Marina Lee : Is Parliament still relevant? PDF Print
Wednesday, 07 May 2008 17:50

"... when freedom of speech is being brutally subverted by the present regime and false charges can be instituted against anyone who dares to demand for justice and truth."

As a wife and mother, I want to know from my fellow citizens whether a government that has incarcerated my husband in the Sungai Buloh prison on trumped up charges and brought untold suffering on my family, especially when one of my daughters is sitting for her final examinations, is a legitimate government.

No wife, mother or child should to go through this horrible experience when all her beloved husband did was to uphold justice and truth.

On 2nd May 2008, the Armed Might of the regime was unleashed on my family when they came to my house in search of evidence for some alleged crime that my husband was supposed to have committed.

I thought that this can only happen in a Gestapo state but not in my beloved Malaysia. You be the judge of this.

The police came in the morning and desecrated the sanctity of my home for the fourth time. The fact that this had occurred previously does not make it any easier for my daughter and me. I wish that such nightmares can be forgotten, but let me tell you, especially mothers and wives, that the pain will never go away and that it is only our family's self esteem and strength and our faith in god that has enabled us to withstand and overcome the trauma and pain that we have suffered together.

I pray that no mother and wife will have to suffer and experience what I had with my beloved husband and my family.

Before we had time to recover our composure, the police handed us a summons to appear before the CCID the following day. However, at 3.15pm, we received a call to appear at 4.00pm on the same day.

My suspicions for this sudden change in the time for my husband to be interrogated was to prevent publicity and the exposure of their dastardly deeds.

Can anyone of you imagine what I, as a wife and mother, had to go through emotionally and psychologically when accompanying my husband to be interrogated by the police when on a previous occasion in 2000, he was brutally assaulted in my presence?

I could not express my anxiety to my husband on the way to the CCID, as I know that my strength and resoluteness would be critical to enable my husband to face his interrogators. He must have also felt the same for me and so both of us, thinking alike kept our silence. But we were determined to see this through together hell or high water.

The Petras’ are not some tofus!! We have enough strength and dignity to overcome such adversity.  My daughter suffered in silence and despite her age, she held up magnificently and no mother can be more proud than I to have such a daughter.

As we approached the CCID, tears welled in my eyes, but they were not tears of fear, sadness or trepidation, but the expression of my determination and faith that my husband’s struggle will ensure a better future for my daughter and the children of a better Malaysia.

I am proud to say that my husband overcame the intrigues and schemes and came out unscathed. But we knew that this was a mere prelude to more brutality that will be inflicted on my family.

The events of yesterday’s circus are known to all.

But what was most telling was the deafening silence of the judiciary and the bar council which supposedly are the guardians of justice and equality.

The dinner that was orchestrated by Pak Lah, his law minister and other cronies that allegedly ushered “a new era” for an independent and fearless judiciary in upholding justice and human rights, makes me wonder if such an institution that was promised was a fantasy in the light of my experience.

Today, my daughter and I went to the Sungai Buloh prison to visit my husband but we were told that he had no wish to see anyone, not even any member of the family or lawyers. I was shocked and disturbed by this turn of events as it can only mean that my husband is determined to endure the pain of incarceration and humiliation of being subjected to and treated like a common criminal for upholding the freedom of speech and justice.

Being married to him for 35 years, I know only too well that he is capable of making sacrifices for truth, justice and freedom.  I suspect that when I was told that he did not want to see me, that he would be taking the ultimate step – to go on a hunger strike to demonstrate his determination to uphold the cause of truth and justice.

I have nothing more to say, as I am thoroughly exhausted by the turn of events and can only hope and pray that my fellow citizens, especially wives and mothers out there, that you would all come together to protest and to demand for my beloved husband's freedom and that you will call upon your member of parliament to boycott parliament as a gesture of support for my husband’s struggle.

His struggle must not be in vain. We as a family will see this through but we will only be able to cope if we know that good and god fearing people like you will be there and standing together with us shoulder to shoulder to strike a fatal blow against tyranny and for justice and truth and for my husband’s freedom.

There will be riots on every street in Malaysia if RPK dies while in detention!
For all those who loves RPK from the bottom of their heart, please call on the government to RELEASE RPK WITH NO CONDITIONS ATTACHED!

RPK will never give up this fight so easily! He is on the path of civil disobedience to free the oppression meted out on free media and freedom of speech

I am not a lawyer and have never pretended to be one especially since I believe that the great majority of lawyers, like the great majority of journalists, should be shot, hung and fried. They only have the ringgit sign in their eyes.

Still, it should be fairly obvious to even the layman that an act of sedition can only be committed against a lawfully established government, not against a state, or against any person in his individual capacity, or against any post, even a government one, which the person may hold.

In the sedition case of blogger Raja Petra Kamaruddin, the post of deputy Prime Minister of Malaysia is also an issue.

The Federal Constitution, in fact, does not recognize the post of deputy Prime Minister of Malaysia and hence, therefore, no such post exists in law. The post of dpm Malaysia is the creation of an administrative act for political reasons.

The Federal Constitution only recognizes the Prime Minister and his Council of Ministers. Hence, the dpm of Malaysia cannot also by any stretch of the legal imagination be recognized as the lawful successor to the Prime Minister. When the Prime Minister goes on leave for less than two weeks, no one is appointed as Acting Prime Minister.

Only his majesty, the King, in his infinite wisdom, can determine who, in his opinion, should be called upon to be appointed as Prime Minister. The King will call upon a member of the House, who in his opinion, is likely to command the confidence of the majority of the House, to be appointed Prime Minister, and he will then go on to appoint his Council of Ministers.

If the King can appoint the Prime Minister, he can also dismiss him for failing to live up to his oath of office.

When a Prime Minister resigns or is dismissed, his entire Council of Ministers is accordingly deemed to have resigned or dismissed.

Of course, these things -- dismissals etc -- have never happened before. But there’s always a first time. Mahathir, in fact, came perilously close to getting sacked during his tenure in office and the matter was discussed openly in the streets.

Pls allow us to flush your statement here out onto the rest of the Net, far and wide. I will be doing that to all my contacts, regardless Malaysians or not, as we are one big family in the Virtual world - the Netizens. Furthermore this is an issue about human rights and human decency, justice and truth, - universal traits shared by all.

I have said it, and I say again. Pete MUST think again. It's imperative that he stays out, and stays healthy. Sometimes to run is not because he's a coward, but to live and fight another day! Hope you can get him to understand that. The RAKYAT would agree with and support him if he posts bail and go home. We all need him. And he can work with all the lawyers to prepare his defence come October.

Just because he does so (post bail) does not mean he admitting guilt of the charge. We understand that! And we, Rakyat, do know that Raja Petra is GUILTY of upholding truth, justice and freedom of expressions!

Dear Puan Marina,
I understand what you and your daughter are going through. It is not easy. I am humbled by your story. What have i done besides participating in a few rallies and marches, make some stupid comments in mt, voting for the pakatan rakyat for the past 15 years, campaigning for the opposition and walking to the bank to deposit RM1.00 for your husband? Those are embarrasment compared to what you and your husband have done for this country and the rakyat.

Allah is your protector, RPK's protector and our protector. I know RPK will be making plenty of doas as no doa will be granted faster and better than one from a person who has been terribly wronged. We must believe this. You know you have moral, physical and financial support from your extended friends out here, and you must use us. But as you know the perfect solace is with the Almighty. Use him too.

And try to get adequate rest and meals. You are of no use to your husband, daughter or your friends if you fall sick and unable to coordinate your family as RPK would want you to. So please get some rest and eat to stay healthy. The rest, InsyaAllah we can do together.

A very personal account on what this tyranny does to everyday people. It makes me sick that this political party can get away with this in the 21st Century. At the same time though, it has strengthened by belief that there are no real leaders in BN. They are all gutless and therefore not fit to lead. If you were a person of any conscience, you could not read this article and stand by silently while this blatant injustice is occurring.
So BN members, where are you? What have you got to say? You can’t say anything because you know it’s wrong. Your only real course of action is to hide and hope they can silently erode the public sentiment. HAVE YOU NO SHAME THAT YOUR PARTY EMBLEM IS THE SCALE OF JUSTICE???? I’M SURPRISED THAT IT HASN’T FALLEN OFF THE AXIS AFTER ALL THESE YEARS OF ABUSE. You need something closer to the jolly roger to fit the bill......though Blackbeard probably had more ethics.
BN is dead and buried. There really is no way back. The only way they can try and get votes is by spin, deception, money politics, gerrymandering, controlling the media, and draconian laws to lock up their threats. You stand for nothing else. Our forefathers whom I still admire for achieving independence must be rolling in their graves. Everything you fought for is now tainted, and the stench is unbearable.
I for one will do my bit to ensure people do not forget that RPK is wrongly imprisoned. I’m taking that “Free RPK” graphic on the website and put it on a t-shirt, and make some car stickers for my car. Move over Che Guevara, we have our own.
I’ve always thought “I’m too busy”, or “someone will do something”, but you can still voice dissatisfaction. For those of you who are sickened by this, a little bit by all goes a long way.

Long Live RPK.....

I would like to appeal to all the PR MPs and PR Assemblymen to start the initiative because they are the frontline elected to represent the RAKYAT.

I appeal that all of them gather to seek an audience with the Yang DiPertuan Agong to either ask for an unconditional release of RPK or to charge him immediately on whatever charges.
They must not bow down until the Palace agrees to an audience and agrees to lay a hand.

Fellow bloggers please help me disseminate this appeal to all our elected YBs.

Deal all , the umno government is trying to make the people angry and trying to make Pakatan Rakyat angry.
umno is trying to incite a riot in this country and RPK is being used as the "igniter".
And when theres really a riot , this is where and when the polis anjing will comes out in full force and bodohwi with najis imposes the ISA to nearly all PR leaders by claiming PR are the ones responsible causing riots and havocs.
The same goes for Tengku razaleigh as well, the moment he defends RPK , if he really does that , bodohwi will swings into action.
bodohwi and kj have intentions to stay longer in power
umno realizes that they cannot afford to lose power as PR and DSAI getting more supports day by day.
Efforts made by RPK in promoting PR is better than all MSM combined .
umno and polis are just waiting for the day to snuffs out RPK.

Dont falls to such trappings laid out to us from umno.
ipg musang is just waiting for us to falls into their dung holes if we organizes a rally to protest. This time will be more than tear gas canniters , batons , pepper sprays and acid water towards protesters.

PR people and RPK's supporters must be very careful on this one , as this one is for real .
DSAI , Lim Kit Siang , Karpal , Tian Chua , Wan Azizah , Husam and Nik Aziz must be protected from now on ,plus to be extremely careful.
This time is no longer "play - play".
DSAI must play carefully from now on and to do the "checkmate" quickly and quietly. We must avoid any riots at all cost.
Whether RPK will be safe or not while in custody is something which we do not knows of.

In every age, in every country, there will always emerge a person of Great Faith and Honesty. Some examples: England had Boudica, France had her Joan of Arc, India had Ghandi, South Africa has Nelson Mandela and I think its timely that we now have RPK as someone righteous and brave who will lead the rakyat to reclaim what rightfully belongs to the rakyat.

We, the rakyat, have the right to live with dignity and in peace. Our country is blessed with many good things but cursed with governance. Perhaps the time has arrived when the curse of this bad governance is over.

I echoed the exact sentiment yesterday in another article. yea where are they? what about the conference of rulers? They all need to play their parts. If this is not pure political prosecution, then tell me what is it!

Another sad chapter in malaysia democracy!

Dear Marina

The answer is yes, as long as more people are like yourselves. Even though I have only met RPK and yourself only once, I feel that the people in this country are greatly indebted to you and your family for the struggles you have experienced for the good of this country. The easier way for most people would have been to migrate, not necessary to a better country but cant be worse off. As a mother and a wife, I do not know whether I have the courage needed to face what you and your children are enduring right now and for that, we salute you. Please tell your children that they are extremely fortunate to have parents who understands the importance of upholding justice and truth at all costs.

Putting everything aside, the priority is to get RPK out. It is unlikely that the hearing will start in October 2008 due to the postponements, etc. By opting to stay in prison will only play into their hands. What better ways to keep RPK silence for as long as it takes. RPK has succeeded in uniting all the firm believers of justice and truth through his action and now we need him out to lead us there.

Fellow readers, apart from the walk - is it possible to put up a petition to the King or use foreign channel to exert pressure for RPK's release? The petition should urge the King's intervention in one of the darkest hours in the history of Malaysia. Shame on those of us who voted for BN.

Datuk Ambiga supped with the BN beruks and when one has eaten from the hand of evil, you will never be the same.

The Malaysian Bar had never been a vector for Change. No legal body in any country's history had ever played a significant role in change. You must remember that lawyers are just that...Lawyers! They will first assess whats in it for them. In Malaysia, its styled as "Cari Makan". So, whilst that maybe a general statement, there are a few good lawyers, sadly there are not enough.

Twenty years ago, another evil regime tried this.

Art and music are a good way of subverting such regimes.
Satire and mockery are good ways of subverting such regimes.
If theres one song that will make the hairs rise on the back of your neck, download "Something inside so strong" by Labi Siffre. Its from South Africa.

Learn it, and sing it together, so that in four years, when the Tsunami comes to remove the debris of UMNOcracy, the veneer of freedom, it can be sung at the party gatherings. They shall tremble, knowing that the majority is against them.

1. Four years is a long time to become more oppressive, more draconian, and lets be assured, if we think Badawi is bad, judging by his fathers performance, Najib Tun Razak will be the prince of darkness. The succession was set out in stone years ago, and they will do all in their power to make it happen. Badawi will think he made a mistake in setting Anwar Ibrahim free.

RPK is their tool, and their hostage now. That was inevitable. Things are very dangerous, and they can use him to provoke us. Heres my analysis of the next part of their "game"

Unfortunately, unlike Tun Mahathir, and unlike his father, Najib Tun Razak will not command the respect and affection of the majority of the Rakyat. Mahathir, for all his faults did command that much.

2. The defendants in the Altantuya case can now use the "defence", that the trial is prejudiced because of comments made in the public domain, AND that the presumption of innocence before guilt, beyond all reasonable doubt was forgotten/abused.
3. RPK can be convicted in a show trial on the basis that he commented and presumed guilt before it was proven in a court of law.
4. RPK is a captive in the hands of the regime now. They are damned if they let him free. They are damned if they keep him captive. The independence of the judiciary is at stake in this trial. Not that they care, because RPK has made powerful enemies in the corporate sector due to his exposure of their misdeeds, their rent seeking, and their corrupt deeds.

5. Malaysia-today still goes on, without its lynchpin. That won't stop, but there is a distinct sense of an Ops Lalang ahead. Unlike the Ops Lalang era, one blogger being arrested won't stop matters, for there will be 10 others to replace one arrested. There are'nt enough cells in the Malaysian prison system to stop this. There are'nt enough agents in Bukit Aman to monitor the whole blogosphere. Its a new world, and they don't know how to handle it.

All evil regimes fall eventually. It takes brave people, and true patriots like RPK to make it happen. There are people in parliament who have been victims of draconian leglisation. Lim Kit Siang, Karpal Singh, Lim Guan Eng, Anwar Ibrahim have all gone through their baptism of fire. I despair now. When I came to Malaysia, I looked at the Twin Towers, and Menara KL and though it looked wonderful. But, in the light of so much evil, so much corruption, so much deprivation, poverty of ideas and innovation, lies and deceit, they have lost their beauty and their meaning. They are merely a facade, a bauble, all style and no substance. Most Malaysians were apathetic until now, as long as there was rice and movies, life went on, and politics did not matter. Thats changing, but it needs a lot more work to get the message out to the masses, because a lot of us are perceived as being from the Bangsar set.

UMNO. Checkmate, after 40 years, its almost "game over".

For TRUTH, JUSTICE and LOVE to prevail, a "chosen one" have to submit "himself" for the "sacrifice".

This have been observed for centuries. Jesus was crucified. Mohamad was forced to Hijrah. Ghandi was brutalised and many more other examples.

Yang Mulia Raja Petra Kamarudin is a "chosen one". The evils will do nothing but more evils. Only "submission" will bring evil down to the ground.

Dear Puan Marina,

I have never known anyone like your husband. He is like a big brother to me and maybe like a father to many out there. I am sure at this moment thousands out there are praying for his well being. Was it too drastic to appeal to him for action ?

All I wanted was to go through the proper channels because I personally would not want to see the RAKYAT involved in demonstrations that might lead to FRU being called and injuries involved.

Now I really do not know where to run to in time of needs as even my namesake LKS does not even bother to care or reply to my post.

Dear Marina,

I do not pretend to know what you are going through but do take heart that your husband knows what he is doing. I also know at this time no word will be enough.

When I first read the article that is now the subject of the court case I thought it rather ought that he had stated that he doesn't know if what he had just said will cause him to be jailed. It is quite apparent now that what he was doing was baiting the authorities. Subsequent revelation made it quite clear that he had sacrificed himself to "reopen" the Altantuya case within his own trial. His carefully crafted article raised point after point that "looked" like innuendoes. Points in which he had to substantiate later in the court of law in order to beat the sedition charge. The escape clause is for him to prove what he had said is true. My hope and prayer is that he can pull it off. If the court judge kept ruling "irrelevant" as did Augustine in DSAI trial we will have another sham and shameful trial in the making.

Your husband's sacrifice for Altantuya and her family in seeking justice for them in the only way possible under the condition that we have today, will never be forgotten. I wish and pray for his success in his bold attempt and for the family speedy reunion.

Be strong and resolute.

RPK - While I totally respect your actions in wanting to prove a point, I believe you languishing in prison for the next few months serves very little purpose, productively speaking.

While you are in, the powers-that-be will glee with joy. If you're out, then it's a different story.

We donated generously towards your cause because we want you OUT, not IN. If you had decided to stay in prison, then what was the point of the fund-raising?

You asked for RM1.00 per person to bail you out. We have far surpassed that, so why are you still being indignant and stubborn?

Why are you even refusing to see your wife? She needs your go-ahead as to the next course of action as far as your indictment is concerned.

Unless you have a specific strategy in mind in accomplishing what you want, then it's a different story.

This is what Wikipediahave to say about Sedition....

"Sedition is a term of law which refers to covert conduct, such as speech and organization, that is deemed by the legal authority as tending toward insurrection against the established order. Sedition often includes subversion of a constitution and incitement of discontent (or resistance) to lawful authority. Sedition may include any commotion, though not aimed at direct and open violence against the laws. Seditious words in writing are seditious libel.

Because sedition is typically considered a subversive act, the overt acts that may be prosecutable under sedition laws vary from one legal code to another. Where those legal codes have a traceable history, there is also a record of the change of definition for what constituted sedition at certain points in history. This overview has served to develop a sociological definition of sedition as well, within study of persecution.

The difference between sedition and treason consists primarily in the subjective ultimate object of the violation to the public peace. Sedition does not consist of levying war against a government nor of adhering to its enemies, giving enemies aid, and giving enemies comfort. Nor does it consist, in most representative democracies, of peaceful protest against a government, nor of attempting to change the government by democratic means (such as direct democracy or constitutional convention).

Put simply, sedition is the stirring up of rebellion against the government in power. Treason is the violation of allegiance to one's sovereign or state and has to do with giving aid to enemies or levying war. Sedition is more about encouraging the people to rebel, when treason is actually betraying the country."

What RPK wrote was about someone and not the government or legal authority.

Why...why lah RPK was charged under Sedition?

If the Najis and his bulld*g wanted to sue RPK, they only can file in civil court. What the abuse of power by the umno monkeys.

Oh God. How long you allow this bunch of umno monkeys to inflict suffering upon Malaysian? Oh God....how long ?????

Fellow Malaysians!!

The voice of MT readers are the voice of thousands if not millions of matured and serious minded Malaysians. The issue of RPK not wanting to see his wife and children is not true. That is a downright LIE !!! My sixth sense feeling is that he has been brutalised beyond recognition. The jail wardens cannot allow his physical condition to be seen by anybody till he recovers fully. Where is the bar council? Can the bar council demand that RPK be brought out to meet with his family members. OK now the public is deeply suspicious that something is not right about RPK. We demand that he be taken to a hospital and be examined by a medical examiner. Can somebody go to the court and get a court order that RPK be taken to a hospital for examination at least to quell the fears of his family. Where is Anwar Ibrahim? He seemed to be missing in action since RPK arrived at the court house yesterday. Anwar please come forward and do something and dont wait as if you are unaware of anything. I call upon all elected representatives in Parliament to demand for immediate action in Parliament. If the BN MP's oppose any rightful demands made by the PR MP's then please stage a massive walk out in utter protest. Where is the Prime Minister? We demand that the PM must come out and make an open statement about RPK's physical condition. He cannot pretend as if everything is fine and dandy. Nothing is fine. He must listen to the people's demands. People are sick and tired of what is happening around. Stop the bullying of the innocent and the concerned Malaysians. When women and children plead then the PM must act immediately and not pretend as if he knows nothing is happening. If the BN MP's refuse to show any concern for fellow Malaysians then it is time that the electorate who voted such people should rise to the occassion and demand for their expulsion or their resignation. Let there be fresh elections for these constituencies !! Let there be non violent protests nation wide and let there be civil disobedience as long as there is no threat to national security or to human lives. We demand that the IGP come forward and present RPK to his family at least for their satisfaction that he is well. He owes this conscience to the rakyat and to the women and children of this country.

Dear YB Lim,
I would like to appeal to you amd all the PR MPs and PR Assemblymen to start the initiative to free because they are the frontline elected to represent the RAKYAT.
I appeal that all of them gather to seek an audience with the Yang DiPertuan Agong to either ask for an unconditional release of RPK or to charge him immediately on whatever charges.
They must not bow down until the Palace agrees to an audience and agrees to lay a hand.

Now that many bloggers are coming up in arms to support RPK, I am sure many blogs will have banners to support him. But this is not enough. We need to create more awareness.

Everyone should include the URL of the offending article in your e-mail signatures. We need everyone on the net to read this article, especially e-mails to the Ministry of Defense. ;-)

Bloggers should reproduce the article in the blogs, just in case Malaysia Today is taken down in the future. We need this article to start a life of its own. We need people to read it and question the contents and its ramifications.

If your neighbourhood is not tech savvy, why don't you print out the articles and pinned it on your apartment/flat's notice boards or distribute it to your neighbours. Let's see how PDRM can stop this article from spreading.

RPK stood out to be counted and this is what happened to him.

How many more malaysians who love their country will end up like him?

There are many of us who are standing by him in spirit and in strength.

We might not be able to be there physically for him but just ask and we will do what we can to let his voice be heard even louder in the world.

Our government is even worse than the Myanmar Junta, worse than the Chinese Communists, we are living in times unlike the Hitler Era.

Fellowmen, let’s stood and be counted too……

If there is a online petition to free RPK, we will all be able to stand together under one voice to be heard.

For those who have voted for BN, the least thing you can do is to feel regret, we won't blame you for that, but keep a neutral eye on all that is surrounding us, and your faith and morality will guide you to where justice, truth and light are.

Malaysians will go on an endless war with BN, untill they're brought down.

All I wanted was to go through the proper channels because I personally would not want to see the RAKYAT involved in demonstrations that might lead to FRU being called and injuries involved.

Now I really do not know where to run to in time of needs as even my namesake LKS does not even bother to care or reply to my post.

Marina, forgive my humble being for being so useless.

Syabas to you and your family, You can take comfort for all the support you and getting. We are all angry with this Government for jailing him and for all the injustices that they have perpetrated and we all want justice to be restored - no one more than your beloved husband.
But I urge you to look at this through a different prism. Your husband has a higher calling. He see himself (and I support it entirely)as the savior, the Ghandi, the Martin Luther King, the Nelson Mendela of Malaysia. He passionately wants justice returned to Malaysians, justice that has been robbed from us and our children by greedy, corrupt officials. He won't rest until this is achieved. Seeing him in this special light, we have to bear the pain of seeing him incarcerated, maybe even abused - because these people are evil. We cannot defeat them without the conviction and courage that your husband has displayed as he sacrifices his body for this just cause. We must stand by him and behind him and endure the pain together with him. We musn't lose sight of the bigger objective that your husband has embraced with his life.
Please be brave & may you all be blessed.
