Police must stop harassing lawyers PDF Print

THE Malaysian Bar is alarmed and perturbed that the police continue to harass and intimidate lawyers by calling them in for questioning on matters relating to the execution of their professional duties.

Most recently, lawyer Chan Kok Keong was served a Section 111 notice that was silent as to the subject he would be questioned about. At the interview, he was asked regarding an affidavit that had been affirmed by his client, former Perak assembly speaker V Sivakumar, in a suit where Chan is representing the said client. Lawyers representing Chan in this matter were themselves informed that they would be required to give statements if they wished to accompany Chan at the interview.

Such questioning makes a complete mockery of the fundamental principle of solicitor-client confidentiality by which lawyers are bound. It shows a grave lack of respect for the criminal justice system, as the solicitor-client privilege lies at the core of this system.

This harassment must stop if we are indeed committed to the principle of access to justice and to the rule of law. It is internationally recognised that lawyers perform a vital function when they act for their clients in the pursuit of justice, and that they must be permitted to carry out these functions freely.

We urge the police to immediately stop such unwarranted action whereby officers continue to call in lawyers representing clients, to have their statements recorded.

Further, we call on the police to respect the rule of law, which includes the right to legal access and the right, recognised in law, to legal representation without the undue harassment and intimidation of lawyers carrying out their duties as officers of the court.

Rule of Law???, Justice??? Well, well, Ragu, these words do not exist in their mind and soul. They DO KNOW these - "undue harassment and intimidation" to the point of extermination. Remember "Kugan"?.

Surely the BAR can do better than writing letters of protest. Do something MACRO instead.

Why does the BAR council still swallow this crap ?

Why don't they all just stop practicing and shutdown - and declare that the law is dead in Malaysia - that at least will be more representative and factual of the current state of the criminal justice system.

Right now all they achieve is a continuation of a kangaroo criminal justice system.

Bar Council please stop this chicken shit. Please tell the Govt that if they do not provide a firm undertaking that this harassment will stop immediately, all lawyers will refuse to attend court. Get on with it guys, stop pussy footing.

I thought they were supposed to sue for the illegal detainment of the lawyers.

Bar council, sue the polis for harassment and if you don,t who would and you would not have done justice to your members and the people of malaysia. Learn from the Pakistan lawyers. Show us how you do justice in Malysia.

Pussy footing on the issue is going to land this country faster into a Police State. It is already having the markings of becoming such a State. This has to happen so that BN can deprive PR of ever taking over the Government.

Has the Bar Council no more BALLS?? The previous Lady President at least showed that she had it although not of the gender to possess it.

The Police Force makes a fool of itself in everything it does and all that we citizens do is laugh on the matter as vulgar jokes. Either the Bar Council and the Lawyers put a stop to this nonsense by the Police or let the NGOs higlight the issue so that the lawyers can sit in their cloisters and collect fees for cases 'that never will be won in Court'.

The next on the list to be summoned to the Police Station will be the Magistrates; Sessions Court Presidents and Judges to "record" statements on why they are 'hearing' such and such case or something to that effect. After that they may even have the audacity to summon the Rulers and the PM himself. The PM should have the least sense of intelligence to know that HE is permitting the rise of a Devil which will eventually swallow him and HIS sycophants because the PDRM is not going to sit quietly when it finds that its powers are not growing. The top honchos and the Drug and Criminal Cartel which controls them {PDRM} would eventually like to have Malaysia fashioned on the model of Burma.

Already we are hitting the Headlines the world over on human traffic and racial profiling and blowing up women. We may soon overtake Idi Amin and Saddam Hussein for notorius behaviour.

In the greater interests of our children and those to come after them, it is the duty of every citizen and leaders from both sides of the political divide to urgently implement the full Police Disciplinary Commission exactly word for word as in Hong Kong. This country has no other choice.

Hi legalized Maggots!
Majority of lawyers ( except for a few veterans ) often play 'golf' with Trial Judges at the expense of Clients!
Why only put the blame on Mahathir, the Judiciary and the Police from your nonsense since 1987?
When the maggots have eaten up the host, it will be maggots eat maggots.
