Death for Azilah/Sirul - intensify demand for RCI into allegations of Najib’s involvement PDF Print

By Lim Kit Siang

The end of the murder trial of the century in the Shah Alam High Court this morning, with policemen Chief Inspector Azilah Hadri and Corporal Sirul Azhar Umar found guilty and sentenced to death for murdering Mongolian woman Altantuya Shaariibuu, and then blowing up her body in a jungle clearing on Oct 19, 2006, is not going to end public fixation with any Altantuya-Najib nexus in national and international circles.

The question that is inevitably asked is who could be behind the two Bukit Aman Special Action Squad (UTK) cops’ C4 murder of Altantuya.

Those who had thought that the end of the Altantuya murder trial, with the conviction and death sentence pronounced on Azila and Sirul, would end national and international fixation with any connection of Prime Minister Datuk Seri Najib Razak with the Altantuya murder case cannot be more wrong.

While Azilah and Sirul would appeal against the mandatory death sentence upon conviction under Section 149 of the Penal Code, their conviction and death sentence have not lessened but intensified public demands and necessity for a Royal Commission of Inquiry into swirling allegations of Najib’s involvement in the Altantuya’s C4 murder case.

At 3 pm today, Najib is announcing his new Cabinet – but this important event in his six-day premiership, which is already marred by the two Umno/Barisan Nasional defeats in the Bukit Gantang and Bukit Selambau by-elections, is totally overshadowed by the Altantuya murder case conviction and death sentences.

As Najib has repeatedly declared his innocence of any involvement in the Altantuya C4 murder case, he must act decisively to set up a Royal Commission of Inquiry to lay all the swirling allegations about his involvement in the murder case which are haunting and hounding him, his administration and the nation’s good name, to rest once and for all – whether about the accessibility of C4 explosives, the disappearance of Altantuya immigration records, the exchange of SMS messages or the disappearance of private investigator Bala Subramaniam after making public a very damaging statutory declaration about Najib.

A royal commission must be set up to investigate this matter and no stones are to be left unturn.This serious allegations have affected the image of our country and our PM.If Najib wants to be clear of all these allegation,he must support this investigation or otherwise he will have to face these allegations daily and this will affect the running of the country.
Clear your name Najib and take all those who say you are link to Altantuya.Malaysians of all races would like a PM ,who not only seems to be clean but must smell clean ,not spay with Coco Chanel parfume.

NR has to come clean -impeccably clean beyond any iota of doubt, and the only way is to subject himself in the court of law and bear testimony to the allegations.

There is no other way - swearing in the mosque won't do, public press coverage testimony won't do.

For if he offer himself to public scrutiny - this alleged murder controversy will haunt himself for the rest of life and subject himself to national and international contempt.

His high office as PM will not stand the test of time. Period.

It just doesn't make sense! Why would these two Special Forces guys, blow up a mongolian beauty if they are not instructed to do so by someone with authority? There are many presumptions we can make here. Now that Najib is in power, he will extend every effort to clear his name. Even Althantuya's entry record can be deleted in immigration, what is stopping them from giving these two scape goat a new identity and putting them somewhere else with some $$$?..

If these guys have the ballz, they should admit everything as to who instructed them and who is behind this. Probably their families are threatened like the Zionist would (Wipe the wholle family) and this burdened them to admit the truth. This whole trial is just like stage play and we can see the puppet master's strings.

Meanwhile, many Malaysians found the trial ‘unbelievable’
because the prosecution refused to call certain persons to court, even though their names were mentioned by several witnesses.
because someone had said “only three persons” even before the trial began.

Many Malaysians found the verdict(s) ‘unbelievable’
that the third accused has been acquited of abetting the murder.
that 'The prosecution has proven beyond reasonable doubt the actions of the duo call for their conviction on the murder carried out with the common intention.'

By the way, what was the common intention?

Azilah and Sirul have been sentenced to the gallows. I sympathise woth their families. Eventhough they murdered and blown Altantuya up they are subordinates taling instructions. They dont even know Altantuya from the begining and have nothing to get involved with the Mongolian girl. The real murderers will hve to be hanged because thier INTENTION to kill is more criminal than the doer. There are more unanswered questions and the withnesses have not been called to the stand. I hope the case can be heard from the ICJ in Hague. A royal commission has to be set up and the death execution has to be delayed untill the Commision finish the investigation. The main culprit has to be charged as simple as that. Malaysians and the world is watching this case. The PM must say something positive now and not just swear his innocence. The Almighty cannot speak so this is not good enough.

Dear Indian boys,

Please don't commit any crimes till after the hanging. Don't even THINK of committing a crime. Najib has told his number 1 thug Musa to look for 2 Indian boys to hang in place of Azilah and Sirul. These 2 murderers will then get RM50 million each and join Razak Baginda to do their PhD at Oxford. UMNO has donated millions to Oxford to take in rejects like Khairy and Razak Baginda for any course they want.

So my fellow Indian friends, keep clean for a short while. Then go attack Samy Vellu.

Both Azilah and Sirul are sentenced to the gallow...fine. But the question that needs answer is, who's the actual perpetrator who instigated and/or ordered or contracted these guys to kill Altantuya ? I personally don't think that they did it due to their own motives or they had revenge on her ! Razak Baginda the proxy in the plot is cleared. So, who is the Don responsible to the order to kill ? It remains a mystery because only in Malaysia, the real culprit who has the power and influence, is always escaped untouched !

When you put sycophants in the commission, nothing will come out of it except lame excuses to make the government look good. The latest is the Lugan case.

The best thing to do under present circumstance is wait for a new government, overhaul the police and judiciary, then look into all these cases and bring to justice all the guilty ones. The present BN government have no credibility at all. No decent being would have any faith in them.

There is really no mystery to this case. All you have to do is look at the real facts and avoid the distracting sub-plots.

1. She was killed and blown up by Special Forces Police, who are only assigned to high-level government officials.
2. Her immigration records were deleted from the Immigration database. Any IT idiot will tell you you need a super-high-level admin password to do such stuff.

So it is clear as daylight that her killing involved the highest levels of the Police and Immigration departments, and that whoever ordered the killing would have had the highest-level Police agreeing that this needed to be done. This, therefore, was not a straightforward murder: This was an "official" Sanctioned Elimination. The "highest authorities" agreed that she was a threat, so they agreed she would be eliminated. Not just killed, but eliminated (body blown up, immigration records erased, it was intended that she just vanish without a trace).

It was thus not done on 1 person's order: it could have started with a request from 1 person, but in the end it was a "team" effort, with layers of chain-of-command to insulate those at the very top. That's why Badawi,the judiciary, the AG, Razak Baginda, even the defence lawyers EVERYONE who walks the Corridors Of Power will never let the real truth be told. Everyone is a part of a layer in the many layers of Power, and each layer protects those close to it, knowing that one day the favour will be returned when needed. Najib will of course resist any really independant inquiry. He is closest to the centre of the people who decided she needed to be eliminated (he could have been against it even, but could have been told it was in his/national interests). Whatever it is, he knows who/how/why she was killed. Badawi knows too, for sure, but he chooses to play stupid: why lose a life of luxury over someone else's sex toy?

And here's where the real horror emerges: with such a wide-ranging cover-up by so many institutions and people, it is obvious that this was not the first such Elimination, and neither will this be the last.

3. they succeed to overturn the conviction in their appeal
4. the hangman noose broke and they have to be hanged for the 2nd time (Iraq?)
5. some powerful hidden hands at work in Putrajaya to forestall the hanging

What of the MOTIVE for killing the victim by these 2 police personnels,one of whom is a Chief Inspector and the other a Corporal? Do people enjoy immunity from the court?

No. Everyone can be prosecuted: head of states, members of government or parliament or elected representatives or public officials.
Superiors or military commanders may be held responsible for criminal offences committed by persons under their command or control.
The ICC cannot prosecute persons who were under the age of 18 at the time a crime was allegedly committed.

When will the ICC investigate and prosecute crimes?

The ICC is a court of last resort.
It will only prosecute war crimes suspects when states are not able or are not willing to prosecute the most serious international crimes,
Bona fide efforts to discover the truth and to hold accountable those responsible for any acts of genocide, crimes against humanity, or war crimes will bar the ICC from proceeding.

Who can bring cases to the ICC?

The Prosecutor can start an investigation or prosecution in three different ways:
states Parties to the ICC can refer situations to the Prosecutor;
the United Nations Security Council can request the Prosecutor to launch an investigation;

the Prosecutor may start investigations when he receives reliable complaints by anyone. However, in this case, the Prosecutor must seek authorisation from three independent judges.

definition of Crime against humanity, just some search on wiki, thought of sharing the information with my fellow MTians

International Criminal Court

In 2002, the International Criminal Court (ICC) was established in The Hague (Netherlands) and the Rome Statute provides for the ICC to have jurisdiction over genocide, crimes against humanity and war crimes.

The definition of what is a "crime against humanity" for ICC proceedings has significantly broadened from its original legal definition or that used by the UN,[13] and Article 7 of the treaty stated that:

For the purpose of this Statute, "crime against humanity" means any of the following acts when committed as part of a widespread or systematic attack directed against any civilian population, with knowledge of the attack[14]:

(a) Murder;
(b) Extermination;
(c) Enslavement;
(d) Deportation or forcible transfer of population;
(e) Imprisonment or other severe deprivation of physical liberty in violation of fundamental rules of international law;
(f) Torture;
(g) Rape, sexual slavery, enforced prostitution, forced pregnancy, enforced sterilization, or any other form of sexual violence of comparable gravity;
(h) Persecution against any identifiable group or collectivity on political, racial, national, ethnic, cultural, religious, gender as defined in paragraph 3, or other grounds that are universally recognized as impermissible under international law, in connection with any act referred to in this paragraph or any crime within the jurisdiction of the Court;
(i) Enforced disappearance of persons;
(j) The crime of apartheid;
(k) Other inhumane acts of a similar character intentionally causing great suffering, or serious injury to body or to mental or physical health.

interesting part (i) enforced disappearance of persons.. smilies/grin.gif

It matters not anymore on who instruct whom or whoever is behind the murder or even who declaring himself innocence of any involvement. What matters most is, two more live will be lost for some greed, lust and corruptions.

The underlying question will be – what started the whole episode? It will be the procurement for the two submarines which itself had claimed one life and a further two more, even before being commissioned to enter service. The greed over the RM440 million in commission for the procurement, the steps taken to cover up ‘lustful’ adventures of the high flyers involved and the most despicable disease of corruption of the peoples in the high office are the causes of this sorry episode.

I for one or anybody else with a sane mind for that matter find it hard to comprehend that these two scapegoats, CI Azilah and Corp. Sirul would embarked on a murderous spree if it is not for some orders from the people of the high office and/or perhaps for some irresistible RM reward for accomplishing the task given.

The murder and further death does not just come out of the blue, it is the resulting act of CORRUPTION. The toll and price to pay for this despicable disease are now much higher than it was before, where it use to be some jail sentence or some punishment by fines but this disease are now claiming lives! This disease has got to be stopped and in order to stop it we will have to find the virus and the carrier of the disease – but we let ourselves to be lead by the virus that carries the disease and can we blame ourselves if one day we are going to see more death due to our failure to stop the virus, the CORRUPTOR? Yes, the blame are going to be on us, we have to be responsible for we have failed in our duty to stop the disease, we have failed by letting corruptors holding high office, we have failed through our lackadaisical attitude and the fear of change. We also have failed in educating our society, our children, our family with the awareness on the danger of corruption. We have to stop and ask ourselves, ‘are these three lives worth RM440.00 million?’, and what if one of these three lives is our friend and family. What about the additional live and hearts that have been and will be broken by this despicable disease of corruption.

Some people are not even worthy of their own life and the air that they breath and the heartbeat that are being given by Almighty and Gracious God, but we let these people roam free to inflict further damages and destruction to more lives and society.

The corruptors have to be stopped – and we have to change.

Malaysian Bar council has been pushing the government to sign on it

http://www.malaysianbar.org.my..._govt.html

our government have been so vocal about the Israel atrocities, but will not sign on the Rome Statute, apa pulak ???

should we all pressure the gov to sign on it ? you think our PM dare or not ??

THEY WILL BE SET FREE.

Do you know how easy it is for Najib to do this: Have the capital punishment center announces Sirul's and Azilah's 'death', secretly let them free, give them new identities, provide them with some money so they can live in other country.

If Altantuya's immigration record can be erased, C4 can be taken from Defense Ministry, Razak Baginda can be released, how hard it is to release those two lads?

RCI must be made up of distinguished international figures. It is best the members of RCI be nominated by DAP, PAS, PKR or Aliran.
If givernment nominatyed its cronies, the verdict: You know la!!!!

Strange thought that they are so calm on pronouncemnt of the death verdict. Is there an "escape" plan ?. A new life with new looks and new identity ?. Their place taken by some other "unknown" persons who are given the death sentance ?.

why wouldn't they spill the beans on who gave the order to do the killing ?. Blind loyalty or is there something else ?. Rewards maybe ?. Hmmmmm, I think we will never know.

At the rate things are going on now, even if RCI is convened, there are doubts if it would be impartial.

What if the RCI finds that najib is not implicated ? What do we do next ?

The nation should get together for many rounds of demostrations like Bersih, Hindraf, Reformasi but for one single issue..... TO SEEK FOR A ROYAL INQUIRY ON THE ALTANTUYA MURDER AFFAIR before the execution date. We know there will be a date but the UTK murderers will substituted.

By Lim Kit Siang...The end of the murder trial of the century in the Shah Alam High Court this morning, with policemen Chief Inspector Azilah Hadri and Corporal Sirul Azhar Umar found guilty and sentenced to death for murdering Mongolian woman Altantuya Shaariibuu

>>>Does Chief Inspector Azilah Hadri and Corporal Sirul Azhar Umar really exist? No one has seen their faces. For all intent and purposes the convicted may well have been 'BATMAN and ROBIN'.
Part of the criminal justice system is predicated on shaming the guilty. It is baffling how these "dynamic duo" can escape recognition. How do we know they will indeed be punished according to the sentence of the court when nobody has ever seen their faces for the whole duration of the trial? Does policemen Chief Inspector Azilah Hadri and Corporal Sirul Azhar Umar even exist?
Or was Batman and Robin convicted?
