(TV Antara) - "Jika di atas pokok pun ia sah", itu pandangannya ketika ditanya mengenai kesahihan "persidangan tergempar" itu yang diadakan di bawah pokok di luar bangunan Perak Darul Ridzuan yang menempatkan Dewan Undangan Negeri Perak, di Ipoh pagi semalam.

Persidangan itu, yang dipanggil oleh Speaker DUN Perak V. Sivakumar, berlangsung selama kira-kira 30 minit bermula 10.20 pagi, dihadiri semua 27 ADUN PAS, DAP dan Parti Keadilan Rakyat (PKR).

Mohammad Agus, seorang pensyarah Pusat Pengajian Sejarah, Politik dan Strategi Universiti Kebangsaan Malaysia (UKM) berpandangan bahawa tiga usul yang diluluskan itu juga sah dan tidak boleh dicabar di dalam mahkamah.

Usul-usul itu ialah menyatakan sokongan kepada Datuk Seri Mohammad Nizar Jamaluddin sebagai Menteri Besar; membubarkan Dewan bagi membolehkan pilihan raya negeri diadakan; dan mengesahkan keputusan Speaker Sivakumar melarang Menteri Besar Datuk Dr Zambry Abdul Kadir dan enam anggota exco kerajaan negeri daripada menghadiri persidangan dewan.

"Sebelum ini Dewan Undangan Negeri Perak hanya ditangguhkan dan tidak dihentikan. Jika ditangguhkan, maka Speaker mempunyai kuasa untuk mengadakan persidangan tergempar itu tanpa mendapat perkenan Sultan," katanya kepada Bernama.

Sementara itu, Presiden Majlis Peguam Malaysia Datuk Ambiga Sreenevasan berkata perkara yang berlaku di Perak di luar dugaan dan membabitkan isu perundangan yang kompleks.

Sungguhpun ia tidak munasabah untuk satu pandangan konklusif mereka, sesetengah perkara itu hendaklah ditangani sebagai satu perkara prinsip, katanya dalam kenyataan.

Beliau menanyakan sama ada dibenarkan untuk mengadakan persidangan Dewan Undangan di luar Bangunan Sekretariat Negeri.

"Tentulah, Bangunan Sekretariat Negeri di mana Dewan Undangan Negeri patut diadakan.

"Bagaimanapun, Speaker dan Adun Dewan Undangan Negeri (ADUN) dilarang daripada mengadakannya di satu tempat yang sesuai oleh polis dan ini membangkitkan isu serius mengenai kesahihan tindakan polis.

"Dengan itu Speaker tersebut tidak ada pilihan tetapi untuk bertindak dalam apa yang dilihat sebagai kuasa yang luas untuk mengadakan persidangan ini di tempat lain," kata beliau.

Beliau berkata ada pandangan berbeza, tetapi keadaan itu di luar dugaan dan Aturan Mesyuarat mungkin tidak meliputi sepenuhnya seperti keadaan yang tidak diingini, menyerahkan kepada Speaker dengan kuasa untuk bertindak mengikut keadaan kes itu.

Sreenevasan berkata keadaan itu tidak boleh dipertahankan daripada kritikan dan hanya mendesak untuk satu perkara iaitu pilihan raya negeri.

"Kini ada harapan untuk ini berlaku. Biarlah rakyat menentukan," tambah beliau.

I guess Siva and the rest of the MP’s would have to hold their assembly on tree tops….

Datuk Ambiga Sreenevasan, isunya adakah Persidangan Tergempar itu sah atau tidak sah, bukan "hanya mendesak untuk satu perkara iaitu pilihan raya negeri".

Speak and think like a lawyer, what more you being the Presiden Majlis Peguam Malaysia.

Apa yang diperlakukan oleh PR adalah tidak sah. Hanya perbuatan orang-orang AMNO aje yang sah. Bunuh orang pun boleh sah, apa lar nak diperkatakan oleh wahai rakyat jelata?

Kalou nak taksah kan orang, orang pun boleh tak sah kan hang tapie hang ada C4 dan K-47 kat tangan, tu pasal hang selalu menang!

Where else can you hold a state assembly when the police (executive) prevented the PR assemblymen from having access to the state building? Malaysia does not practise separation of powers.

What kind of shit or najis argument is AMENO / BN trying to pull this time on the Perak Constitutional Crisis they had created. How come they are now claiming that Speaker Sivakumar should be represented by the Perak State Government laywer. Doesn't it mean that they are now finally coming to their senses that Sivakumar is currently the rightfull and legaly binding speaker of the Perak State Assembly. Then if it is rightfully agreed that Sivakumar is the Current Speaker, then logically whatever Sivakumar rules should prevail and not disputed anywhere except through the voice of a quorum in the Perak State Assembly. Now I need some answers from the Indian origin mamak Zambri on this matter. If I am not mistaken Tambi Zambri definately can speak polished Tamil and even might be having second or third Indian muslim wifes in India. That is the trend and fashion among Indian muslims residing in malaysia.

This is a case where subversive elements in the form of provocateur agents, UMNO hooligans and a partisan police tried to undermine the constitutional process by illegally blocking off the State Assembly.

The Speaker has done the correct move by declaring another venue as the meeting point for the State Assembly.

Remember, even Zambry was proud to declare that he has his exco meetings at different locations the past few weeks. So, was that legal ??

The point here is Najib wants to win and has to win at whatever cost - but not thru a snap election .

GO PR PERAK
This show not only that majority of the PR representative are beyond the standard we required out of them. Good job.

The other three two was under suspicious setting which they put themselves in a situation to be trapped or they really want the money. From what I see so far it seems like they love the money. As for the DAP lady.... what can I say no principle and over a Camry... come on girl you need to ask for more.... But, what do I know maybe she have an account in Swiss by now.... Pstt... the new UBS Bank doesn't support corrupt accounts so maybe you want to move it somewhere.

It only shows PR politicians can 'think out of the box'. BN reps can only think in terms of $$$ and the use of PDRM goons to achieve their pilticial ambitions.

So, I would bet my 2nd hand bicycle that PR would be a better bet to pull our country out of this global financial mess. If we trust the BN, they are so stooooopid to even realize that there is a global crisis looming.

UMNO politicians are only interested to be in power and get elected to UMNO offices - "to hell with the rakyat" is their motto.
