All these would have remained hidden had it not been for Kartika. We owe her an immense debt of gratitude for exposing this flawed and misguided system. She has done her part, but I do not see the nation doing its share. Instead we are consumed with the minutiae of her caning and ignore the huge elephant in the room: a hypocritical and an unjust Shari’a that is ill suited for our needs.

THE CORRIDORS OF POWER

It took a diminutive but courageous 32-year-old nurse and mother to expose what has been obvious to many but conveniently ignored: a grossly unjust and frankly hypocritical Malaysian Shari’a court system.

Subjecting a first offender – and a young mother at that – to six lashes of whipping for drinking beer in public cannot be considered a “just” punishment. Bluntly put, it is barbaric. And if something is not just, it cannot be Islamic. It is that simple. I wonder if those advocates for caning could tell me under what of the 99 attributes of Allah would caning a young mother fall under. Certainly not Ar Rauf (The Compassionate) or Ar Raheem (The Most Merciful)!

A Profile In Courage

Kartika Sari Dewi Shukarno is truly a profile in courage, a genuine heroine. She did not seek out to be one; the circumstances could easily have tuned her into an angry rebel, or worse.

She succeeded by adhering to our traditional halus (soft) ways. She did not challenge the system; on the contrary she freely admitted to her error and accepted her fate, just like a good obedient Malay daughter was taught to be. She asked only that the whipping be done in public so others could learn from her mistake. How noble and touching!

By those seemingly meek actions she exposed the hypocrisy of the Islamic establishment, and did so far more effectively than all the shrill voices of those in Sisters-in-Islam and other vociferous advocates for reform. More significantly, her Gandhi-like passivity is now noticed by the world.

Thus far what seems to get whipped is the image of Malaysia as a modern tolerant Islamic country. Her submissiveness, reflecting her Islamic faith (Islam after all means ‘one who submits’), also rattled Prime Minister Najib and Women’s Minister Sharizat. It is hilarious if not pathetic to see them scurry for cover.

In urging Kartika to appeal despite having her appeal period lapse, both Najib and Sharizat must feel confident that the sentence would be reversed. What however, if it were sustained? Their utterances imply that they could influence if not control the Shari’a Appeals Court’s decision. That is a scary thought. It bears pointing out that Kartika was sentenced by a court in Pahang, Najib’s home state. Meanwhile Shahrizat is bewildered as to why Kartika refused to appeal. The poor Women’s Minister still has not figured it out.

Home Minister Hishammuddin too joined in with his share of idiocy. When Kartika presented herself to jail for the planned whipping, she was turned away as the prison, under Hishammuddin’s portfolio, was not prepared to carry out the sentence!

The idiocies did not stop there. The Chief Judge of Pahang’s Shari’a Court of Appeal ordered a deferment and review of the sentence “in the interest of justice.” Left unstated was under what statute his order was made. Then there was the Federal Attorney-General also intervening, obviously not realizing that Islam is strictly under state jurisdiction.

There are those who would like us to believe that the ‘Islamic’ version of whipping is not at all cruel. The association of Shari’a lawyers and an umbrella group of Muslim NGOs maintain that “caning, in the context of Muslim punishment, is for the purpose of education and is different from the penal nature of some provisions in the Common laws and the civil courts.” Let’s ‘educate’ them!

Presumably the ‘Islamic’ whipping is closer to the S&M variety. Kartika is assured that she would not be stripped but allowed to wear her baju kurong. How thoughtful! Perhaps they could supply her with a black leather one; she just might like the whipping.

The Perak mufti opined that Kartika should be grateful as she would receive only six instead of 80 lashes that the mufti himself would impose and, I presume, like to administer personally. Thanks to the mufti’s advice, Kartika has now accepted her fate with equanimity, if not his blessing.

In the ensuing furor, the sentence was deferred, “in the spirit of Ramadan!” The piety of these folks is truly touching. Presumably once Ramadan is over, and the furor subsided, the whipping could begin. What is obvious is that the deferment was a relief not for Kartika but the establishment, a chance for them to recover from their collective shame and stupidity.

Expansion of Shari'a

In the past, the Malaysian Shari’a was restricted to family laws with such mundane matters as inheritance, divorce, and adoption. As part of Mahathir’s move at “out Islaming” the opposition PAS, the Shari’a was granted greater jurisdictions such that today it is on par with the secular system, as well as extending into civil and criminal matters.

Malaysia prides itself in being the only nation with a unique dual-track justice system that coexists harmoniously. Both assertions are erroneous. Canada also has a dual judicial system, with Quebec following “civil law” based on the Napoleonic Code and the rest subscribing to common law of the English tradition. However, the Canadian Supreme Court has final authority over both.

As for the harmonious part, Malaysia has yet to resolve the often conflicting jurisdictions of the two systems. It is not at all clear whether the country’s Federal (Supreme) Court has jurisdiction over the Shari’a courts, which gives a special Malaysian meaning to the word “Supreme.” Many maintain that it does not, which makes a mockery of our constitution. This unresolved issue has consequences, often heart wrenching, as demonstrated in many recent well publicized cases.

As the Shari’a now also has criminal jurisdiction, Malaysians are inherently not treated equally under the law; their fate depends not on the crime but their faith. A non-Muslim man caught committing adultery faces only the wrath of his wife, and possibly her vicious divorce lawyer. A Muslim man however, could be whipped, the same ‘Islamic’ whipping that Kartika would face. Now imagine the complications if one partner is a Muslim and the other, non-Muslim.

There are other distressing inequities if not outright hypocrisy. While Kartika would be whipped for drinking beer in public, the Muslim directors of beer companies – the manufactures and pushers, in the language of the drug culture – are honored. I also do not see the Shari’a going after ministers and sultans running away from their gambling debts.

Muslims confuse the concept versus the content of Shari’a. The concept – Shari’a being a body of laws based on the Quran –is accepted by all. It is a matter of faith; no disagreement there. The contents however are the products of human interpretations. As such it suffers from all the imperfections inherent in such endeavors. It also results in the Shari’a of the Shiites being very different from that of the Sunnis, as well as variations within the Sunni Fighs.

The corollary is that the content of Shari’a can be debated. These discussions must necessarily involve all stakeholders, not just the scholars and ulamas, a point emphasized by Abdullahi An Naim in his book, The Future of Shari’a. He suggests that Muslims revisit the Shari’a using the same rigorous intellectual tools used by earlier luminaries while cognizant of today’s universally accepted norms of constitutionalism, gender equality, and human rights, among others.

If that is too ambitious, begin with a more modest one. Get rid of the unjust elements in our Shari’a, like whipping women, and the grossly “un-Islamic” elements in our secular laws, like jailing citizens without affording them due process.

That is the crux of the issue, not caning. Thanks to Kartika, she is forcing us to face this reality squarely. She gently stared at the system, and it blinked.

until today, there is no standard syariah law agreed by all. It is based on the religious scholars intepretation.
If they say those caught for adultery should be stoned to death, there is nothing anyone can do.
thanks Dr. M. By enlarging the syariah law' jurisdiction, muslims are now subjected to two sets of laws and even more complications when trying to settle their problems in the courts.

You say anything unjust is un-Islamic. I say anything unjust is inhuman. And the Islamists tell that as non-Muslim I should stay out Muslim affairs. I tell them that as a human being and a fellow Malaysian, I have every right to to say my peice. And I tell Kartika that there is no court order on the day that judgement was passed that you can be taken into custody prior to the caning. Do not submit to any arrest. Instead ask them to come to the place of your choosing to be caned. Otherwise they can buzz off or charge for any other offence they can find in the books.

As a non-Muslim, I of course do not want to comment on the Kartika Dewi issue since it comes under Islamic laws. She can be whipped, stoned to death, have a hand chopped off, that is not for me or any other non-Muslim to make a statement, it is none of our business. There has been much analysis of the subject by many persons and I am sure they are all learned in Islamic jurisprudence.

Being a Malaysian, I am curious about knowing more about any religion, be it Christianity, Buddhism, Islam, or Hinduism. So my understanding of Kartika's punishment is that it was under Islamic and as everyone has hastened to point out, anything done within the teachings of Islam is both noble and right. My confusion is over the timing of the punishment. Why has it been postponed to after Ramadhan? Since anything done under Islam is for the greater glory of God, is there an "appropriate" time for it? Should somethings be NOT done during Ramadhan lest it lessen the purity of the month?

Like I said, I am most ignorant. Perhaps some of the many experts can explain why the whipping was postponed.

But Bakri Musa, starting from Mahathir onwards, the Prime Minister of the day had proclaimed that Malaysia is an Islamic country contrary to the constitutional provision. Now PAS too is bent on turning the country into Islamic country. The creation of Syariah courts, Islamisation of government schools, temple demolishing, temple relocation, refusal to allow construction of temples, removal of religious education for non-Muslims in govt schools, using public tax money to build mosques instead of money collected from Muslims etc etc is part of that process for which Muslims like you are eternally grateful. So, you are blessed. Why cry foul over Syariah courts? God the mericiful has given you what you wanted. Just enjoy it.

Furthermore, as a non-Muslim, I do not have the knowledge to comment on Islamic justice and even if I try to seek the truth, I will not learn about the "true" Islam from the judgement and testimony of Malaysian Shari’a. Please execute your judgement on all those stated by Fart Fart and not forgetting J.J and gang.

Fortunately there are good Malaysian muslims like Bakri and others that I believe I may learn the true meaning of Islam.

My view about Syaria laws is that it is too inhumane for certain crimes. Actually, some crimes are not crimes like drinking beer, close proximity and etc. The laws are dictating how you should behave, which I feel that they are trying to act like GOD. I would like to ask the Muslim scholars how to differentiate a faithful and an unfaithful Muslim if there aren't any tests to tempt the followers. We are born with choices. To be good or bad. To go left or right. Even if you depict the behavior using the law, I still can find ministers' children committing such crimes out of the country and this is an act of hypocrisy. At the end of the day, humans are still choosing and laws cannot force their will to bend to its ways.

I dare say that a free-willed individual who acknowledges his/her shortcomings is a sincere and faithful Muslim than one who wears a mask everyday to face his fellow Muslims. Umnono/The-End have many hypocrites.

All the fracas we have seen thus far is as though God under Islam is more concern with drinking a few glasses of beer by a woman than rampant corruption of government leaders. You get cane for drinking if you are a normal citizen and free of punishment for corruption if you are in power. If "muslims' believe such nonsense, can anyone really tagged those who critisize and mock "Islam" as bashing Islam? Common sense will precribe that any religion who practices such nonsense ought to be lambasted ss primitive and out of touch with reality and the modern world.

Malaysian transsexual Tasha
The report focuses on a 28-year-old transsexual called Tasha, “who looks for all the world like a striking young woman. But her all-important Malaysian ID card declares she is a Muslim man”.

Says Tasha, who has been cross-dressing since she was a child: (), there are only men and women, there are no transsexuals, and this is () country so that makes life very difficult for us.

Like many transsexuals in Malaysia the clash between the ID card and appearance means Tasha is shunned by employers, and forced to make her living as a sex worker.Tasha endures drunken clients, violent pimps, and aggressive competition from other transsexual prostitutes, but what really frightens her are the raids mounted by police and religious authorities.Enforcement officials from the Islamic Affairs Department (JAWI) – notorious for swooping on nightclubs and motels in search of Muslims drinking or having extramarital sex – regularly descend on the streets of Chow Kit.

Sex workers are sent scattering on their high heels, and those who are caught and hauled off face jail or intensive “counselling” sessions like a two-week interrogation Tasha once endured.

They asked me why I didn’t want to be a man, how I became like this and why I behave like this. But it didn’t change my mind. Why can’t () accept us? We are human beings as well. I am also one of God’s creations.

It was not always this way for transsexuals in Malaysia, where they are known as “mak nyah”.Says Teh Yik Koon from the National Defence University who has written a book on mak nyahs:

Until the early 1980s transsexuals were usually accepted in Malaysia, they could go for a sex change and amend their identity card. At that time quite a few had sex changes, some became happily married and even adopted children.

But in 1983 a fatwa that prohibited gender-reassignment surgery as well as cross-dressing was imposed on all Malaysian Muslims, who make up 60 percent of the population.

Adds Teh, who estimates there are at least 20,000 in the country:
So now they’re not accepted, there’s no such thing as transsexuals according to Islam in Malaysia. The biggest dilemma for a Muslim transsexual is the ID card, because it states they are a Muslim man but when you look at them they look like a woman.

Some do manage to find regular work, typically as hairdressers, make-up artists, and boutique sales assistants, but advocates say that at least 70 percent resort to prostitution.

Addressing the problem of work, the crazy cleric Zakaria declared:
Of course they won’t get a job if they turn up wearing a woman’s dress. All religions are opposed to this.

We find morons and super idiots all over the world but the concentration in in Peninsular Malaysia.

They think that the social customs and rules of the desertland tribes and babarians are god sent laws. They even think the book dropped from heaven just like the Cow Head dropped in Shah Alam, amidst a demonstrating crowd.

Till they accept that a religion is another way of life and there is nothing superior about theirs, there will be no peace. Ayah Pin and his group is a hundred fold civilised than the one we are witnessing.

The ninth month of Ramzan (Ramadhan) in the Muslim calendar is a holy month and as far as possible, no evil shall be done. All other months aren't as holy. Therefore, the Islamic authorities had recommended that the evil whipping of an almost innocent woman (an unholy act) should not be done in a holy month but it is okay if in unholy months. Thus, the deferment.

Thanks for exposing whole syriah court system is a scam. The institution is manned by UMNO and half breed backward mongrels! Hypocites who chooses who to prosecute and of course they alway take advantage of the weaker sex. Will they also whip those arrested for drinking at a disco club recently which includes ranking muslim police officers and other civil servants etc. More likely their tails are behind their legs! Using the ramadan to justify an intentional stupid decision in Kartika's case as an excuse is obscene and sickening to say the least. Malay muslims need to wake up fast.

I am still baffaled why they did not whipped the drunkard UMNO ex-Minister who "raba bontot" a woman not his wife. He was caught drunk right?

The thing is, instead of whipping him, they promoted him to be an Ambassador.

I fully support the implementing of Shariah laws by muslims on muslims themselves. Whether it is fair or not, civil or barbaric should be entirely up to the muslims to decide. Being a non muslim I feel that, as in the constitution of Malaysia, they have the right to pursue their religion and non muslims should respect that. However, the religions of the non muslims should be respected and muslims values should not be enforced on non muslims as per our constitution. Fairness is the key to religiuos harmony. If non Muslims do not complain that their tax money had been used to build mosques whenever and where ever muslims wanted, then I think it is only fair that just a temple build in section 23 should not be made into a big issue, and selling beer should be allowed as long as muslims are not allowed to buy from these stores. Afterall, if you are a real muslim your faith should be unshakeable and if such triffle matters can change your faith or make it difficult for you to practise your faith, then it is better for you not to be a muslim because your faith in Islam is, afterall, not deep and sincere enough.

It's not true. The shariah courts IS NOT hypocritical. They are just limited in terms of power. They cannot rule over muslim board of directors in liquor companies simple because their powers does not cover that area.

Their powers are only limited to Muslims that is caught drinking.

These bigots at the Syariah Courts just dispense the laws according to their whims and fancies. Real Idiots. The whole world is now laughing at us. They are now in a fix, and so are asking Katrina to appeal, so that they could then let her go on sympathetic grounds and safe their skin! Unlike Malaysian, she is a Singaporean Malay - that's the difference.

As money is not evil, but the love of it is, so is this canning issue. Many Muslims would by now be ashame and furious for this insulting issue. But as money itself is not evil, so is this issue. Either we learned from this and repent and then improve ourselves OR be angry and take drastic action to justify one's anger. Kartika in a way has sacrifies herself to expose the syariah laws either willingly or unintentionally. Now that all the hypocrisis had been revealed, where do we go from here? To all peace loving Muslims and God fearing Muslims, its time to take a good look at the Syariah laws and Islam. Some would take this as a redicule but it is love and those who repent and improved themselves are the blessed ones.

When Kartika drank the beer and later apprehended she knew she was wrong. When prosecuted she took the responsibility of her action and admitted what she had done, accepted the whipping as part of her punishedment. When the fiasco occured she vehemently stood her ground and did not want to appeal.

Personally I think the issue has ended and nobody should doubt her decision. Please show some respect to this little lady.

As for the decison taken by the authorities not to whip her due to the holiness of Ramadhan, it is all just a bull-SHIT. The month of Ramadhan is indeed a holy month but the real reason is that UMNOnok BN has be caught pissing in their own pants. Now UMNOnok and BN morons are trying to wash the stinks away. Thats the real reason.

No great civilization can have two laws for supposedly one people. Laws are meant to unite a collection of people and forge them into a Nation. When there are two separate laws for one people, you have actually divided the people into two camps. People governed by two separate laws cannot make one nation as there will be no similarity of laws to unite them.

The chasm between Civil and Shariah in Malaysia is one of those that threaten to tear the nation into two. Another force that threatens to destroy Malaysia is the fact that enforcement of the laws (in Civil and in Shariah) are perceived to be favorable to the elites but unfavorable to the normal Joe on the street. As such, Malaysia is slowly being torn 4 ways, 2 ways by the Civil-Shariah divide and 2 others by the Elite-Normal divide.

In the medium short term, the government MUST first ensure that on the Civil-Shariah divide, that all persons be subjected to the law. There must be no exception for Royalty or those who think themselves Royal. Secondly, the government must reel in the Shariah Courts that have no power over and above the Federal Constitution. Shariah Courts MUST be subject to the Federal Courts in order that there is finality, fairness and stability in the laws of this one Nation.

In the long run, Malaysia must embark on a plan to have one law - that draws from the wealth of the Civil system as practiced all over the modern world and from the concepts of justice and decency from the Islamic world.

In this regard, Muslim Jurists are urged to synthesize the concepts of Shariah rather than be fixated at forms and procedures as a way of illuminating Islam and the Justice that Islam to this Nation. Civil Jurists must sit with their counterparts to work out whether the synthesized concepts of the Shariah system can be “glued” into the Civil system in light of modern norms and progressive standards of human rights today. "Barbaric" laws (found in the Civil or Shariah system) must give way to more humane laws and procedures - that is what Jurists do - to interpret the concept of justice and decency in light of modern trends and modern understanding of what justice is to be.

Muslim jurists must not (as they do today) refuse discussions that attempts to "glue" the concepts of the two systems together. Refusal would mean certain death of the Nation that we know today as Malaysia and would make Malaysia poorer for that. We must always remember that ALL laws are subject to change when the circumstances that gave rise to those laws change. Concepts of justice and decency can be re-interpreted into the modern world by diligence and open mindedness to the norms and standards of human rights without risking the very concept of justice and decency.

We risk the Nation of one people by our dismissive tone "This (whipping) is God's law and therefore cannot be changed. We are not open to discussion". If so, then we are damned to always live in a hallucinated world of the past - or worst make believe.
