The Perak crisis is far from over although – against all odds and without precedent – the ousted Pakatan Rakyat state government held an “under the tree” emergency assembly Tuesday and approved motions to dissolve the legislature.

It is a moral victory and a signal of their determination not to accept defeat or let the Barisan Nasional (BN) rule in peace in a state PR had ruled for 10 months from March 2008.

“We are not going to let it go … we are going to keep up the pressure. We are going to hamstring them until a fresh election is held,” said PR leader and Ipoh Barat MP M. Kulasegaran.

A comment making the rounds in Perak says that while BN has the state government, PR has the legislature, through the office of the Speaker which is held by Tronoh assemblyman Sivakumar Varatharajoo, a lawyer, trainer and management consultant before entering politics.

The question is, what comes next now that PR has made their point?

Do they really control the legislature now that Sivakumar has been slammed with a restraining order not to act for the legislature?

Will the Perak ruler Sultan Azlan Shah recognize the “under the tree” session and the motion to dissolve the assembly for fresh election?

Very unlikely by most counts; and not just because the session was held under the tree but also because of legal and procedural issues that would potentially invalidate the session.

Political consideration will also come into play in any decision by the palace to give consent or withhold consent.

Nevertheless, the crisis is a very public issue and the burden is on the palace to act in a fair and just manner to ensure a legitimate and competent government in place and ensure peace, stability and progress.

However, with numerous suits and counter-suits and police reports by both sides, it will take months before the crisis can be resolved, lawyers on both sides said.

PR had hoped to end the stalemate they were trapped in by dissolving the assembly and holding fresh elections to let the voters decide the issue.

They had hoped to return to the state legislature with a bigger majority and end the crisis that was sparked after three PR representatives defected last month.

As Datuk Seri Nizar Jamaluddin himself said, he will “freshen up” the wording of the documents and try to seek an audience with the Sultan to get palace consent to dissolve the assembly for fresh election.

But that is easier said then done.

The palace gates will not open for him, not only because he is only an assemblyman now, but also because he and his government had been dismissed by the same Sultan just a month ago.

The Sultan had appointed Datuk Dr Zambry Kadir as the new Menteri Besar on Feb 5 and for the ruler to grant an audience now to Nizar is to go back on his own decision.

“He would want something more legitimate like a full and open session of the assembly with both sides present and taking a vote to dissolve the assembly before he would agree to dissolve the legislature,” a lawyer said.

Therefore it is an uphill task for PR to convince the palace to dissolve the assembly for fresh elections and this means the PR strategy to strangle the BN will continue unabated to force dissolution.

One area of action again is to use the Speaker’s office to hold state secretariat officials, police and others in contempt of the house.

Another is to lodge police reports against the same for restraining elected representatives from doing their duties which is a serious criminal offence under Section 124 of the Penal Code punishable with imprisonment of up to seven years if found guilty.

With these actions and the outcome of numerous suits in the courts undecided, it is too early for any side to claim victory or to conclude that the worst is over for Perak.

BN is expected to either shrug off the “under-the-tree” assembly as a PR circus or go to the court again seeking a declaration to nullify the meeting and the motions.

“It must be appreciated that the events unfolding in Perak are unprecedented and involve complex legal issues and it is impossible to provide a conclusive opinion on them,” said Bar Council president Ambiga Sreenevasan.

Under these circumstances, it is unlikely the Perak crisis can be resolved any time soon.

Why is the Sultan of Perak so silent inspite of all these huhas and chaos in Perak?

He is not so stupid after all. He knows Mahathir has taken away the powers of the Sultans a long time ago. He is keeping silent because he knows day by day UMNO is bestowing back all his powers and respect that he had lost! Just look at the daily shouts of allegiance and the march, banners and placards carried by UMNO members in praise of the Sultan lately. He never had it so good since the days of Mahathir!

He is using UMNO to gain back his powers and respect and UMNO is using the Sultan in the desperation to cling onto power! They are both using each other for their own ends. The Sultan should be wise enough to realise that by associating with the corrupt UMNO, his position and stature could also be mired with the same filth and his popularity/reign could follow whatever fate that awaits UMNO in the future.

Even if they are using each other for now it will only for a short term. In the end the rakyat is the bigger power. The rakyat are already up to their neck in frustration with the arrogant and corrupt BN regime. In a rakyat uprising, even if the Sultan sides with UMNO, anything and everything that stand in the way of the rakyat will be swept away by the tsunami of frustration and anger!

What is BN so afraid of having a snap election? They would argue that it will cost millions of taxpayers money to fund the election. But as it is now its costing the country billions of ringgit in 'missed' foreign investments. Surely only the desparados will want to invest in Malaysia now given the political uncertainty.

Perhaps the reality is they BN will be dumped by the rakyat. And there goes with it Gamuda or UMNOPutras opportunities to rake in hundreds of millions of ringgit from negotiated projects.

Zambry should be professional. Ignore your master. Use your discretion to facilitate dissolving the Assembly to pave for a fresh election. Lets the Rakyat decides who they want to lead them.

This Baradan fella has a bee in his bonnet. Most times his writing is an ill disguised attempt to paint Pakatan black and a few rare times he would take the middle course. In this latest, he is a dumbo. The Speaker is an an official of the Legislature and this office cannot be restrained by the court. The duty of the court is to interpret the law and pass judgement as the law dictates. The Legislature is the body which decrees the laws needed to govern a state. A restraining order maybe issued against Sivakumar in his personal capacity as a private citizen but not as a Speaker. The judge should be cited for contempt of the legislature. And Baradan cannot tell the difference. **sshole!

The war is not over yet.

Pk has just retreated from this battle and address the wounded. BN/UMNO just fought this dirty war by using all the public institutions as well as the sultanate of Perak as their weapons at a hugh cost because it has alienated the ratyat on which they would govern. During this short period of 3 years when the next GE comes around for another battle, it will be a very decisive war as right now a hugh percentage of the voters are with the PK. Analysts have confirmed that more than 80% of the ratyat are sympathetically leaning towards PK.

BN/UMNO, you can run and laugh now, but you cant hide for long. Just wait to see your downfall permanently.

What happened in Perak is a very complex incident for a lay man like me to understand. The only lesson I can draw for it is that "UMNO dah tak ade teloq nak dapatkan mandate baru dari rakyat dalam pilihanraya"

surely a state by-election would nullify all the law suits and adds legitimacy to the freshly elected state gomen. and it is the most efficient and effective way to allow a legal state gomen to concentrate on the welfare of Perakians instead of having the assembly men running to the courts over a long drawn period instead of running the state affairs. afterall, if not now, then Perakians will have to wait for next GE. by then, can anybody calculate the ekonomic damage done to Perak state?

What is so complex? I wonder why people love to make things complex. Spend time disecting and analysing the law and you will get the answer.
Anyone with a thinking and analytical mind can do it.

To say that Bukit Chandan needs some convincing is to imply that the sultan took a fair decision in the first place, and that if PR presented enough facts the sultan would have decided otherwise.

But the above is not the case. The sultan knew very well that he was making an unconstitutional decision. Now having made that decision, he cannot back down ( unless he is capable of "bertaobat") due to his ego, and his vested interests.

When ego and vested interests are involved, bertaobat is out of question. He will use his learned mind to invent all kinds of ingenious justifications for his action. The human heart is wicked and beyond repair.

The Perak palace is never convinced by good rhyme or reason - they will be more convinced by Gamuda contracts and by Najib.

But they talk and talk about ideals - only not to practise it.

With the cry of the majority people of Perak which party they want to rule the state is reason enough for the Sultan to make the decision. Whatelse do the Sultan need to be convince of what his subjects want? Any dumb person will know. May the Sultan make a very wise move this time so that the Perakians will enjoy a peaceful life.

there is no convincing needed, if the sultan is wise and just as perceived previously.

(1) PR holds an assembly to confirm Nizar as MB and calls for the dissolution of the assembly and give power back to the people to choose the fate of the state.

(2) BN tries to stop an assembly that wants to give power back to the people so it can stay in power.

(3) PR doesn't want to stay in power if the people doesn't want them. They just refuse to hand over power and the trust of its voters who supported them by some underhand tacticians and greedy frogs.

(4) BN wants to gain in power regardless what the people wants, and doesn't dare face the rakyat for a judgement.

(5) The speaker is enforcing the powers given to the speaker during the BN administration days. Now the very powers being yield is deemed derhaka! for going against the sultans wishes. Mind you this cry of derhaka is Coming from the same people who challenged the sultans during the appointment of MBs just barely a year ago.

SO wise sultan, if you can't see the picture, what can you see???

If the sultan is really sincere in his concern for the welfare of the state and its rakyat, he should not delay in dissolving the state legislative assembly. No need for DS Nizar or the illegitimate MB to request for it.

With this crisis going, I am happy that Johor, Melaka, Pahang, NS, Sabah and Sarawak will fall to PR in the next general election!

Why is Sultan of Perak keeping quiet?

If he can't decide then let the people decide who should be CM of Perak. Let there be another election.

What is so difficult? Do he even understand that people have the right to choose their government? What is stopping him from seeing that?
