Selangor fights 30pc water hike, wants Syabas concession cancelled PDF Print

The Selangor state government has signaled its intention to take on the federal government in a battle over water supply in the state after sending a letter to the Energy, Water and Communications Ministry asking for the 30-year concession agreement with Syarikat Bekalan Air Selangor (Syabas) to be terminated.

While the immediate concern is to block a 30 per cent hike in water tariffs come April, the actual ramifications may stretch into talks that have begun in earnest this week over the sale of water supply assets – water treatment plants, dams and pipelines – in the state to the Finance Ministry’s wholly-owned Pengurusan Aset Air Bhd (PAAB).

Under the concession agreement inked in 2005 between Syabas, the federal government and the Selangor government, periodical tariff hikes are provided for as long as Syabas meets certain conditions.

Energy, Water and Communications Minister Datuk Shaziman Abu Mansor recently said that “according to the National Audit Department’s estimates, Syabas could increase the tariff by 30 per cent although the agreement stated 37 per cent because the company had met almost all the conditions”.

This has left some 1.5 million consumers in Selangor, Kuala Lumpur and Putrajaya facing the increase which may, however, be revoked and restructured if water assets are handed over to PAAB before the hike takes effect in April, according to Shaziman.

Under the Water Services Industry Act 2006, all water assets in Peninsular Malaysia must be transferred to PAAB with Malacca recently inking an RM889 million deal and Negri Sembilan following suit this afternoon.

But the letter sent by Menteri Besar Tan Sri Khalid Ibrahim is a clear signal that the state government is not certain that this handover of assets will take place by the end of March and is now forcing the cancellation of the concession outside of the mechanism of asset transfer.

The situation could lead to a protracted legal battle and the state government will most certainly apply for an injunction to block any tariff hike until it is resolved.

Should it be successful in lifting the April deadline for the hike, it will give the Pakatan Rakyat government some breathing space to engage in the negotiations over the water assets deal.

Khalid confirmed when asked by The Malaysian Insider that he sent the letter at the end of December 2008 to challenge the concession agreement on the grounds of non-compliance by Syabas.

“The National Audit Department concluded that there were a lot of discrepancies that were not in accordance with the agreement.

“For example, the agreement said that they must give tender for projects so we can get the best price. Over RM600 million of projects were not tendered,” he said.

Sources also told The Malaysian Insider that a majority of projects were in fact, handed via direct negotiations and that total capital expenditure exceeded the approved amount.

Khalid also added that Shaziman’s “most” is not good enough and that “Syabas is getting a free ride.”

Several factors are standing in the way of a smooth transfer of water assets to the federal government, chief among them being the discrepancy in “fair exit value” for private companies who own about 20 per cent of the assets.

One of the asset owners, Puncak Niaga, also owns 70 per cent of Syabas, and has an obvious vested interest in prolonging negotiations and activating the tariff hike.

Khalid clearly hinted at issues with differing valuations when he told The Malaysian Insider that if the deal is “done at a fair price, the concept of a 30 per cent increase may be unnecessary.”

Selangor must resist the corrupted UMNO-led BN Govt all the way. It's daylight robbery for the Govt to force the State Govt to surrender all water assets to PAAB and allow a disgusting lopsided water agreement with Syabas that fleece the people. Together with the scurrilous toll concessionaire agreements, BN is clearly contributing to inflation in this country and thus aggravating the people's hardship. It's time to dump this incompetent, indifferent and abusive BN to the drains.

Tan Sri Khalid, be firm with the UMNO goons. They can't wait to claw at you especially their latest defeat at KT. Please settle this water thingy, and make sure it is in the interest of Rakyat selangor's benefit.

By the way, what happen to the hantu toyol's case involving his wife with illegal transferring of fund (Balqis)??? Please, do not procrastinate anymore, deal with the case urgently as though it is your final day in Selangor, all the people in Selangor are getting frustrated why Toyol's wife is not brought to task for failing to answer for her misdeed! Justice must be meted out against her at all cost if you do not want your credibility to be dented!

Syabas is a real inefficient unit. Water leakages along pipelines, overstaffed, poor service, and corrupted procurement procedures. The water hike should not be allowed to cover their losses neither should the rakyat be made to pay for their inefficiencies.

Don't bend over backwards for this A-holes.

when we put you as MB,we want you to tell the FED gov't that in no uncertain terms will we,as the state gov't, bow to your demands.Let make it very clear umno/BN ,as opposition,must not try to belittle Selangor.
Yes,terminate Syabas contract is they refuse to listen to the state gov't wishes.We can't let these umno cronies do what they like.

Since Syabas did not get the best price according to the terms of the agreement, they should be made to cough out the money pocketed by greedy politicians of the ruling party of the last state government failing which the present Pakatan government should sue them.

In Malaysia, privatisation meant to generate money for the gomen goons/cronies. Most of the privitisation (the brainchild of our previous buaya) was meant for thier own benefits, the way where the rakyat monet would be siphoned out....the Bolehland concept!

This proposed hike is one of the many reasons why the people are unhappy with the BN govt. If BN wants to win back the peoples' support it got to do away with all these sweetheart deals that are so lop-sided in favor of themselves or their cronies. Look also at the highway concessions, you find plenty of "sweethearts" there.

Under syabas, our water is not even fit for consumption. Fill a bottle of water from the pipe, put it in the fridge and next day you will find lots of residue at the bottom. Currently I pay extra for drinking water as the water from our pipes are only fit for washing and cleaning. What is syabas doing.

In Australia and New Zealand, the water is so clean and taste so good. Syabas wants to increase their rate when they cant even supply us with clean drinking water.

Khalid good on you and PR.

With your background in managing corporations, please run this state like a company by instilling good corporate governance. It is in the best interest of the rakyat to question any mishandling by the other Ministries. In fact even at the current rate Syabas cannot give us clean, heavy-metal free and chlorine-free drinking water. Don't even talk about rates hike.

Go sue Syabas for breaching on their terms of contract and either meet clean water standards or get terminated!

These bloody UMNOputras trying to fleece the Rakyat once more. Tan Sri Rozali of Syabas (& Puncak Niaga) is already a multi-millionaire and his Syabas has taken the Rakyat's money without renewing and replacing all the worn pipes as agreed, so why does the Govt. have to protect this concessionaire ?!!

If Syabas was any good, the Rakyat would get Clean piped water, not the yellow tainted muck that we are getting now. If Syabas did their job as per the contract, many companies selling water filters would not have been viable business entities !! The Rakyat has been robbed all these years, and now they want to raise water tariffs 30% - for what service, may I ask ?!!

Only in Malaysia are the Rakyat given tainted water, defective "national" cars etc. etc. and made to pay through our noses ... only in Malaysia

The water deal was a scam by the previous state gomen under hantu toyol and the BN Fed gomen to cheat and fleece the people of Selangor so that these corrupted can get rich. That's right Khalid take them to court and make public disclosures of the shady "negotiated deals" get other contractors to requote and the make a case for the MACC (Fat chance but we live in hope). Gather the evidence and sue for fraud and abuse of power. Meanwhile apart from the Balqis thingy, what about the RM1 million Merc S350 that the hantu toyol bought for his private use using Kumpulan Darul Ehsan's money. Hey this is a clear case of corruption and misappropriating Selangor's gomen funds, just like criminal breach of trust. Go ahead Khalid, fry hantu toyol.

Water is a basic necessity for human survival, hence many country s even provide it free for its citizens. But in Malaysia the govt gives away its own assets for free via privatization to leeches like Syabas etc who after taking over all the assets for free, increases the tariff and acts like it is doing the citizens a favour by maintaining the water supplies. This must come to a stop. If the govt is a caring govt (sic) then it should rescind the concession agreement and let the state govts run the water services. It is the same with all other basic utilities like Electricity etc. No more monopolies.

There are certain basic needs that people are willing to fight and die for. Water is definitely one of these needs. I do not understand why water supply and management must be privatized. The nature of privatization is to make money and profits. In this water case, it is at the expense of the basic survival needs of the people.

How can a govt ever thought of doing that to its people, unless it is not caring at all. How can anyone ever think of exploiting the very survival need of the people just to make a profit?

Can the landowner further upstream near the catchment areas prevent water from flowing down to the dams then?

Water belongs to the people. And the govt is put up there by the people to take care of their interests and if the govt cannot even take care of their basic needs, why the heck are they the govt?

Why does this BN govt keep on burdening the rakyat? We pay taxes to the govt but for what? Because beyond that we pay our own way too, just to live a decent life everyday, from tolls, to energy, to water, to communications, to health, to damn everything. And I don't even see unemployed here in Malaysia lining up for dole like other countries.
