Keputusan pembebasan Tee Yam dibuat oleh panel tiga Hakim Mahkamah Persekutuan, Datuk Pajan Singh Gill, Datuk Richard Malanjum dan Datuk S. Augustine Paul. Tee Yam diwakili barisan peguam diketuai Datuk Muhammad Shafee Abdullah, Kaushalya Rajathurai, Frida Krishnan dan Lilian Lee.

KOO TEE YAM (kanan) bersama peguamnya, Muhammad Shafee Abdullah (tengah), sempat melambaikan tangan ketika ditahan semula oleh polis sebaik sahaja dibebaskan dari Penjara Simpang Renggam, Kluang, Johor semalam.

Jutawan yang dipercayai memiliki aset bernilai RM1 bilion yang mencetuskan kontroversi apabila enggan keluar dari Penjara walaupun telah dibebaskan oleh mahkamah, hari ini ditahan semula di bawah Ordinan Darurat 1969.

Koo Tee Yam, 48, ditahan semula sebaik melangkah keluar dari penjara Simpang Renggam, Kluang, Johor ekoran keputusan Mahkamah Persekutuan yang membebaskan beliau pada 19 Oktober lalu selepas permohonan habeas corpusnya didengar.

Dia sebelum ini ditahan di sebuah restoran di Bukit Bintang di sini pada 26 Mac tahun lalu sebelum dipenjarakan di Simpang Renggam, Kluang, Johor.

Keputusan pembebasan Tee Yam dibuat oleh panel tiga Hakim Mahkamah Persekutuan, Datuk Pajan Singh Gill, Datuk Richard Malanjum dan Datuk S. Augustine Paul.

Bagaimanapun, Tee Yam yang sepatutnya dibebaskan Rabu lalu, dilaporkan enggan meninggalkan pusat tahanan di Simpang Renggam itu kerana bimbang ditahan semula oleh pasukan polis dari Bukit Aman.

Kebimbangan itu menjadi kenyataan apabila Tee Yam yang dibebaskan pada pukul 1.30 petang ini, diberkas semula mengikut Ordinan Darurat 1969 sebaik sahaja melangkah keluar dari kawasan penjara.

Seorang pegawai polis, Asisten Supritendan Zabidi Kadir Mohamad membacakan waran tangkap kepada lelaki itu sebelum dia dibawa masuk ke dalam van polis.

Ketika dibebaskan, Tee Yam yang memakai baju-T belang hijau, seluar coklat dan kasut hitam, sempat mencium dan memberikan sesuatu kepada isterinya, Chia Mei Sim sebelum waran tangkap terhadapnya dibacakan.

``Saya berada di sini (Penjara Simpang Renggam) selama 17 bulan. Apa salah saya,'' tanya beliau dalam bahasa Kantonis kepada pemberita dan orang ramai yang telah berkampung di luar penjara itu sejak lima hari lalu.

Sementara itu, Pengarah Jabatan Siasatan Jenayah Bukit Aman, Datuk Mohd. Fauzi Saari memberitahu Mingguan Malaysia: ``Dia (Tee Yam) dipercayai terlibat dalam pelbagai kegiatan haram seperti pelacuran, kongsi gelap, perjudian, kelab malam dan ah long yang mampu mengancam keselamatan orang ramai.

``Polis menahan lelaki itu atas dasar keselamatan negara.''

Katanya lagi, jutawan itu ditahan selama 60 hari di bawah ordinan tersebut.

Penahanan Tee Yam katanya, adalah sebagai jaminan keselamatan masyarakat umum.

Peguam Tee Yam, Datuk Muhammad Shafee Abdullah yang turut berada di luar penjara itu berkata, ahli perniagaan itu ditahan atas empat sebab iaitu menganggotai kumpulan kongsi gelap, terlibat dalam aktiviti mencurigakan, kegiatan jenayah dan perkara yang berkaitan.

``Bagaimanapun, Seksyen 4(1) ordinan itu membenarkan Menteri Keselamatan Dalam Negeri menahan Tee Yam sehingga dua tahun selepas ditahan selama 60 hari,'' katanya.

Lelaki itu yang juga merupakan seorang ahli perniagaan dipercayai memiliki aset bernilai RM1 bilion, kemudian dibawa ke Ibu Pejabat Polis Daerah (IPD) Kluang untuk membuat laporan polis.

Tee Yam kemudian dibawa terus ke Bukit Aman untuk siasatan lanjut.

Sementara itu, Mohd. Fauzi berkata, sepanjang tempoh penahanan 60 hari itu, polis akan mendapatkan perintah daripada menteri berkenaan supaya penahanan Tee Yam dilanjutkan dua tahun lagi.

Tee Yam pernah melalui lima proses perbicaraan dan mengemukakan rayuan melalui Muhammad Shafee di Mahkamah Tinggi Muar pada 24 Mei sehingga 7 Julai lalu.

Dalam rayuan bagi permohonan habeas corpus di Mahkamah Persekutuan, Tee Yam diwakili barisan peguam diketuai Muhammad Shafee, Kaushalya Rajathurai, Frida Krishnan dan Lilian Lee.

Pihak responden diwakili oleh Timbalan Kanan Pendakwa Raya, Datuk Yusof Zainal Abiden, Timbalan-Timbalan Pendakwa Raya, Tun Abdul Majid Tun Hamzah, Kamaluddin Mohd. Said, Mohd. Najib Zakaria, Fazillah Begum Abd. Ghani dan Tengku Amri Zaki Tengku Abdul Rahman.

Muhammad Shafee dalam hujahnya antara lain mengemukakan alasan mala fide (niat jahat) dari mula Tee Yam ditahan oleh polis sehingga 60 hari tempoh penahanan yang dibenarkan, dan tidak mengikut peraturan seperti dinyatakan oleh Lembaga Penasihat. - Utusan Malaysia, 30 Oct 2005

Dont get the BN wrong... ISA is to protect.... Protect it is(for US)......

Why all the fust on this and tat. All we tahan is those who made huru-hara (for US)

Anyone who go against the government (US, specially). will always experience it.

So, do not fight, we want to be ur friends. (If you pay well, tat is.)

We dont need GOD to save Malaysia, there are already a GOD (which is US) in Malaysia.

Hope u doing feeling better now....MT commentators was making a big fuss out of a statement quoted from Star yesterday..But I guess indue time, you will clarify it....In the meantime, links of the underworld is nothing new Pete...MCA are just a "legal crime organization" themselves...Our glorified MCA Tun is one perfect example...Guess who owns the mini casino in Hartamas, and Decanter chain restaurant...Or how bout his son owning sole hard liquor license for "whiskey" etc......I am telling this through my experience from dealing with the MCA these thugs....they are as filthy as the dogs they are...

I feel you trying to get us to see the bigger picture around the three stooges, namely Datuk Pajan Singh Gill, Datuk Richard Malanjum dan Datuk S. Augustine Paul? Are they in any way related to the court cases that you're involved in?

Are we to pray that the less than squeaky clean judges who take your case turn a new leaf overnight? Bertaubat? Malaikat datang pun tak akan bertaubat. Only God himself appear and say tonight, this moment, I require your soul...perhaps boleh bertaubat. But I am not 100%.

Day in, day out, we hear the ongoing suspicious activites of the Police and the Judiciary. The well-connected get off scott free but those who stood up on matters of principles and legitimate democratic rights are bashed into submission. Then we have a Home menteri who even had a reporter arrested under the ISA for her so-called personal protection. If this is what Barisan has to show for the past donkey years, the rakyat should know what to do in any by-election, State election and Parliamentary election. Enough is enough. The UMNO youths can all go and gather in front of Karpal Singh's legal firm to make all the noises and protests they want, 365 days a year. When the crucial moment comes anyway in Malaysia, you all know where to mark your 'X' on the ballot papers.

RPK got a few items wrong here - Ah Lek was not the sole taiko of the gang. Initially, the gang was headed by "uncle" but he retired of old age. Ah Lek and Ah Lau (nephew of "uncle") both assumed control after that and that started the break up. Ah Lau migrated to UK before the PDRM swooped in. Tan Yew Hock (Ipoh Chai) is one of the smaller bosses together with Ah (forgot-his-name) who migrated to Australia.

Corruption in the police amd judge is the mother of all problems.

- A friend of mine is ASP in the Narcotics Penang. He is rich enough to buy land for his siblings.

- Bukit Mertajam DVD heavenly king was arrested for countless times. He was found innocent by the magistrates for almost all cases.

- Ex-KL police chief was transferred to Pahang because they worry he has too much cashes and no safe place to keep his cashes.

One of his liutenants Tan Yew Hock, the former special assistant to former Bukit Bintang MP Datuk Dr Lee Chong Meng, was shot dead at Jalan Pandan Jaya. Tan Yew Hock was Koo Tee Yam's personal assistant to handle matters with the authorities.

I remember reading news articles of this man several times. Is he the director of agencies in AIA? Heard he was a clever strategist. No wonder AIA is in this shape.

I think we should have a 10 years plan. Abolish BN/UMNO. Get new educated people-not exposed to the dirty politics yet, who have passion to help others. Make it a compulsary that a PM can only stay for 2 terms.
All I can say for now that is DPM will be PM soon and no one can do anything about it. Malaysia is getting darker and darker...

don't worry about this triad boss. he should know, those who live by the sword, die by the sword. he won't live long, his life will be taken care by rival gang soon. the chinese always believe in "pou ying" retribution. so those doggie MCA including bukit bintang division, is a matter of time they will receive their due punishment. if not for their generation, their next will receive it. all the best to those mca involved.

Saya mengkagumi setiap artikel yang dikeluarkan oleh Y.M dan mempercayai hampir 100% mengenai apa yang ditulis oleh Y.M. Saya yakin dan percaya, hampir kesemua rakyat Malaysia yang membaca artikel Y.M juga mempunyai pendapat yang sama seperti saya.
Walaubagaimanapun ingin saya memberikan pendapat mengenai artikel Y.M yang bertajuk “Heavenly King : The story of Kuala Lumpur’s Boss of Bosses”. Terdapat beberapa keraguan wujud terdapat artikel berkenaan iaitu:
1)Tee Yam tidak ditangkap dan ditahan dibawah ISA tetapi dibawah POPOC (Public Order and Prevention of Crime)
2)Tee Yam dibebaskan kerana hakim berpendapat terdapat beberapa alas an antaranya adalah pegawai yang menandatangani arahan penahanan tidak mempunyai kuasa untuk menurunkan tandatangan dan pertuduhan yang tidak jelas (hear - say) dan lain-lain;
3)Tee Yam ditahan dan dibebaskan sewaktu Dato’ Noh Omar menjadi Timbalan Menteri dan bukan Dato’ Johari Baharom.
4)Adalah sesuatau yang meragukan apabila Dato’ Johari Baharom dan orang-orang PM menerima RM7juta untuk kebebasan beliau sedangkan kemungkinan untuk beliau ditahan semula dibawah POPOC adalah mustahil kerana:
(i)beliau telah dibebaskan dan pertuduhan yang sama tidak boleh digunakan;
(ii)pertuduhan yang lain adalah sukar kerana tempoh masa yang singkat diantara pertuduhan lama dan pertuduhan baru (jika ingin dibuat oleh pihak polis), sudah tentu tidak akan diterima Mahkamah dan kemungkinan beliau mengatakan beliau difitnah adalah boleh dipercayai;
(iii)Tee Yam adalah bodoh untuk membayar RM7juta untuk sesuatu yang tidak perlu, beliau hanya perlu lari dan menghilangkan diri sahaja. Seperti kes Jackie Chan Malaysia.

It seems that in Malaysia nowadays,it is better to be criminals than law abiding slaves, err, citizens. Criminals are given better protection and have more rights than a normal citizen. And the letter from saudara Rizuan above raised more ironies than clearing up the air.

1. Unarmed bloggers who have never stolen a single cent such as RPK are charged under ISA which are supposed to deal with subversive and dangerous armed organisation like terrorists and communists. In contrast, Koo, who controls an army of armed gangsters who had track records of murder, robbery, extortion, etc. are not charged under ISA.
2. Many ISA detainees and also non-ISA detainees (Jerit and other assemblies) were arrested even without any signature from anybody. When Syed Hamid and Badawi, were asked about such arrest, they answered " eh, saya apa pun tak tahu-lah.." So, since even the Prime Minister and Home Minister is not sure who is supposed to sign what, your excuse of signature does not hold water.
3. Who is the Timbalan Menteri does not change the fact that Koo Tee Yam is Koo Tee Yam, and a criminal is a criminal.
4.i) it is not impossible for a person who was released to be charged under the same charge because Malaysian court practice selective prosecution as in RPKs case.
ii) RPK was charged immediately upon his discharged. Since when does the Mahkamah accept or don't accept a case base on technicality of the law in Malaysia?
iii) If Tee Yam just disappeared, then he must be really bodoh because he will lose his power and his 1billion dollar empire. By paying only a petty sum of 7million, all the corrupted politicians, police, judges and lawyers are still at his beck and call, and he could still access his billions.
So, saudara Rizuan, what are you trying to prove?
