(Suara Keadilan) - V. Sivakumar akan terus menjadi Speaker Dewan Undangan Negeri Perak yang sah disisi undang-undang manakala R. Ganesan, calon lantikan Barisan Nasional adalah Speaker haram dan perampas kuasa.

Kekosongan kerusi Speaker hanya akan berlaku dalam tiga keadaan iaitu sekiranya Sivakumar meletak jawatan, beliau didapati tidak lagi layak memegang jawatan itu atau DUN membuat keputusan menggantikan beliau, demikian menurut bekas Hakim Mahkamah Rayuan, NH Chan.

Tiga syarat tersebut secara jelas terkandung dalam Artikel 36A(2) Perlembagaan Perak.

Chan berkata tafsiran Artikel 36A klausa 2(c),(d), 5 dan 6 dalam perlembagaan negeri itu jelas membuktikan bahawa kedudukan Sivakumar tidak boleh dirampas oleh mana-mana pihak.

“Kita membaca laporan media bagaimana Sivakumar dikasari oleh anggota polis untuk mengeluarkan beliau dari Dewan.

“Sivakumar boleh menyaman perampas kerusi Speaker, Ganesan yang mengaku bahawa beliaulah yang memanggil polis ke dalam DUN termasuk sesiapa sahaja yang bersubahat mengeluarkan beliau dari Dewan secara paksa,” kata bekas hakim itu.

Beliau juga menjelaskan menurut Artikel 36A(1) DUN tidak boleh membuat sebarang keputusan dalam ketiadaan Speaker selain bersidang untuk melantik Speaker yang baru.

“Oleh kerana Sivakumar tidak meletak jawatan, kedudukannya terbatal atau jawatannya dikosongkan atas keputusan Dewan maka beliau masih Speaker yang sah.

“Hakim-hakim Mahkamah Persekutuan yang membuat kesilapan penghakiman boleh kata apa sahaja tetapi rakyat sudah tahu dan faham bahawa mereka telah menghina diri mereka sendiri dengan membuat keputusan yang tidak berasaskan undang-undang,” tegas Chan lagi.

The judges who pledge to uphold justic e but acted disgracefully must be damned by Malaysians, NEW MALAYSIANS.

They can rest assured that a royal commission will be formed to investigate them and they can also be sure that they will be charged accordingly. These scumbags judges are a disgrace to their profession, a disgrace to their forefathers and a disgrace to their descendants.

It is of course heartening to read this analysis by Justice Chan.
But the UMNOputras control the police and the bureaucracy, so Siva will still be prevented to carry out his duties as Speaker.
Well, the rakyat will remember this affront to our democractic rights.
Come the next general elections, let's all who cared for a just and fair society show these UMNOputras the boot!

It never crossed my mind that Judges were on the take, not until the Federal Court judgment was read to me, the Plaintiff (surely not Salleh Abas) then only I realised that Judges too are corrupted.

Terima kasih N H Chan J kerana meyakinkan saya bahawa hakim-hakim sekarang (Hakim Umno)langsung tidak boleh dipercayai, nampaknya.

Analisis penghakiman Bekas Tuan Hakim NH Chan yang begitu jelas dan saksama amatlah di hargai kesemua rakyat dan harus digalakkkan. Kejadian di Dewan Undangan Negeri Perak adalah rampasan kuasa serupa yang sering kali berlaku di Benua Afrika. Malulah Malaysia. Bukan sahaja tindakan haram UMNO/BN melanggar Perlembagaan Negeri Perak. Hak rakyat Perak untuk memilih kerajaan negeri pun ditepikan.

All is not lost. BN is not listening to their own peril but the rakyat is listening and the rakyat will remember come GE13. The Honourable Mr NH Chan is brave and loyal to the cause of all Malaysians. No other retired judge has come forward to elucidate the legal intricacies and challenge the judicial hanky panky and foul play. I salute you, Sir!

I know that. You know that. The rakyat know that. And guess what? UMNO/BN knows that too. Too bad knowing is one thing but acknowledging it is quite another.

Truth is the rot has set in too deep now where it permeates not only UMNO/BN but the judiciary, the AG, the Polis, the MACC.And this tumour needs to be excised to bring back the country to good health. The rakyat will ensure this is done come GE 13.

Let us not forget what happened in Perak.

May I appeal to NH Chan, Tun Salleh and other senior retired judges to sit in the Public gallery when the Federal Court is sitting in some of the so called landmark cases coming up . They can then perhaps come up with their own judgement which the rakyat is more likely to respect and accept... whichever way their decision goes

I sincerely hope that more of Justice NH Chan's peers and brother judges come out in support of him. It seems to me that Justice Chan is fighting, albeit a very lonely fight, to salvage the image of the once proud and respected institution that he once was a part of. His explanations make a whole lot of sense and is hard to disagree with.

But, as I say, he needs support from others who has the capacity to speak with the same weight. For the good of the nation, please speak up in unison with Justice NH Chan, so that the Judiciary can be redeemed.

All the various institutions of our nation that exist only because of the trust the people upon them, are no longer honouring that trust. Why do they still exist then?

Where have you been all this while?

The judiciary under the stewardship of the late Tun Mohd Suffian and Tun Salleh Abbas was near impeccable and on par with most developed Commonwealth countries. The rot was started by TDM when he interfered with the independence of the judiciary (remember correctx3 Lingam?), misused the institutions of governance (unleashing his dogs...the AG, PDRM, etc... in the malicious prosecution of Anwar) and dumped the doctrine of separation of powers to rule rough shod over all and sundry. The legacy left by those long, damaging years is all too clear to see today.

Save for some soon retiring senior judges and exceptional ones like Hakim Abdul Aziz,untainted by the all corrupting machinations of UMNO, I really have some serious doubts about the independence of the present judiciary
