Perak muddles further with Ridwan's eligibility to judge PDF Print

(The Malaysian Insider) With his term as judicial commissioner ending February 28, the Perak constitutional crisis has taken another twist with the question whether Ridwan Ibrahim was eligible to hear or grant a restraining order against state speaker V Sivakumar yesterday.

The Ipoh-based judicial commissioner was first appointed on March 1, 2007 to a two year term which ended last Saturday. It is not known if his term of office has been extended as the newly-minted Judicial Appointments Commission (JAC) has yet to meet.

Unlike judges who have full tenure, judicial commissioners get two-year contracts  under Article 122AB of the Federal Constitution and can sit to hear cases in the High Court.

A legal source said the judicial commissioners used to get extensions but now have to apply to the JAC for consideration as high court judges.

"I am not sure about Ridwan's status but the JAC can easily extend his appointment retrospectively like in the past," the source told The Malaysian Insider.

Ridwan's status, unless confirmed, could be another contentious point in the protracted Perak political impasse turned constitutional crisis as Pakatan Rakyat's Datuk Seri Nizar Jamaluddin claims he is still Menteri Besar although the Perak palace has appointed Datuk Dr Zambry Abdul Kadir last Feb 5 when three government lawmakers turned independent.

Both Pakatan Rakyat and Barisan Nasional have 28 members each in the 59-seat state assembly, making the three independents a decisive force. Lawsuits from both sides have muddied the issue which is now tied up in legal process. Earlier, judicial commissioner Mohamad Ariff Yusof had recused himself in Kuala Lumpur to hear Nizar's suit challenging the validity of Zambry's appointment.

The legal source said the matter could be clarified when the JAC finally meets. "We don't even know where and when they are going to meet, their staffing and other issues. They could meet under a tree," he quipped, referring to the Perak assembly meeting under a rain tree in Ipoh.

Ridwan, who disqualified Sivakumar's private lawyers yesterday in favour of state lawyer Zulkairnan Hassan, issued a restraining order against the Perak speaker from convening meetings “purporting to be meetings of the Perak legislative assembly”, after accepting arguments that the immunity from judicial review stated in the federal constitution was only for proceedings in the state assembly.

The order for an indefinite period of time was granted at 5pm under Section 44 of the Specific Relief Act which grants the court the power to make orders to a public official.

The order came hours after Sivakumar convened a meeting under a raintree 200 metres from the state legislative assembly building that was locked by order of State Secretary Abdullah Antong Sabri and cordoned off by a phalanx of riot police armed with shields and water cannons.

A hearing date will be set by the court on March 5, which is also the day that the three independents who left Pakatan Rakyat and now support Barisan Nasional, will go to court to quash the speaker’s decision to consider their state assembly seats vacant.

Sometimes when spectators are watching a football game, some will shout "referee kayu" if they think the referee makes bad decisions.

In this case, the judge made a wrong decision when he disqualified everyone on one team (all of the Speaker's lawyers), leaving a one-sided game with only one team playing. How can that be fair? Who will respect the result? Now we find out he himself could be disqualified.

We should note the “restraining court order” is possibly null and void. Notice the legal experts say that a court order has “no retrospective effect”. In other words, the Ipoh High Court order (made yesterday afternoon and served this morning) only affects the future (today onward), but not the past (what happened yesterday morning). If the judge is disqualified, then this court order is not valid.

Hahaha...BN is trying to undo their mistakes by removing the stupid judge who has actually legitimized the Perak state assembly meeting when he issued a restraining order against Siva...In other words , Ridwan recognizes the legitimacy of the assembly......that is why the BN Dogs are scrambling around for damage control....what a joke...I would't be surprise if BN cut down the rain tree and argue that without the tree, the assembly wasn't legal......

Mamaak's Court is worst than the Kangaroo Court. Can The Rakyat believe Mamaak's Court of Law? I feel sad for the judges who are sincere and mete out their judgment fairly and accordingly.

Even the good judges are tainted because of Mamaak's Court and as perceived to be every court in the country as long as it concerns BN's agenda.

Dahlah tak bertindak secara arif, dirinya pula nampak sangat bongok. Kamu tu Ridwan sudah monopos dari kuasa sebagai JC !. Apalah kena pada jantan seekor ni ?

Dua dari tiga hakim masuk neraka. Kalau hakim takut dengan manusia tapi tak takut dengan Allah, jadi macam Cek Wan kita dari Ipoh ni. Sejak bila kehakiman boleh campur urusan legislatif? Oh mungkin dia kata sidang DUN tak sah. Tapi mereka tak ada speaker selain dari speaker yang ada. Beli lah speaker lain dulu.

Quick Mr Sivakumar, demand the letter of extension for his as a judge if any from this stupid judge. If he does not posseess he should be also charged for contempt of the assembly. And further more sue this dick for misleading you and the rakyat. In future you and all the representative do the same, demand to see their letter of appointment and the letter of extension if any!

If the JAC is prepared to extend this idioitic and corrupted JC's term, it goes to show that the JAC is nothing but another UMNO serving apparatus. The rakyat is sick of all these umno goons making stupid decisions against the law, and to top it all, these are the ones who swore to uphold the law.

The Perak situation is now a circus. The haste of BN to obtain an injunction and the actions of the Police to block MPs to do their rightful duties are creating major problems and tearing the constitution apart.

Every move by BN has been too hasty and not well thought through. It would have seen that BN is truly naive when it comes to constitutional matters.

Kontrak dah tamat buat apa itu hakim duduk sebagai pesuruhjaya kehakiman. Bukankah dia sendiri label dia sebagai pesurujaya kehakiman yang bodoh. Tak tahu peraturan nak duduk sebagai pesurujaya. Mana ada kuasa?

Ridwan's term of office has been extended for another 1 year.
This is what you will see in the papers in due course.
How did he extend his term?
Well, well, well. You know you are in Malaysia Bolehland?
Anthing can be done.
All paper work will be backdated. All restrictions on his appointment has been removed. All are well done retrospectively.

Don't worry. They will give him an extension retrospectively to make the ruling legal. Just like they issue permits retrospectively whenever BN needs to demonstrate or go on a street march. To show how loyal they are to the BN Govt., they will even provide police escorts. The excuse is that they are there to prevent anything untoward happening. Just like they detained the Sin Chew reporter under ISA to "protect" her.
