Institusi Raja jangan hanya bersifat simbolik - Prof Aziz Bari PDF Print

Profesor Dr Abdul Aziz Bari berkata, institusi Raja jangan hanya bersifat simbolik yang hanya membuka sidang Dewan Undangan Negeri (DUN) dan Parlimen semata-mata.

Beliau berkata demikian selepas ditanya mengenai bidang kuasa raja berperlembagaan di Malaysia dalam satu Forum mengenai 'Raja Berperlembagaan dan kemelut' dekat sini, baru-baru ini.

Forum anjuran Ikatan Ilmuan Nasional (Ilmuan) itu disertai oleh dua orang panelis; Peguam Haji Sulaiman Abdullah dan Profesor Dr. Abdul Aziz Bari yang dipengerusikan oleh Prof. Madya Zainal Kidam dari UNISEL.

"Mengenai bidang kuasa raja, payah nak buat senarai. Cuma kita kita boleh buat kajian mengenai apa itu Raja berperlembagaan dalam konteks negara kita.

"Bidang kuasa raja adalah yang pertama bersifat simbolik. Ia membawa maksud kerja raja hanya buka persidangan parlimen," katanya.

Menurut beliau, gambar raja terpapar di merata-rata tempat supaya tindak tanduk kerajaan tidak bersifat partisme, yang menyampaikan pingat itu bukan orang politik tetapi raja.

"Tetapi yang menjadi masalahnya ialah bagaimana hendak membataskan kuasa raja. Kebanyakan kuasa raja adalah bersifat ceremonial atau upacara.

"Salah satunya ialah kuasa raja ialah ketua dalam bidang agama yang dibolehkan menjalankan kuasa agama tanpa nasihat kerajaan memerintah. Ini sudah termaktub dalam pelembagaan persekutuan dan negeri.

"Namun yang menjadi persoalan ialah adakah betul raja sebagai ketua agama menlaksanakan kuasa ini tanpa mendapat nasihat dari kerajaan.

"Ini bukan isu yang kecil, kerana Islam pada hari ini berkaitan dengan pengurusan masjid, pentadbiran wakaf, mahkamah syariah dan banyak perkara lagi yang berkaitan dengan islam," katanya.

Serta katanya lagi, Islam juga telah menjadi satu elemen penting dalam mewarnai seluruh kehidupan sebagai seorang muslim pada hari ini.

"Oleh itu, adakah mampu raja melaksanakan semua ini dan mungkin kebanyakan raja di Malaysia tidak mempunyai kelulusan dalam bidang agama. Ini masalahnya.

"Begitu juga, tugas raja sebagai ketua tertinggi panglima angkatan tentera Malaysia. Adakah semua raja mengalami latihan biasa untuk menjadi seorang tentera seperti institusi beraja di England. Tidak semestinya," tegas beliau.

Who says they are symbolic? They are 'political' for UMNO.

The problem with symbols is that some people take them seriously and make them bigger than what they really are. We could easily change symbols and move. Take the flag. Someone burns our flag. Do we have to declare war and sacrifice the lives of many to redeem the flag. Hey, just go and print a new flag.

Symbols are important. But just dont make them bigger that what they are.

As for the King, they are just symbols of the people. I can live with a different symbol such as a Malaysian President who represent the people of malaysia.

The role of the royalty as a defender of islam is really untenable. Islam abhors and despises class distinction and believes that all are equal in the eyes of God. As a royalty they have already violated the basic tenet of islam. How then could they be its defender ?

As a defender of the malay rights as enshrined in the constitution I don't see that they are necessary. The constitution states that the royalty can ask the government of the day, and the government must follow, to set aside reasonable quota in institution of higher learning, civil service and business licenses for the malays. What do we have today ? Quota in institutions of higher learning today has reached ridiculous proportion and licenses, particularly monopolistic licenses, had been given exclusively to the malays. Many malays who could not carry out the business under the license rent it out to others. Institution of higher learning are filled with malays who really have no inclination nor the capacity to study the field they were alloted. Asasi science and other matriculation programs were backdoor entry for many of them. They are many malays who are very capable but just to fill the unreasonable quota many were forced into fields that they had no aptitude in. I know because I had first hand knowledge. Many hated their field and much prefered to do other things. Special tutorial where the actual questions coming out in the exams were given to the malays so that they could pass the exam. What does all these do to a generation of malays ?

In the civil service we can't talk of quota for the malays as they are the overwhelming majority.

More than anything the non-malays in the country needed the royalty to set a reasonable quota for them and to control the unbridled zeal of the government of the day in robbing the nation blind by awarding licenses to their cronies.

The rights of the malays do not need defending as it is already enshrined in the constitution. But 30% quota in new business investment and listing in the stock exchange actually violates the constitution which Clause 9 of article 153 states

'Nothing in this Article shall empower Parliament to restrict business or trade solely for the purpose of reservations for Malays.'

The Sultans are in a position to regain the powers UMNO stripped away in 1993. UMNO have put themselves in a mighty fix. The have been saying they are the defenders and Pakatan are the penderhaka lot. Well in a few days time when the Sultan reconvene their meeting, we will see if they want to reverse 1993. What will UMNO say Boleh? Tidak boleh?

If today a malay riding on his bumiputers status can enjoy a 20% discount on a bungalow costing RM1.5million (The Star 7.3.09), shoulndt he be charged the extra 20% and that amount be used to either buy of a house or pay as a downpayment for another poor bumiputera? Rediculous. I mean this bumiputera can buy a bungalow costing millions and yet enjoy the 20% discount and this right is enshrined in the constitution?....yeah! yeah! yeah!.....

well the other argument will be, can i opt to pay zakat to help the poor muslim even though i am not a muslim ? if i do so, am i eligible for the 20% discount ? since i am myself consider a bumiputera being born in malaysia..i am willing to help the poor, but can i be acknowledge as a born malaysian ?? regardless of my blood ?? (no offence intended to muslim, but just food for thoughts)
