Is the Elections Commission (EC) a component party of the Barisan Nasional (BN)? This question is sort of a running joke amongst many political observers as the EC has in many instances – especially of late – made decisions that clearly favoured the ruling coalition.

The latest EC decision that has fuelled criticism of it pandering to the BN was its decision to push the decision on the Penanti by-election to Monday, despite having met to discuss the issue last Wednesday. Whether the Umno Supreme Council meeting, held last Friday, had anything to do with the delay remains unknown, but the timing of the delay certainly raises many eyebrows.

Election Commission Chairman Tan Sri Abdul Aziz Mohd Yusof denies that the Umno supreme council meeting had anything to do with it, saying the delay stemmed from external factors. “It was not relevant at all to the EC’s decision,” he told The Edge Malaysia. “We made the announcement within 10 days according to the powers given to us. I did nothing wrong.”

Technically, he’s right. He did nothing wrong but the timing of the decision, coupled by the EC’s long history of decisions that seem to favour the BN, has led the public to question its impartiality.

The Election Commission, set up in 1975, is responsible for revising and updating the electoral roll, reviewing the boundaries of polling constituencies, holding general and by-elections and conducting voter registration drives.

Famous controversies include the 1999 disenfranchisement of 680,000 new voters from voting in the general election although they had registered many months prior. Political scientist and elections expert, Wong Chin Huat of Monash University Sunway, says that incident really fuelled speculation that the EC acts in the interest of the BN.

The Coalition for Clean and Fair Elections (Bersih), which Wong is part of, has also compiled a list of instances of egregious behavior by the EC.

More recently, the decision to hold all three by-elections in Bukit Selambau, Bukit Gantang and Batang Ai on the same day and on a weekday at that, was heavily criticized for advantaging the government.

“The opposition has fewer resources and thus has more difficulty waging three campaigns simultaneously,” says US-based political analyst Ong Kian Ming. “Having the polls on a weekday would result in a lower voter turnout as those who work out of town might not bother to return home to vote. These people are usually younger and working urban areas – the kind of people who vote opposition.”

Ong, who specializes in elections, also questions why the polls were held after the Umno General Assembly and not before. “The boost that Umno got from it having a new president probably helped win it some extra support from the Malay electorate,” he says.

That the EC is far from impartial is a commonly held view. To alter that perception, Ong suggests some short term things that the EC can do including conducting a massive registration drive for eligible but non-registered voters.

“Analysis has shown that younger voters (who make up the majority of unregistered voters) tend to vote for the opposition,” he says. “If the EC can show that they are not afraid of making a big push to increase registration rates, it would give some confidence to the public that the EC are more independent than it seems.”

Other quick wins Ong cites include holding consultation sessions with both the opposition and the government, before deciding on by-election dates, as well as consulting NGOs such as Malaysians for Free and Fair Elections (MAFREL) and Bersih on suggestions for improving the electoral process. “If the EC were to do such things, straight away people would say they are improving,” he says.

As for long term solutions, both Ong and Monash’s Wong concur there needs to be a structural revamp.

Wong says that because Malaysian civil servants are so clearly biased towards the government, realpolitik dictates that we don’t attempt to go towards a Western democracy approach straight away but rather adopt the Eastern Europe approach whereby the EC members are made up of politicians.

“Membership should be allocated according to (popular) vote share and be reflective of parliament to have some checks-and-balances,” he says. “That way it’s more transparent and more debates compared to the current system which is completely opaque.”

Ong disagrees with adopting the Eastern European approach saying that the problem with having political representatives in there is that it makes everything a political battle. “This is exactly what is happening in Mexico right now,” he says. “It becomes really messy.”

One key step that needs to be taken, Ong says, is for the EC to be taken out of the purview of the Prime Minister’s Office and be made into a standalone institution. Its staff should not be civil servants who are answerable to the government.

Whatever the case, neither the Eastern European model of having the EC made up of political representatives from all parties nor the notion of the EC being completely independent of the government, is likely to be adopted by the BN.

What you’ll have then is an EC that will continue to be seen to be biased even at times when it is not. “This won’t change as long as there is no restructuring done,” Ong says.

Tan Sri Abdul Aziz Mohd Yusof - Used to be Home Affairs Secretary and now EC....not a good mix. Funny why their whereabouts, address and where they live is not in Public Domain. Once I comfirm like the last EC Chairman, we go and give it REPEATED Paint Job. Maybe we need to give the Previous EC CHairman another Paint Job for his house and Luxury Cars. How else can we the Rakyat Terror back these Leeches and Immoral Goons of UMNO?? This link to Hamid and UMNO is no wonder we must continue our Terror Campaign to regim ganas kejam UMNO. Their lives should NEVER be happy and carefree while we rakyat suffer their Injustice!! Carry on the Fight 6 days to IPOH-Perak Charge...wear Black and any colour except Yellow.... We need to postpone / disrupt the meeting until after May 14 and we see what EC does......Election must be called or HIS House is going to get it sooner with more Paint Job. Put Paint inside Ballon and Lontar or Sarang Lebah in plastic bag and Lontar to FRU/Police!!

Are we surprise EC takes it sweet time waiting for their BN to take their sweet time to decide? Will that happen to the opposition? I bet not. They will immediately shut the door or declare them illegality.

Will the EC allow to let the democratic process work if their BN loses the WAR? Now we see the opposition win the state because they haven't any way near take the Nation. Don expect in the next election the EC will favour opposition witout consulting their master. If I am not mistaken, the result in the last election was delay for hours. Were the take their sweet time deliberating wit their master to give or not to give?

Bottom line, EC and BN are buddies. Afterall, they derived from the same source...So don't expect the opposition to win the war...Just the battle will do

Geez, does it surprize anyone if the EC is in the pockets of BN? But who cares how long they posponed it because we will whacked them at poll day. After next GE the new government will be able to reform the EC into a fair organization. And these unprincipled toadies will be scanning the Straits Times situations vacant column to look for new jobs.

The new EC chairman has shown himself to be a more sycophant than the previous chairman. From day 1, he made every effort at every opportunity to prove to his Umno masters that he can be depended on. His decision has been so one sided and so obviously in favor of the BN. Want to bet that his reign will be a long one as long as the BN remain the government?

Election Commission Chairman Tan Sri Abdul Aziz Mohd Yusof just follow the footstep from his former chairman.

This EC is fcuking rakyat in every election. Attempt to make BN more easily to win. If BN don't get the help from this EC, BN had definitelty lose the federal government.

Splitting contituency to into at least three or five to BN stronghold, and it will lead to BN have more seat. Deciding election or domination date by considering to BN situation first is the stupid EC. The first player to defend the Perak constitutional crisis is EC by rejecting the speaker decision and make unnecessary judgement on the three froggy is EC.

We can award this EC with the prize of "The Best Fcuking and Sucking Dog Of The Year"

I cannot see any hope for Najib short of stepping down if he is unprepared to take drastic measures to restore his tattered image at home and abroad. And drastic measures does not mean in the mould of Ops Lallang. Any dictator can easily muster sheer brute force to subjugate a people thirsting for reforms, but such suppression will only be temporary and cannot be sustained. Najib should think out of the box. Methods of old like the ISA will only attract more opposition. How much more tyrannical does he intend to be to perpetuate his rule? It will better if he embarks on an aggressive policy of inclusion to win over Malaysians. The EC must be immediately freed from it shackles and be told in no uncertain fashion it must be neutral and function as a conduit for the rakyat to express its preferences at the ballot. Dictators suppress the people; leaders are positively inclusive while allowing his people the freedom of expression.
Again, it is Najib’s call.

Our top priority is to press for EC reform - long before the next GE13 takes place.

If we wait till 2011 to do so, it may be too late. We have to start now. First, that obedient dog at EC must go! EC must not be answerable to the PM. This is so basic, I dunno why we allow the EC to be reporting to & taking instructions from umno.

Until this is done, I foresee bodohland being fcuked another 50 years under bn govt. right after GE13. Maybe that is what this 49-50% bn voters want - to be fcuked, sodomised, raped repeatedly and coming back for more.

Just a simple answer if the dog does not have the owner then what do you think of it.
I am the master so listen to what I said or you won't get the bone of the day.This dog is lucky and can survive for 50years but my dog live is only 13 years,just passed away do I don't know when the time will come for this one.Hope today or tomorrow.

The EC's actions are not only biased but downright shameful. They favour BN in everything from choosing polling dates, allowing phantom votes, even to mishandling ballot boxes in Batang Ai by-election. Totally unethical, unfit and downright shameful. Just like most govt. depts no right minded citizens TRUST them at all. Their behaviour makes a mockery of democracy. YUKS!!!
