(Malaysian Mirror) - Lim Kit Siang has called for the resignation of Attorney-General Gani Patail for failing to charge former Transport Minister Chan Kong Choy for criminal breach of trust.

The DAP stalwart said the findings of the Public Accounts Committee (PAC) on the Port Klang Free Zone (PKFZ) scandal was sufficient to warrant his resignation. 

lim-kit-siang.png"The PAC report has confirmed and vindicated my statements and allegations about the PKFZ not only as a can of worms but a swamp of crocodiles that I have made in Parliament since the last session.

"[It] raises the question why no action had been taken very much earlier to avoid the rotten state of the PKFZ scandal today," said Lim in his blog.

According to the PAC's findings, as much as RM645 million could have been saved had PKFZ land been acquired under the Land Acquisition Act 1960. PAC recommended that former Transport Minister Chan Kong Choy be investigated by the Malaysian Anti-Corruption Commission (MACC) and the police for unlawfully issuing three Letters of Support.

Lim said Chan should be charged for criminal breach of trust under Section 14(1) of the Financial Procedure Act 1957 read together with Section 409B Penal Code.

"I commend PAC for taking such a clear stand but I cannot wonder what is the use of such a reference to the MACC, when the MACC and previously the Anti-Corruption Agency had been aware of these facts as I had spoken about them many times in Parliament in the past three years.

Committed breach of trust

Lim said during a meeting with the PAC committee, MACC Director of Investigations Mohd Shukri bin Abdull had confirmed that the attorney-general's office has investigated the issuing of the Letters of Support and found that no offence had been committed

What purpose can be served by PAC recommending that SPRM should further investigate into Chan Kong Choy for the offence of criminal breach of trust when it had already investigated and cleared him of having committed any such offence?"

"Attorney-General Gani Patail had appeared before the PAC to reiterate that Chan had unlawfully given an implicit government guarantee in the three Letters of Support which he had no power to give as transport minister. The question is why the Attorney-General had failed to take action against Chan for abuse of power or criminal breach of trust in illegally. Gani Patail should resign as Attorney-General if he cannot give a satisfactory explanation."

Lim also called for a Royal Commission of Inquiry to build on the PAC findings as well as to investigate why the MACC, the Attorney-General and other key institutions and important officials had failed to discharge their duties in allowing the PKFZ scandal to reach the present astronomical scale.

no such thing as resigning in msia!!! the AG is the gate keeper for UMNO/BN and he is the key, the most important one and all u need is to deal with one man with a small team unlike the police. we know how it works and UMNO/BN will not want a honest man or a system which is clean. Rakyat didahulukan is all bull shit, UMNO/BN leaders come 1st and the their performance in terms of wealth accumulation is diutamakan.

Not only AG head must roll. Pak Lah and his half-past six Cabinet members must roll as well. Remember, the Cabinet ratified the whole series of documents and events.

The whole damn cabinet should resign...they are privy to any decision made by cabinet Minister. In other countries head will roll. in Moooolaysia we have a bunch of Moooolayus from UMOOOONO who are killing and raping our country and bleeding it to death.
you see Mr Kit Siang..they don't care a damn. YOu can shout cry and make a lot of noise...they hold the power...they hold the power...In any case they do not care a damn for our country or the people. They have enough money stashed away in Switzerland...land in Australia or New Zealand or they hold PR status in Canada...and after causing trouble here they run there and hide...safely..while you and me get slaughtered by the police and army...then they come back and claim they are fighting for the country..and get the citizens to be suckers again...
I hope you are not like the UMOONO Moooolayus who will sell the country, buy a new wife and murder to hold on to power...The only way is to swat them like flies and get dump them in the indah water cesspool...vote them out..bloody bastards.

In Korea & Japan government servants, Ministers & other leaders who bring shame & dishonour to themselves & their families or failed to perform their duties to the satisfaction of the people would commit suicide or hara kiri. In Japan some of them do so by disembowelment of their stomach using a knife or sword by a rite known as Seppuku.
The well-known writer Yukio Mishima did this in public many years ago. In our country we have the right weapon in the kris now belonging to Krismuddin but no one perform the Seppuku rite to restore their honour or repent for their mistakes.
Our is Boleh Land except for Hara Kiri.

The PKFZ now sounds more like Port Klang Free-For-All Zone instead of what it is suppose to be. Not only Chan Kong Choy and OCPhang that is to be investiged, Azim Zabidi, Faizal Abdullah and all their UMNO cohoots, Abdullah Badawi for being the dumb finance minister who minuted Kong Choys request for financial help, MACC,AG. All these should be brought to book.
How sometime I wish we are communist China...these perpetrators will face the firing squad in Dataran Merdeka. Even the communist have greater intergrity against corruption.
