Fairus can still withdraw Penanti resignation: Karpal PDF Print

(NST) - Former Penang deputy chief minister I Mohammad Fairus Khairuddin is free to withdraw his resignation as Penanti assemblyman, lawyer and DAP chairman Karpal Singh said.

He said Fairus was legally entitled to withdraw his resignation letter anytime as the Election Commission has not accepted his quit notice and announced the by-election date.

"This is my opinion..the whole process has not been completed and I am of the opinion that he (Fairus) is entitled to withdraw his resignation letter if he wants to.

"The ball is now in his court...it is up to him to decide if he wants to retract his decision," he said hwne contacted yesterday.

Karpal said should Fairus decide to retract his resignation letter, he must do it before the Election Commission announces a date for the Penanti by-election.

"Otherwise, it will be game over for him," he said, adding Fairus should also talk it out with Parti Keadilan Rakyat (PKR) before making any decision.

Fairus was reported to have second thoughts in resigning as Penanti assemblyman and had indicated that he will rescind his resignation letter. However, Fairus came out strongly today, maintaining that his resignation letter was intact and he had no intention of withdrawing it.

The 34-year-old, who was under investigation by the Malaysian Anti-Corruption Commission (MACC) for alleged corruption involving quarry operations, has since been cleared by the commission.

There has been widespread speculation that whoever is chosen to represent PKR in the by-election will also succeed Fairus as the former deputy chief minister I.

Meanwhile, Parti Keadilan Rakyat has identified three potential candidates to contest in the Penanti by-election.

Penang PKR chairman Datuk Zahrain Mohamed Hashim said the candidates names had been submitted to party de facto leader Datuk Seri Anwar Ibrahim for consideration.

He said all three were local party members. However, he remained tight-lipped about the identity of the potential candidates.

Zahrain nevertheless claimed his name was not in the list.

"I don't want to stretch myself too much since I am already an MP (for Bayan Baru). I would rather focus my attention on my constituents and the party," he said.

State PKR deputy chairman Dr Mansor Othman is tipped to be one of the three potential candidates.

Whoever chosen as the candidate will just walk through the by-election hands-down.

UMNO can bring TDM, KJ, Esam, Muhyddin, Reezal, Hisahm.......to campaign but the result is a foregone conclusion.

What Mr.Karpal said is only true from legal angle and Wak respect that, but looking at bigger picture it is better for fairus to stick to his resignation. If Fairus withdraw his resignation, he will be look-at with suspicion, caurse new problem for PKR and all host of uneasyness in pakatan gov.

I doubt whether the report is accurate. Anyway, Fairus offered resignation and the speaker accepted. It has been concluded. Yes, Fairus can retract but it is up to the speaker to accept or not. Probably, this part was not mentioned. Anyway, in Malaysia the court can interpret them differently.

I agree with what Karpal said. He should withdraw his resignation as ADUN; however I still dun think he is fit to be DCM as he is young and very inmature. It is a mistake for DSAI & PKR to have an inexperience ADUN for the DCM position. He just can't take the pressure. I would propose a PKR lady to be DCM.

Why can't Fairus withdraw his resignation?

The 3 frogs did it and the EC accepted it. There is even a federal Court precedence on the 3 frogs. Or is it only applicable to BN candidates?

It might be alright for Fairus to retract his resignation as ADUN for Penanti but he should be wise enough not to hold on to the DCM1 post.

It had been proven that he was unable to cope with the tough requirements of holding on to both portfolios and both he and the party realise this.
So, it's advisable that he gains enough exposure and political maturty before taking on such duties and at the same time not jeapordise his political future.

OTH, there is still this issue of selecting the right candidate for the DCM1 post which seemed to be unavailable in the current line-up.
That is the predicament faced by the Pakatan administration currently.

If Fairus was to withdraw his resignation, it would be advisable for the PR to look elsewhere, without prejudice or just leave the post vacant until the next election.

As a true Rakyat, I would wish that the coalition put all these behind and continue to focus on the rebuilding of the state and country.
