Mahkamah putuskan pelantikan Dr Badariah sah PDF Print

Dalam keputusan majoriti 3-2, Mahkamah Persekutuan menetapkan bahawa pelantikan pensyarah undang-undang Dr Badariah Sahamid sebagai pesuruhajaya kehakiman (JC) adalah sah.

Keputusan majoriti tiga itu dibuat oleh Hakimhakim Mahkamah Persekutuan, Datuk Nik Hashim Nik Ab Rahman; Datuk Hashim Yusoff; dan Datuk Azmel Maamor, sementara Ketua Hakim Negara Datuk Abdul Hamid Mohamad dan Hakim Mahkamah Persekutuan Datuk Zulkefli Ahmad Makinudin membuat keputusan menentang.

Kesemua lima penghakiman itu dibaca oleh tiga timbalan pendaftar mahkamah.

Dalam menolak saman oleh Badan Peguam Malaysia yang mencabar pelantikan Dr Badariah sebagai JC, Hakim Hashim berpendapat selaku pensyarah undangundang di Universiti Malaya, Dr Badariah mempunyai pengalaman undangundang luas dan mahkamah tidak punya sebab sahih untuk menyekat beliau daripada dilantik sebagai JC.

Hakim Azmel berkata Dr Badariah seorang yang layak dilantik sebagai JC.

Hakim Nik Hashim berkata Dr Badariah mempunyai kelayakan minimum dalam perkhidmatan kehakiman oleh kerana beliau adalah seorang pensyarah undangundang dan mengajar undangundang kepada pelajar Universiti Malaya.

Hakim Abdul Hamid, dalam keputusan menentang, berkata Dr Badariah dilantik sebagai JC pada 1 Mac 2007, dikehendaki menjadi peguam pengamal selama 10 tahun sebelum boleh dilantik sebagai JC dan ini dipersetujui Hakim Zulkefli.

Dalam saman itu, badan peguam tersebut mahukan pelantikan Dr Badariah diisytiharkan batal dan tidak sah dan tidak mempunyai kesan atas alasan pelantikan itu bertentangan dengan Artikel 122AB dan 123 Perlembagaan Persekutuan yang menghendaki seseorang itu menjadi peguam pengamal selama 10 tahun sebelum ia boleh dilantik sebagai pesuruhjaya kehakiman. After reading the two dissenting judgements, I am greatly puzzled as to how the other three judges can come to their conclusion when it was pointed out in the two dissenting judgements that a mandatory 10 years experience as an advocate and solicitor is a requirement. It sure smells fishy . Can the ACA please take a look into this matter ?.

Di Malaysia, bukannya kelayakan kertas boleh menentuakn masa depan seseorang itu.
Yang paling berkesan ialah siapa yang awak kenal di atas itu yang akan mengorak kejayaan hidup terjamin.
Inipun kalau berada dalam pasukan MYteam yang betul.
Yang ini dilantik mungkin mempunyai anak/saudara terdekat/pertalian tertentu yang boleh menjamin kerajaan keselesaan mengubah perundangan khusus memberi keutamaan kepada BN serta orang perseorangan tertentu.

Will this Badariah lady step down gracefully or will she take University Malaya down another 100 rankings....the CJ doesnt want her..period.

This is just mind-boggling. Artikel 122AB dan 123 Perlembagaan Persekutua I assume is part of the constitution so how come there's such a wide interpretation? Maybe this runs deeper where it's another act in some power struggle in the judiciary. Who's Dr. Badariah's backer?

I think the majority views decided the case from their hearts not the law as can be seen that one of them was quoted as saying Dr Badariah legal qualification is impeccable.

But I tend to agree with the CJ contention that the issue is she did not meet the criterion in that she must have been called to the Bar, admitted and enrolled as an advocate & solicitor for 10 years.

Simply put, Dr Badariah should step forward and decline the position solely on principle.

All of Badariah's judgements may end up void....and the tax payer may have to cough up the costs.....

Why does a person who does not comply to the basic written rules, want the position?

In Bodohwiland, any thing can happen. When caught for back door entry, just say: others have done that before and therefore legal ma! Just worried that soon failure students repeating for 10 years will make entry to the same seat but through the third door and VK L's appointees will say: OK what!

Mungkin 3 hakim yang bersetuju itu tidak tahu cara hendak membilang angka sepuluh seperti yang dinyatakan dalam perlembagaan malaysia. Barangkali juga, hakim-hakim tersebut tidak dapat membezakan antara pengamal undang-undang dengan pengajar undang-undang. Kemungkinan besar ketiga-tiga hakim tersebut telah diberikan memo.

Apa pun Malaysia tetap boleh! Buat benda songsang atau buat apa sahaja semuanya o.k asalkan insan menjadi modal UMNO. Itulah budaya yang sedang dievolusikan oleh Pak Lah sebelum KJ menjadi PM.

Maybe everything has been done for the sake of the country and nothing else. In that case we excuse the three wise guys and stomach what they have decided, come hat may. Surely there are many more such and yet more coming. So why worry, be merry.

Under the present circumstances, and with due respect, it would be best to leave everything to the respective appointee's conscience. The appointee is a very intelligent and learned person and her intellectual capacity would be equal to if not higher than all the 5 FC judges combined. Her interpretaion of the laws is also not in any way inferior to the 3 comprising the majority.
The appointee should address the question to herself, and if she still thinks that her appointment is perfectly lawful i.e. as the 3 have decided, then let her do her work according to her conscience. If the answer is the same as the 3 then she has placed herself at the level of those 3 intellectually.
Asking herself the question should have been done at the very instant she was offered the post of JC in order to save all the anguish and spare the embarassment of having to bend the laws by those concerned for whatever reasons whatsoever.
We trust she is a class above us all.
Or leave everything to God ?
