Nizar sues Dr Zambry, wants injunction against him PDF Print

(The Star) Former Perak Mentri Besar Datuk Seri Mohammad Nizar Jamaluddin has filed a suit against current Mentri Besar Datuk Dr Zambry Abdul Kadir, saying his swearing in last Friday was illegal and unconsitutional.

In suit filed at the High Court here at 11:30am Friday, Nizar is also seeking an injunction against Dr Zambry to stop him from performing his duties and by way of judicial review, a declaration that Nizar is still mentri besar.

Only Dr Zambry was named as respondent after Pakatan Rakyat decided not to name the Sultan of Perak, Sultan Azlan Shah, in the lawsuit.

It was the Perak Ruler who asked Nizar to step down as mentri besar and whom swore in Dr Zambry after he declared that Barisan Nasional had the majority in the state legislative assembly.

This came about after three Pakatan assemblymen quit their parties to remain independent, while a fourth jumped back from PKR to Umno, barely 10 days after he first quit Umno to join PKR.

While that tied Pakatan, which took over the state government after the 12th general election last March, and Barisan with 28 seats each in the 59-seat assembly, Sultan Azlan Shah said Barisan had the confidence of the assembly after the three independents pledged their allegiance to Barisan.

Don't be surprised if the court strikes out the writ on spurious technicalities. Perhaps for not putting a full stop after the sentence.

We are at the stage we cannot trust any public institutions at all. Even state representatives, judges, and other heads of public bodies can be bought like cattle at the market place.

Today we cannot hope to win on the merits of the case. It all depends on the sitting judge. If he is a God fearing man/woman we have hope. If you get a scum on the bench then even white will be judged black.

There's an error here.
It should read " The Perak Mentri Besar Datuk Seri Mohammad Nizar Jamaluddin has filed a suit against illegitimate Mentri Besar Datuk Dr Zambry Abdul Kadir, saying his swearing in last Friday was illegal and unconsitutional.

Lets see if the courts will have the guts to overturn the legitimacy of BN government like what they did for RPK's ISA trial.... I'am not putting any high hopes on this, but I stress that the courts must be warned! Any injustice would incur the wrath of the rakyat!! BEWARE!

High court very susahlah to get an independent non bias judge. Odd are better to buy the lottery and striking it rich rather than getting a good federal court judge....

Don't give hope first try the luck first... if not then can't say that Nizar haven't try ....at all.... I know it not that easy if anything got to do with opposition party case... and we know why.... UMNO is behind every single step of the way block this and that... don't want any truth to be told or hear or even win!

'The swearing in... was illegal and unconstitutional'. Even a layman can see it is a simple sraightforward case ..unless ,of course, some 'hidden hands' come to play.

The possiblity of Nizar getting a fair trial is very slim. Do not worry as most of the Perakians support him.

I would have named the Perak Sultan as respondent.

After all, our laws provide such provision that royalties are not immune to legal action. This to ensure sultans should exercise their duties without fear or favour.

The Chief Justice is Umno man. Now he is also head of the JAC. Any judge finding against Umno/Bn sure will not get elevated to Higher Court. So this judge, how to carry out his duties?
