U.S. Hypocrisy and the Malaysian Guantánamo

"It's Malaysia's Guantanamo," the woman told me. I was visiting Kuala Lumpur, Malaysia, last week, to talk to an activist from a local human rights group. The group, SUARAM, has been leading a fierce campaign to abolish Malaysia's Internal Security Act (ISA), a law under which more than 70 men are currently held in preventive detention.

Some of the men are suspected of belonging to Jemaah Islamiyah, a militant Islamist group responsible for terrorist bombings in Bali and elsewhere. Others are accused of common crimes like forgery. What they have in common--and what links them to detainees at Guantanamo--is that they are being held in long-term detention without charge or trial.

In a different era--back in the pre-Guantanamo, pre-"war on terror" days--the Clinton Administration would occasionally criticize Malaysia's reliance on the ISA. Now such concerns have largely been forgotten. What counts, for the U.S. government, is that Malaysia is a reliable ally in fighting terrorism.

Just hours ago the U.S. ambassador to Malaysia lauded the two countries' "shared cooperation" on counterterrorism. "We have been impressed and gratified that Malaysia wants a leadership role in this arena," he said.

First Give a Fair Trial to the Detainees at Guantanamo ...

On the rare occasion that U.S. officials venture to look critically at Malaysia's detention policies, the local authorities have a ready response: Guantanamo.

Last December, the Malaysian government arrested and detained five Hindu rights activists under the ISA, in a blatant attempt to intimidate the activists from pressing claims of racial discrimination. The U.S. State Department responded critically to the detentions, though it did not condemn them directly.

Without mentioning the Internal Security Act, or even referring explicitly to the question of detention without trial, State Department spokesman Sean McCormack expressed concern for the legal rights of the detainees. It was the U.S. government's expectation, he said, that the detainees "would be provided the full protections under Malaysian law, that they would be given due process, that they would be accorded all the rights accorded to any other citizen, and that this [would] be done in a speedy and transparent manner."

The Malaysians' reply was swift. "Can they [the United States] first of all give a fair trial to the detainees in Guantanamo Bay?" asked Deputy Prime Minister Najib Razak. "We'll only respond if they do so."

Guantanamo and Kamunting

While their purported concern for detainees at Guantanamo was opportunistic, at best, the Malaysian authorities have a point. No country has a perfect human rights record, and it would be folly to insist that only countries with outstanding records have the moral standing necessary to point out others' shortcomings. Still, it is not easy for the U.S. government--as it fights to prevent detainees at Guantanamo from challenging their imprisonment in court--to give convincing lessons to Malaysia on these issues.

Guantanamo holds nearly four times the number of prisoners as Malaysia's Kamunting Detention Center, the prison in which the country's ISA detainees are held. While a few ISA detainees have been held for up to six years, more than 100 prisoners at Guantanamo have been held since early 2002.

Detainees in both places face secret evidence, an overall lack of due process, and, as a result, arbitrary detention. The problems--and even the justifications that the U.S. and Malaysian governments invoke to defend each system--are similar. It is no more convincing for the Malaysian authorities to call on the United States to close Guantanamo--as Malaysia's Prime Minister Abdullah Badawi did in 2006--than it is for the United States to express concern about Malaysian detention practices.

A Malaysian at Guantanamo

Last year, Mohd Farik Bin Amin, one of two Malaysian detainees held at Guantanamo, was granted an administrative hearing. One of the questions he asked was whether the Malaysian government could demand his extradition.

It's not much of a choice: indefinite detention at Guantanamo or indefinite detention under the ISA. Hopefully, in both countries, fairer options will soon emerge.

You are calling them terrorists, yet doing so is essentially passing summary judgment on them. Isn't this the realm of the Judiciary, and not the Executive?

Detention without trial laws are workarounds of checks and balances, and endanger everyone, as it opens an unbridled path to the tyranny of one branch of government.

Also, by classifying enemy combatants as necessarily terrorists, is it not the imposition of one's view of morality on others?

Finally, why house them in Guantanamo? So that if they escape, the harm will be on Cubans and not the US? Is this what House Republicans say is better, i.e. "playing in the enemy's home field" or fighting them "over there" instead of here?

If long-term detention is indeed required, there must be checks and balances, i.e. right to habeas corpus as well as detention time limits.

Malaysia will always look at the negative part of other countries and then give an excusable excuse. That is why we can find a lot of unexpectable evils and sins in this country nowadays.

Ayoyo! Sdr Temenggong & mike iaiaiaiawood, whatlah dey! How you know those people in Guantanamo are terrorists when no fair trial (as opposed to the judicially suspect :adiminstrative hearing) was ever given to these people. And lovely that you mentioned the term enemy combatants. I bet you guys are avid posters at the Little Green Football or does spouting neo-con catchphrases gets you off?

There are a lot more detainees in the various RELA camps. I understand that they do not have much freedom too. Do these detaiees in the various RELA camps have access to the Courts?

By the way, have you seen the parking lot of these detention centers. The cars driven by these personnel at the centers are definitely quite high end. I guess these RELA personnel are paid stress allowances and other allowances which are sufficiently high in order to afford these luxury vehicles.

The US is a SCREWED country .They have been undermining every country in the world to justify their SUPER POWER country status . Their latest target is China using the Tibet as a issue or human rights as their platform . 911 was an inside job by the Bush administration to justify war in Iraq , no WMD was found but look at their presentation in UN by Colin Powell . Afganistan was justified by the Taliban bombing of the Buddha statue . After Afganistan and Iraq they wanted to start a war with Iran under the same excuse , nuclear weapons production . But it failed because the American military didn't buy it . Remember they flew six nuclear tip cruise missiles to Michingan by mistake instead of to the Middle East ? Also six American generals would tender their resignation if Iran was next . Still no go , they aksed the Isrealis to bomb a suspected Syrian nuclear facility but could find no evidence .They were hoping the Syrians would trigger the war they had hoped but it didn't work . So now they are starting again showing the facility built with North Korean help . I wonder how long they are going to keep on BULLSHITTING people . Coming back to 911 inside job ever incur that all the Jews working at the twin towers knew something is going to happen such that they all took leave on that day and NO SINGLE JEW was killed on that day when the twin towers came down . There were over 3000 jews working in the twin towers .
Coming back to China the Americans and Europeans had infiltrated the monastries thru the human rights organisations . I thought monks normally would spend time preaching , meditating and chanting with occasional travels but here we have one who travels to the US and European countries ALL the time accepting the Nobel Peace prize , talking and shaking hands to the devil responsible for 500000 deaths in Iraq . What a combination ! Can you imagine Satan and Buddha shaking hands together ? something must be wrong here . Next stop France to receive the Key of Freedom of Paris . I wonder what Merkel of Germany would give him next ? Normally when you become a monk , you would have disown all earthly possessions . It also means you have become a servant of Buddha and also would have given up all material possessions , but here I see him collecting all sorts of titles from the Western powers . And then this protest against China , well you make your own opinion whoever is reading this and for your information I have omitted the name of the person . I find that I much more respect for Senior monks from Thailand .

Everyone can bash anyone, especially the USA. But when you tell some home truths about the brutal regime in Communist China (that's right, it's still Communist), all you guys come out of the Chinese diaspora woodwork to defend it.

Why are you so afraid of 1 old man (and if China is correct, the Dalai Lama is also Chinese, surely?) who has been chased out of his home and has taken refuge in India? Perhaps, you are afraid that what happened with Ayatollah & Iran, may also happen in China.

Let's say the TRUTH :-

1. The Dalai Lama has NEVER advocated violence or killing or rioting. This is a figment of the Chinese Politburo's and Spindoctors' wild imagination.

2. THE USA has NEVER instigated the Tibetians to rebel. There is no CIA plot. This is a figment of your wild imagination.

3. If you know your history, during Chairman Mao's rule, more than 50 million Chinese perished. Where were you then and did you stand in protest about it? How easily you forget.

When your back is to the wall, death is preferable to the insult to one's self-respect & dignity, and you are being culturally, religiously and socially swamped by an invader, then even you will riot and rebel. That's the reality of what happened in Tibet.

Live with it!!

I have not insinuated that the killing or rioting was advocated planned by the Dalai Lama , yes you are right the Dalai Lama has NEVER advocated violence or killing or rioting. If you read the whole context of my comment , it implies that the US in trying to slow the growth of China into another major SUPER POWER by financing all activists , NGOs affilated to their purpose of denying the growth of China into another major super power . This explains why at one time CNN used to repeat their articles on Tiananmen uprising . If I were China I refer to do what I have to do rather than let a few to cause the whole country to degenerate into anarchy where probably millions will die . For a country to open up to democracy it takes time not overnight like what happen in Iraq . Irag is liberated today ,can you proclaim that it is a democratic country ??

Well the Chinese's doesn't think it that way . China would imply that for any rioting to take place it has to be financed from outside . Who would stand to gain from all these disturbances ? Not China , not the Tibetians but the world opinion will be against China orchestrated by the US and the Western Powers . Why now before the Olympics ? To get maximum leverage and effect to force the Chinese govt into submission . Olympics has nothing to do with politics , why are they trying to boycott the Olympics opening if not for politics then for what ?

I do wish to go into the Chairman Mao's rule . Every country has their own history . Teng Hsiao Ping was purge at one time for trying to topple the leadership , however he manage to succeed and OPENRD up China . If you look into history , we have stories of millions of people killed in wars , in natural disasters , in epidermics , etc maybe this is one way of controlling over population .

I did not mention the CIA , please check my comment above .
But the CIA purposely BULLSHITTED with all crap photos , insinuations that trucks were carrying and manufacturing biological weapons , certain sites were producing nuclear weapons , all scud missiles were fitted with nuclear warheads etc etc . And all these were presented in the UN Security Council to all the Heads of Govt . As a result 500 thousand people paid for their lives and a country in srambles , you like that to happen to Chima ???

Coming back to China , there are vested interest to see China break up . There is no way China would ever grant Tibet independence , because for China to do so Sinkiang , Inner Mongolia Macau , Hong Kong and Taiwan would also demand their independence and that is the same as USSR becoming what it is today . All these countries are already running on their own .
So what are demanding and rioting for ? Tibet independence ? the next thing you see will be the Americans extending their missile shield to Tibet , encirciling Russia and China , like what they have done in Europe , in Poland , in Ukraine and maybe to Georgio. The Chinese are not so gullible and stupid , they have seen what happen to the USSR ,no way will they let it happen to them .

My dear friend , this is no conspiracy theory .
The twin towers were never brought down by the 737 crashing into them . They were brought down by explosives , done bu professional demolition experts , in other words INPLOSION .
a)a tower in Spain burned for 24 hrs ,but didn't collaspe
b)the towers collapse in 8.5secs for a 110 storey tower block . This is equivalent to dropping a rock from a 110 st high tower block .
c)The temperatures of the plane fuel was not high enough to melt the steel frames of the two buildings .
d)Normal collapse the building would have not been STRAIGHT down .
e)Why were there no big structures or big pieces of the building ? All were left were like it was blown to small pieces and in powder form .
f)Why did WTC building 7 also collapse even though no plane crashed into it and it was not burning ?

I think I can go on bit I feel thats enough for the time being , if you are interested pls go to the 911 truth website and get enlightened .

Until you and Michael Moore come up with something more concrete than 'I say so' the conspiracy theory about 911 belongs right up there alongside alien abduction, (always) hazy UFO sightings, Roswell, The Loch Ness Monster, Big Foot, Vampires and Dracula. A god read;long on speculation, short on facts and proof!

It is inconceivable that the US Govt or CIA would conspire to engineer a terrorist attack on its own citizens, within its own borders. Dream on, brother. Also the WTC was built some 100? years ago. As was proven in the Titanic case, the integrity of buiding structural materials and components may not have met what laborotary specs say they did in the last century.

You take umbrage over 500,000 deaths in Iraq, but dismiss 50 million under Chairman Mao as 'maybe that's a way to control population.' Very strange bias indeed. Most of these deaths & famines were directly caused by Mao's policies, not natural disasters!

In the last analysis, I am neither pro-American nor anti-China. I believe in what Mahathir said - 'Prosper Thy neighbour'. Unfortunately, for Dr.M this meant foreign countries opening up their markets completely to M'sia, but if they wanted to export to M'sia, then they had to do a Ali Baba with the Bumis and no other.

If the situation were the reverse and it was China the advanced sconomy vs USA the developing one, how magnanimous would China be?

So, in the world of free market trade, human rights and competition, all's fair. China will have to improve sincerely its PR and address the problem of Tibet, without always responding knee-jerk fashion with the the typical litany of 'bourgeosie capitalist dog saboteurs, China haters!!' and the language of crude spindoctors.

It is also a myth that sports is divorced from politics. Every Olypic game since 1936(where Hitler marched out his much discredited Aryan Nazi contingent) has involved politics. Israelis were massacred in 1972 in Munich, Russia was boycotted in 1980, China was denied the rights for 2004 vis-a-vis Tiananmen Sq.

So, when you want to rub shoulder with the Big Boys, you must learn and abide by the rules & etiquettes of the Club. Grow up or remain isolated!

Thanks,I appreciate the history lesson and i'll admit that putting Kamunting and Guantanamo in the same boat is far fetched.
However I am not a banner waving monkey for democrat,repulican, communist,PKR,BN or anyone else.
Call me stupid. Say i'm poorly informed but don't tell me who i should or should or should not join. I'd join Idi Amin , Hitler or the devil if it pleased me. Just to piss you off.

So the neo cons have been making the world a safer place? Safe for who? safe from whom? I thought they were busy trying to scare the shit out of the rest of the world.
Clinton,Bush, Regan or whoever,i couldn't give a flying monkeys fart.I'm more concerned about people like The Carlton group and Halliburton who I suspect have a huge influence on what all these U.S. Presidents have said and done. But i'll admit that that's about the extent of my opinion on the subject.
Don't ask me how i know this.I honestly haven't got a clue.
I'm also concerned about the waterboarding and other horrible techniques used to extract confessions. Detention without trial doesn't seem so bad when compared to physical torture.Not that I imagine that ISA/ Patriot Acts are picnics.
I'd admit to anything if either was done to me. Wouldn't you? That's why i think places like this should be shut down.
Do i like terrorists? Hell no! Especially one's that dictate what i should or should not do. Should i be scared of terrorists? you tell me .

It is also inconceivable that President JF Kennedy was shot by Lee Harvey Oswald alone ??? As what the Warren Commission findings that Lee acted alone ? That there was never a second assassin on the grassy knoll ? God knows whether he acted alone but latest findings point to a conspiracy between the CIA , the Mafia and the Cuban exiles . In America anything can happen as long as it justifies the cause including murder as people are expendable .

Take the Nazis for example :in February 1933, a Berlin fire station received an alarm call that the Reichstag building, the assembly location of the German Parliament, was ablaze. The fire started in the Session Chamber , and by the time the police and firemen arrived, the main Chamber of Deputies was in flames.
Investigation of the Reichstag Fire continued and after World War II, research and declassification of official documents have confirmed the widely-held belief at the time, that the Nazis organised the arson attempt in consolidate their grip on power.
So this episode points to the fact that the Nazis burnt their own parliament to consolidate their grip on power and put the blame on the JEWS .

I rest my beliefs on 911 as its no point trying to convince someone who is not prepared to look at possibilities and probabilities and facts . Micheal Moore is not alone , in fact there are thousands of professionals who are in this crusade . For your info I suggest you look into these websites :
