Perak state legal advisor blocks notification of emergency sitting PDF Print

The Perak state legal advisor is trying to block state representatives from being notified of an emergency sitting of the state assembly on March 3rd.

According to DAP Perak chairman Ngeh Koo Ham, the legal advisor, Datuk Ahmad Kamal Mohd Shahid, has directed the house secretary not to send out notices of the emergency sitting.

Ngeh says that this obstruction is in “contempt of the house” and is liable for punishment under house rules.

“The legal advisor has no business to intervene in the process of the house,” Ngeh told The Malaysian Insider.

“He is not an advisor to the speaker or the house. He cannot stop the process and the final decision on whether to send the notices out lies with the speaker.”

To work around the obstruction, a press conference was held in Ipoh today and the speaker will explore other means of sending out the notifications.

Only 49 notices will be sent out.

Menteri Besar Datuk Zambry Abdul Kadir and his six exco members will not received a notification as they were recently suspended by the speaker.

Neither will the three state assemblymen who switched support to the Barisan Nasional (BN) earlier this month as they are regarded as having resigned.

Two motions will be tabled at the emergency sitting. The first motion is proposed by Titi Serong representative Khalil Idham Lim to reaffirm confidence in Datuk Seri Nizar Jamaludin to continue to lead as Menteri Besar.

The second motion is proposed by Teja representative Chang Lih Kang and requests the Menteri Besar to tackle the current political crisis by doing all that is necessary to dissolve the state assembly, including sending a request to His Royal Highness Sultan Azlan Shah to dissolve the state assembly.

If all goes according to plan, PR will have 28 assemblymen to BN’s 21 in the emergency session.

Zambry had earlier told The Malaysian Insider in an interview that he will defy his suspension, maintaining that the speaker had no jurisdiction for suspending him unilaterally for something that happened outside the assembly.

Reiterating PR’s stand that power was grabbed unconstitutionally in Perak, Ngeh says that the protracted battle is damaging to the state and its citizens and called upon the prime minister to advise Zambry to agree to dissolve the state assembly.

“Or hopefully, Sultan Azlan Shah can get parties to sit together and find an amicable solution. Let the people choose their government and their leaders.”

i think this is not necessary as Zambry is suspended and is not goin to be the Menteri Besar. whether Zambry agrees or not, it's irrelevant. Nazri will be the rightful leader to request for the state assembly to be dissolved.

Looking at the bright side of this situation, the hidden Umnoputras will be coming out in full force to stop the sitting of the emergency sitting. Watch out for new kataks.

When the new PR state gov't form, fire all those who had been proven to be Umno friendly in order to ensure that the gov't policies are executed promptly & smoothly.

State exco Ngeh is a gentleman. he suggested the PM or the sultan to step in to resolve this damaging impass. This serves no purpose to the victor or the vanquished. The people only will suffer. And the other best way is to let the people make another decision in a snap poll.

The legal advisor is like a legal consultant. His duties are those outside the scope of the assembly. he has nothinbg to do with the assembly per se. Only the speaker is a direct constituent of the state assembly.

Dear Pakatan Leaders & future Menteri Besar from Pakatan

If State Assembly is dissolve and fresh election take place, please go all out to win Perak State back of which i am sure Pakatan will win. Then PLEASE PLEASE removed all those people or officers with allifiation Gangster ummmmm....... no .

Please study the history of China especially the change from 1 dynasty to another. The new Emperor will always wipe out officials of the previous dynasty. This is to ensure that the old guards will not revoke against the new Emperor.

To all Pakatan MBs,

Don't be so naive to think that all those civil servants who served under UmNo mafia previously will change their corrupted behaviour overnight!

The first thing to do is to make all these civil servants to make mandatory declaration of their personal wealth (well of course this includes their spouse and children). Those who cannot explain how they accumulate wealth that is disproportionate to their income, the state government should suspend their jobs with immediate effect and initiate investigation to take legal action against them.

One very simple solution...dissolve the state gomen and ask for reelections.
If HRH had agreed to doing so in the 1st place, we wouldn't have had all this crab.
Still it isn't too late to rectify the situation.

Ah, finally he admits. And that's exactly the point. The removal of Nizar as the MB was not referred back to the state assembly. And Zambry was appointed the MB, an event preceded by a 'show of confidence' by the BN and 3 frogs that happened OUTSIDE the assembly. So, the Speaker has the right to void that since, as Zambry finally acknowledged, that was something that happened not in the assembly and by the assembly.

Another observation is that lately, the name Ahmad seems to be the common name for troublemakers. First the pendatang, then MACC chairman, and now another one.

The Perak Sultan and his son's elegant silence says it all...the Sultan and the BN screwed up big time.

It's a legal tangle they cant get out of. It's either emergency rule or UMNO gangsters and co incorporated to the fore to bash up the state assembly. March 3rd will be interesting. All PKR/PAS/DAP youth plus whoever else believes in fair play must brace themselves for that day. Whether the PR moves forward or the country stands still may be decided on that day.

To Nizar, Sivakumar and Ngeh...if there were more of you....there is yet hope for Malaysia. Insyallah.

I wonder, can the assemblyman be obstrcted from attending for any reasons what so ever?
PR should send out people to make sure all attend so they have the proper QUORUM.
Be ready for dirty tactics.

Please hold fresh election to solve all these issues. The PEOPLE OF PERAK are sufferring and please do something. Who is this Ahmad Kamal, the Perak state legal advisor? What is his role?

An advisor is just an advisor, nothing more, nothing less and he has no authority to direct any civil servant or officials of the state assembly.

He is there to advise on any legal matters which involves the Sultan and the Royal family, the MB, the Speaker and Exco members of the state assembly.

Directing the house secretary to do his bidding is not in accordance with the provisions of the state constitution and in interference of the speaker's right.

So, Admad Kamal. Back off or you will be sued

My prediction
come 3rd March... 10 pakatan rakyat representative will go missing. They will get detained under ISA and release on the 5th March after the assembly.

BN will win vote of confidence and the will of the royal family of Perak will be done. TO make sure Barisan Najis head the government of Perak so that big project can be secured.
