di Terengganu melibatkan ahli UMNO dan pihak Di Raja....dari kebanyakan ahli-ahli UMNO Terengganu hinggalah ke org No.2 dan No.1...hmmmmm hampas satu MAAF atau PENYESALAN pun TIADA diberikan berkenaan layanan dan kenyataan yang mereka lemparkan terhadap institusi ISTANA.

Harapkan pagar, pagar makan padi. Harapkan bangsa sendiri, diludahnya oleh bangsa sendiri.

Apakah yang diwarwarkan oleh UMNO selama ini??? Elak Melayu dijajah kembali??? Kalau inilah yang berlaku....lebih baik dijajah pihak lain dari dijajah bangsa sendiri!

Betul... Raja yang Adil Raja di sembah... Tapi kalau rakyat dan pembesar yang di payung oleh Tuanku sejak berzaman menghina dan menderhaka .. tak kan rakyat menumpangkasih yang tak berapa faham adat nak bertanya sapa hendak di pancung..

Here's the deal,
Karpal stated his opinion on what he perceives/ interprets the law and he also cited historical judgment. In my opinion not seditious at all but debatable (not whether it is seditious or not but whether his perception of the law is correct or not.

Amno on the other hand had 23 (can't remember the exact number) ADUN's sign a letter challenging the Agong to withdraw his chosen appointment for the MB of Terengganu. They submitted a letter, had meetings, came on TV, and made statements challenging the right of the Agong to select the MB. They threatened to the extent of claiming that they would quit their posts if the Agong did not heed their demands. The reaction of their supporters were incited by them and to prove this point, we can see that in a gathering that they had, a supporter was holding up a banner that insulted the Agong. Astaghfirullah. The acts of these goons is what i call seditious

Hassan is right in calling for discussion and his call for a constitutional court is also timely. In order to sit down and discuss the matter sincerely and rationally there must be basic maturity. None seems to be exhibited by those childish pranksters who went to make police reports with every drop of a pin.

If it was Abdullah himself who had directed that such a report be made then one has to ask if he was trying to divert attention from himself ? If so then his sincerity in reforming the system, todate which are nothing more than half-baked platitudes, should really be called into question.

i will also questions the same thing as Karpal did.
In fact , all the people whom i knew off also asked the same thing.
Nothing is wrong with Karpal.The only wrong was Karpal should say it in a different way.
Karpal NEVER insulted any sultans at all.
Karpal only challenge the written law , not against the law.
but umno beruks said Karpal broke the ketuanan melayu law.

just two months after the election, the BN government is working hard to kill off the opposition with any and all means, legally or otherwise.

the Rakyat voted for a change is the political scenario and practices of the government. many hoped the BN would realise their folly and mutate to suit the current times. alas the BN seems bent on securing their position and silencing the critics. despite pledges by the PM of positive changes in many speeches delivered after the election, it seems to have gone from bad to worse. now the Lingam reports need his vetting before it *might* be released.

the bloggers have declared war against the government. in any war, there will be casualties. they will be remembered in history, regardless if they succeed or not. from the reactions of BN politicians thus far, the bloggers with their non-existent resources have managed to stir up the ruling government and all their devices (AG, PDRM etc). quite a feat indeed.

i'm not surprised the Royalty have been quiet so far. only a fool would not be able to see the double-standards practised by the government in handing out the Seditions Law.

THE COURT OF PUBLIC OPINION hereby concurs:

1. The AG's Chambers and AG himself have failed to maintain their non-partisan and apolitical approach in carrying out their duties professionally.

Consider the following statements, decisions, and actions executed by the AG himself:

a] Making a public statement that only 3 persons were involved in the killing of the Mongolian lady whereas PDRM should be responsible for such announcement;

b] Making a desperate attempt to have an audience with the Agong over the legality of appointment of Trengganu MB. He was shown to the exit when the Agong refused to see him. And making statement to the mass media that the Agong has erred in his decision quoting certain articles in the Constitution;

c] The hurriedly action of AG in storming to the court house to take over the functions of the DPP in charging the HINDRAF demonstrators under ISA;

d] The unproffesional and haphazard manner in which RPK was charged through telephonic instruction and ad-hoc change of venue of the court hearing without any written writ being filed;

e] The utter failure of AG's Chambers and AG himself in instructing the DPM and his wife to testify in court over the murder of the Allatunya as evidences had been proven and recorded in the Court that their own personal body guards were involved in the scene.

f] The utter failure of AG's Chambers and AG himself to subpoena the owner of the green car who ferried Allatunya, in court or to make arrest as he was implicated in the crime scene.

And there were many others, maybe some bloggers can fill them in.......

So before he makes any move to charge Karpal Singh for his interpretation of seditious act, let him think twise before the Court of Public Opinion hands down the sentence on him for collusion with PDRM and IGP himself.

What about the AG's publis statement regarding the appointment of the Trengganu Menteri Besar ?? Isn't that seditious ???
What about the UMNO beruks who requested that the keris be soaked with Chinese blood ??during the 2006 UMNO Youth assembly ?? Why no action taken by the polis ??
What about Najis proclamation on the same issue in 1988 ???

Please correct me if I am wrong. In 1996 the Terengganu state government changed the state constitution where the state Islamic religious issues be under the Menteri Besar. Is this not sedition and treason towards the Raja-raja Melayu? Two days ago the state government restored the powers of the Sultan of Terengganu and this was done by the new Menteri Besar after 12 years
