Better to resolve Perak crisis through talks, says law expert PDF Print

(Bernama) SHAH ALAM - Universiti Teknologi Mara law lecturer Dr Shad Saleem Faruqi has suggested that Barisan Nasional (BN) leaders and those of the former Opposition government in Perak hold talks to quickly resolve the political crisis in the state.

He said trying the settle disputes arising as a result of the crisis through the courts would involve a long and drawn out process as there would be appeals and counter appeals.

He said this on the "Hujah" talk show which was broadcast by the TV9 televsion channel from here last night.

Joining him on the programme, which was chaired by Universiti Kebangsaan Malaysia's History, Politics and Strategic Studies Centre senior lecturer Dr Mohammad Agus Yusoff, were prominent lawyer Datuk Mohd Shafee Abdullah and Bar Council president, Ragunath Kesavan.

One way of resolving the crisis, Dr Shad said, was for the two conflicting parties to take turns to rule the state.

Mohd Shafee was of the opinion that the courts should expedite hearings involving the crisis while Ragunath felt that it was better for a fresh election to be called in Perak.

The crisis erupted early February when the Pas-DAP-PKR pact lost their majority in the state assembly to the Barisan Nasional. The pact's attempt to have the assembly dissolved for a fresh election to be called also failed.

Following this, the pact's menteri besar Datuk  Seri Mohamad Nizar Jamaluddin resorted to the courts to declare he was the rightful menteri besar of Perak and not the BN's Datuk Zambri Abdul Kadir, who was appointed by the Sultan of Perak to replace him.

............................................................................

Common sense tells you that Ragunath was right.

Just wondering what was the outcome of the delegates who went to seek the advise of the QC in London. It is interesting to know from the education point of view.

Taking turns to rule Perak is one way to say that Nizar is still the rightful MB but please give Zamri a chance. A compromise or negotiations would be okay if Zamri is also legally the MB, but how is that possible? Is someone trying to save someone's face here? Where the courts fail or fumble it shall be the people's justice.

Expat,
the delegates to London have not returned yet.
They are now visiting the vegetables farms in Yorkshire to learn a bit more about growing asparagus.

Bodoh lawyer buruk, shame on you all. When in time memorial had BN/UMNO ever agreed with oposition except to put them under ISA, charge them on sodomy or sedition act.
The best solution is let the Perakian desire on their own, a re-election.

What sort of fusking idiot would make a comment like that

The sultan should decree that the status quo which existed before the "so-called-coup" should remain in force until new elections can be organised

How much common sense does it take to work that out?????

Relax guys, don't get emotional. He was in no way being a BN supporter. He was giving an example of a unity government so the MB seat will be rotated like Sabah. He gave very clear answers to the legal situation in Perak. Very fair. Even certain things that Nizar and the Speaker did that was not in accordance with the law. Not to mention the way BN could have done things in a different way if the wanted to prove Nizar lost command of the majority. I saw the show. He was fair. You want to know who wasn't? Dato Shafee, the lawyer embroiled in the Altantuya/Najib case. I thoought he was emotional in trying to say BN was right.
