In a bid to clear the air and find a way forward for the Kampung Buah Pala residents, the Pakatan Rakyat state government has decided to declassify information related to the shady sale of village land undertaken by the previous administration led by Umno-BN’s Koh Tsu Koon.

Caught in a bind by the transaction that was hammered through without consulting them, Kampung Buah Pala folk have been up in arms over the matter, especially as an August 3 eviction deadline neared.

But emotions have gotten out of hand, making it difficult for the current Chief Minister Lim Guan Eng to work out a solution, without ‘backseat drivers’ trying to make full use of the villagers’ plight for their own political agenda.

In particular, outlawed Tamil rights group Hindraf has been active in instigating the villagers into demands that have been slammed by many other Penangites as unreasonable.

“I wish to appeal to the residents not to be manipulated by certain irresponsible parties but to come and meet me for a heart to heart talks,” Guan Eng said in a statement out on Thursday.

“By refusing to meet, the residents are playing into the hands of the land robbers who want to these talks to fail, the residents evicted, their houses demolished and Pakatan Rakyat blamed.

“Unlike BN, the PR government has not cheated the residents of a single inch of their land and will try out all legal avenues suggested by their legal counsel, Cecil Rajendra.

“Time is running out and the residents should distinguish between those who are sincere in helping them against those who are distracting attention from the real culprits who robbed them of their land.”

Let the truth sink in, don’t allow yourselves to be used

According to Guan Eng, the decision to declassify the deals swung by Tsu Koon’s government was taken by the current state executive council, with the approval of the state legal department.

“The chronology of events prove beyond a shadow of doubt that Tan Sri Dr Koh Tsu Koon And His Umno, MCA, MIC and Gerakan cohorts has robbed Kampung Buah Pala residents of their land without consulting them,” Guan Eng said.

The sale of the Kampung Buah Pala state government land to Koperasi Pegawai Kerajaan Pulau Pinang was approved twice by Tsu Koon’s Umno-BN state exco on August 18, 2004 and June 8, 2005.

Initially, a premium of RM 6.42 million or RM 20 per square feet was set but this was later slashed down to only RM 3.21 million or RM 10 per square feet.

At the federal level, Prime Minister Najib Razak has refused to consider extending any financial assistance to the state as requested by Guan Eng, making it impossible for the Pakatan administration to buy back the land as asked by the villagers without incurring heavy losses that would cripple its other operations.

“So far Koh Tsu Koon has not explained why he approved this project without consulting the residents or selling it to Koperasi at such a low price,” said Guan Eng, who is also DAP secretary-general and Bagan MP.

He added that he would continue to try and meet the remaining 23 families who have refused to shift out of the village.

On Wednesday, they refused to see him without the presence of a third party – ostensibly their lawyer but whose credentials have not been checked and is unknown to many of the residents.

“If BN was in power now and not Pakatan Rakyat, the residents would have been evicted and Kampung Buah Pala would have been demolished since last year.

“Questions are raised why one or two of the so-called leaders of the residents are now so defensive of BN and anti-PR, particularly anti-DAP.

“Why is this aggression targeted against the PR government that is trying to help them? In contrast not a single demonstration or action is taken against the BN land robbers who deprived them of their rights,” Guan Eng said.

Even the orang Aslis are willing to let go of their land which they have been living for hundreds of year to built highways and dams for our daily convenience, i feel so sad that this Kg Buah Pala thing happened.

i'm sure most of the 23 families here are not as poor as some of us, otherwise they would take the rm200,000.00 and buy some land elsewhere to start on with their cowboy life. i see almost all these families owns at least a bike or a car. mind you if they are also enjoying Astro everyday. i see malay families worst off than them here, even some chinese too.

too bad this have been politicised by all parties. afterall we are just living on borrowed land and time. i trust the PR government will be able to solve this issue as quick as possible rather then give the BN/UMNO goons the opportunity to blow this issue bigger to their advantage.

just my little opinion...no insult intended.

Pakatan has been the punching bag since Day 1. And some elements in Hindraf had played into the trap of the Barisan. This declassification move would reveal what everyone wants to know. And, believe me, there is more to see what further damage the Barisan had caused and done if additional documents are to be declassified. Not only in Penang. Much more elsewhere. Try the State where you have that luxurious mansion (costing 3.5 million ringgit only) built with the strong Balinese theme. Not even any Malaysian theme after so many millions are stolen from the Malaysian rakyat.

It is sad but if the interested parties were to sit and discuss in a rational manner, the problem will be sorted out. Mr.Lim is doing the right thing by declassifying the deal made previously so that all can see actually who the real responsible people are. Anyway, I am sure various permits will be needed to develop and build on the land. This I think comes under the municipal and state government. Numerous safety regulations will need to be followed and appropriate building codes employed. I am sure the PR government will implement them to the fullest degree to ensure that whatever is built is to the utmost standard. Of course, this may cut into the profit of the builder but then such is life. Next, these documents will need to be perused carefully and if there is any conflict of interest amongst those who had bee involved in the approval process, then MACC MUST INVESTIGATE and bring charges against them(Iwon't hold my breath)

The state government cannot use state money to buy the Kg. Buah Pala land.
Any state money belongs to all Penangites, and not only residents of Kg. Buah Pala.

If there are frogs in Perak which can hop , then be very sure there are also frogs to be found in Penang, even on higher land forms. Anyway, Malaysia is also famous as the land of frogs..."croak, brrrii-bbitt,croak, brrrii-bbitt".

Finally, Pakatan and DAP LGE did the right thing by declassifying all the documents on Kg Buah Pala. Lets put the shame on Hindraf, the residents of Kg Buah Pala and of course, the traitor ex-govt of Penang, Barisan Neraka 'Nasional'. Now who is telling the truth, who is racist, who is greedy and selfish and who are the liars among Hindraf, BN and the residents. You are 3 deserve to be shamed in public.

After more than 2 weeks of tumultuous and sometimes debilitating struggle against what I deemed to be unmistakeable BN onslaught, this message brings great relief to die-hard DAP member & supporter like me. It's really a redemption of the GOOD & RIGHTEOUS. I salute you, my dear comrade, to remain steadfast in our struggle against the tyranny and oppression. We will face them with unbending and unyielding resolve. Make no mistake, we will overwhelm them with this greatness of virtue till their fire of greed and delusion is doused. It's all about development isn’t it...?

Hiving off cheap state land at RM1 per sq foot....kau tim with the bank at RM50 per sq foot and debting the same citizens from whom they got the land from at RM100 per sq foot....

It’s a well oiled game, designed to make money for the developer, the bank and making the state smell rosy…leaving the loans and traffic jams to the buyers…..Penangites and Klang Valley residents are just too familiar with this game…..

This is exactly how Batu Feringghi was destroyed…if you don’t watch it..one day the entire heritage area, Penang Hill, the Botanical Gardens and the Penang Free School Padang will go….

When is it going to stop…Who is going to stop it…UMNO? Gerakan? PR?

Develop by all means….but don’t cram another million flats and condos in an already tight spot with no roads, public transport and keep crying for a fifth bridge to the mainland….

LGE…needs to think long and hard here….the issues may have seemed simple at first…BUT the real issue is planned development that all of Penang will benefit and doesn’t burden future generations….

It is incidental that the majority in this particular spot happen to be Indians and the issue now has been hopelessly politicized….. but it has been..

The PR should take a long hard look at all the problems that are cropping up at Cheras, the Ampang hillsides, Subang Jaya, Kelana Jaya, One Utama, Klang and now Penang….everyone of them has been the result of trying to make money from land together with lazy bankers who are not interested in building businesses but out to make a quick buck by changing property valuation digits…..

Ultimately…..property development must not add to that false banking bubble we all help create and now suffer from…..

The PR must start looking at other means to make money…..we don’t need another BN economic model based on property….the country is already suffering from a glut of more then 100,000 unsold property…..the type of development being proposed for this particular spot in Penang is worrying…. the PR may have an opportunity to put a stop to this scam….

From the angle of the Hollywood movies, one possibility is that money is at play here. Money is being used to buy, not the land but the people in that land.... on the condition that they do their part of the deal. And what is the deal? The families will be paid quantum in multiples of that RM200K compensation or whatever, provided they work to embarrass LGE's govt, and to destabilize it. They may even be paid a bonus sum each if they can cause the fall of the state govt. Obviously the quantum offered on the table is not something LGE's govt can match, since the Fed. Govt is applying a financial choke hold on the Penang State Govt.

Is it possible? Who knows ..... but I have watched enough Hollywood shows to know that everything and anything is possible.

Hey Hindraf!

Where are u? Now CM LGE has de-classify the files and everyone can looked into the deal and find a proper solution ... the residents refused to see CM. What games you trying to play? All of us know this 'wayang-kulit' together with Hindarf are supporting actors for BN. Now, everything in on the table - we know who the culrpits are. Let's see if 23 families can cause the downfall of Pakatan in Penang - with all the files on the table!

I think Hindarf will go the way of MIC. Podah!

you bring BN back, get ready to lose more land and also your house. they just approved and next thing you know, you have to move out cos there is a court order regardless if you stayed there for 100 years or it was your grandfather land.

with PR, this will not happen. and Kg.Buah pala folks should know, if it was Bn govt, their houses would have been demolish and they won't be having a CM who will be willing to meet them or look into their case. How can he when he approved it. What they will get is a FRU team if it was a BN govt.

Kudos to Guan Eng for declassifying the relevant documents. However, one question remains unanswered.

According to the following report in Malaysiakini http://malaysiakini.com/news/107459 there were two actions in this deal that clearly contravened the law...

1. In 2005, the Kg Buah Pala land was alienated without the Housing Trust that preceded it being dissolved.

2. In 2007, planning approval was given to the developer before the land transfer had been completed.

I sympathise with Guan Eng in that the officers of his Land Office completed the illegal transfer after he had become the Chief Minister.

The question is, why didn't he reverse the illegal transfer that had clearly contravened existing laws? What pressure was he under at the time that he was unable to act?

Unless he discloses the details of this part of the sordid deal, his declassification of the documents is merely more of passing the buck to the previous government.

The folks of Kampung Buah Pala volatile bahaviour is understandable though. Basically they had a rug pulled underneath them - fooled in so simplistic a manner it goes to the very core of what Hindraf cause is all about. But Hindraf action also shows how they often choose unrealistic means with their issue. Hindraf may not be a violent movement but it does not mean they don't resort to chaos and terror.

LGE goofed. He made a huge promise without knowing the facts. Then when he got into office, he did not act quickly enough and they pulled a fast one. Now he is trying to wrap his arm around the problem when the folks are screaming for blood. Is it unfair to him? Yes. But if he wanted fair, he should have gotten into a different business. Its public service - the Rakyat are SUPPOSE to get more than he does.

Having said that, its unproductive to keep clashing on this on both sides. The folks of Kampung Buah Pala deserve to have KTK head hanged in front of their house or anyone at was involved in the first place. The land was promised to them by Mr. Brown. The state screwed them over. THAT need to be put right and the co-conspirators cannot say its not their fault. THEY HAVE TO PAY A HEAVY PRICE not just an adequate price.

You have raised excellent points. Unfortunately, many will choose to ignore them owing to blind, unquestioning loyalty in the erring belief that the LGE administration is infallible.

The fraud may have been perpetuated by the previous KTK administration, but it was the LGE administration that allowed the fraudulent transfer to take place after they had come to power. How could this have occurred?

There’s so much emotion over here about Penangites having to sacrifice their hard earned money to save the residents. How can a land sold at RM3.21 million suddenly “rocket” up to hundreds of millions after the land has been transferred to the developers by the LGE administration? Why doesn’t the LGE administration declassify documents on how this happened?

A report entitled Kg Buah Pala: Villagers to file fresh writ to claim ownership in today's Malaysiakini http://www.malaysiakini.com/news/108200 carries a controversial statement that will surely trigger many virulent statements of condemnation...

Tharmaraj alleged that on March 16, (200smilies/cool.gif the villagers were informed by their then lawyer Cecil Rajendra that Lim (Guan Eng) had been notified about the land transaction.

He said Cecil Rajendra had ask Lim to scrutinise the transaction and that there was a pending court case on the village land.

“Lim now claims that he didn't know anything about the transaction. Lim should stop blaming the previous administration on the issue. He is partly to be blamed for allowing the transaction,” he said.


There is surely more to this than meets the eye.
