The government waived interest payments on RM100 million worth of loans it made to Elite highway, which is operated by Plus Expessways Bhd (Plus), as part of the deal to lower toll rates, a DAP delegation revealed today after inspecting recently declassified documents today.

In total, the company took RM390 million in financing from the government. As of last year, the company had already collected RM1.2 billion in toll charges.

The disclosure, the latest since the DAP and other political parties started inspecting the volumes of contract documents at the Works Ministry this week, provides a glimpse into the kind of deals struck, which were once cloaked in secrecy, and which critics say have been extremely favourable to private highway concession holders.

In disclosing the Elite's interest waiver, Petaling Jaya Utara MP Tony Pua said, however, that the amount of interest rate was not specified as the loan agreement was not released for public inspection. It was revealed however, that Elite drew down RM90million of the initial loan.

Elite highway, which was built mostly by 1994, to connect the New Klang Valley expressway to KLIA and Nilai was still receiving government financing as late as 2003.  The company took a total of RM390 million in government financing and RM800 million in Islamic bonds. It has collected RM1.2 billion in toll revenues by 2008.

The original concession period for Elite highway was also extended from 24 years to thirty years to the current 36 years. It was extended for various reasons such as for new interchanges built and in exchange for lower toll rates.

He said this at the conclusion of a weeklong study of about a dozen toll concession agreements by the DAP team, which included Teh Chi Chang and Teo Nie Ching.

Teh is economic advisor to the DAP secretary general and former executive director of investment reseach at Citibank Asia Pacific and covered toll highways and Independant Power Producers for 13 years.

Teo is DAP's member of parliament for Serdang. Some of the other findings by the DAP team are:

Plus is facing problems with efficiency as it is paying maintenance fees of RM50,000 which is double what other operators are paying.

"If Plus can improve its efficiency, they can cut toll rates, still maintain profits and everyone wins," said Teh.

The agreements contain no service level protection for consumers. "The whole reason for having toll highways is faster traffic flow. But there are still traffic jams, for example along the LDP. Consumers are suffering but still paying toll," Teh points out. "They should offer discounted toll rates to compensate for poor service quality."

There is no standard formula to calculate profit sharing. "The profit sharing ratios range from 50:50 to 80:20 in favour of the toll concessionaire in the case of the SILK highway," says Teo.

Almost all loan agreements are effectively guaranteed by the government as if the toll concessionaire defaults on loans from the private sector, the government will assume the liabilities. "The concessionaires have nothing to lose," notes Teo.

Declassified documents only extended as far as general agreements and do not include appendices. Appendices are important as they contain projected revenues, agreements on toll rates over the next few years as well as the physical design documents. Loan agreement and novation agreements were also not made available.

"Novation agreements detail the manner in which concession rights are transferred from one company to another, for example, the transfer of the Penang Bridge concession from Mekar Idaman Sdn Bhd to Penang Bridge Sdn Bhd," says Pua. "We appreciate that the minister declassified these agreements but it is still not a full and frank disclosure."

Teo adds: "Concessionaries use confidentiality clauses but as these are big projects that come with big profits, the government is in a position to bargain. If an open tender was used, they could have kicked out any party that insisted on having a confidentiality clause."

A RM300 million government loan was contained in the original agreement with SILK highway but the loan was deleted in the supplementary agreement throwing the status of the loan into question. "Has it been drawn down? Was the loan cancelled? Was it a gift? It was not properly explained," says Teo. Pua adds however, that it could have been deleted as part of the restructuring of the agreement.

A DAP study committee, called "Operation Restore," is being created to come up with a comprehensive report on the toll concession agreements.

The committee will comprise of Pua, Teh, Teo, Anthony Loke, Charles Santiago and Lim Lip Eng.

Loke, Santiago and Lim are members of parliament for Rasah, Klang and Segambut respectively.

They expect to submit a preliminary report next week to the Works Minister, which will contain their findings and their recommended actions.

Mr. Pua, even if you discover irregularities what can you do? I mean look at the Port Klang cost overuns to $4.3 billion. The running dog promised parliament everything will be revealed. But now the running dog has decided to keep quiet. Thay's their new tactic. He even fired a senior director of The Star for speaking out. They are all crooks.

Fellow Malaysians! Please open your eyes to how the govt molly coddle their cronies. Inspite of Plus Expressway making mega bucks from the Elite Highway, the govt still waived interest on a loan taken by Plus. Isn't this good enough to tell you why the cancerous UMNO and its diseased BN's buddies should be dumped for good. It's just not worth your support.

Dear DAP team, thanks for the in-depth analysis, the Rakyat are being appreciative of your efforts put-in, I hope all the highways users will remember how these blood-suckers keeping sucking our blood-sweaty monies whenever we were travelling on such highways, nothing much we can do now as it was controlled at the federal level, unless we vote PR all the way up to the Federal Level in PutraJaya. God bless us the good people of Malaysians, except the BN crooks.

The whole highway concession thing is a massive scam regardless of the conditions of the agreeements the concession holders take Malaysians for a mob of bunnies I'm sure the first line of their contract would insist they provide facilities to allow the smooth and safe flow of traffic But look at the toll.all they are interested in is raising money. They have made very little to no attempt to maximise the flow of traffic. Yet they only have to look just south of JB to find a simple, inexpensive and effective way of collecting money while allowing the traffic to flow smoothly

This Privatisation and Concession schemes were all started by MM and now all the UMNOputras in Barisan Najis use these money-making methods to plunder the Rakyat and use these large corporations and concessionaires to siphon the Rakyat's money in pay-offs to these UMNOputras' pockets!JKR in my day would have built all the highways at a much lower cost and probably last longer too! Nationalize all these Buccaneers & Lanun companies and Stop them from continuing to plunder Malaysia!

Not overpay,no inefficeincy.The payments were purposely overpaid to benfit the mainternance operators who is UMNo members.In return for the exorbitant profit the maintenance contractors will paid UMNO or its goons certain amount of money as gratitude for awardfing them the contracts. That is how the business were done in Malaysia.UMNO and UMNOPUTRAS benefited a lot while we and ordinary folks sufferred.

Declassified documents only extended as far as general agreements and do not include appendices

I believe these appendices are still top secret because it states:
Party A gets 20% commission for the next 30 years
Party B gets 10% commission for the next 30 years
Party C gets 25% commission for the next 25 years...

Probably the UMNO goons are shredding right now as we speak (aka Enron, for all their criticism of USA, they certainly look, act and smell like the American capitalists)

A govt operated in secret & kept these agreements under OSA bcos the culprits knew they were committing criminal offences; all these lopsided agreements are screwing the rakyat & this is akin to robbery, stealing, cheating (for eg. easing traffic flow kind of crap).

They will all get away with their corruption, cronyism & nepotism & live happily ever after for the next few generations. I recently spoke to nice Malay folks here in PJ; most of them are "blur" abt the corruption levels of bodohland. A few didn't even know who or what is an IPP.

To show how pissed I am when paying toll, I:

1. Pay them in 1 cents, often give them 1 or 2 cents less;
2. Horn loudly before and after you pay; and
3. (Optional) show your middle finger;
4. (Optional) drop the $ and ask them to pick it up;

Yea, toll collector job sucks.
It doesn't make the real a$$hole feel bad but this make me
feel good.

It's good that the Works Minister declassified the documents. Syabas to him. Semivalue would never have entertained such an action.

And good job to Tony Pua and all the members. Hopefully something good comes out of all these. Hopefully the Works Minister will accept their recommendation in good faith, with a good heart, and with an open mind.

Just one thing here :

Is it as simple as that? Is the RM50,000 based on certain common denominators of measurement? Because NPE, LDP, Kesas, etc., are all short highways compared to PLUS' North-South alone. Just asking.

Millions are needed to stay in power.The privitisations were a way to ensured a constant stream of money flowed to the coffers of UMNO via its listed highway operators. Also, building Proton cars would also increase the toll usage (and highway operators cash hoard) but caused severe traffic congestion in KL and Penang (and other cities) which then offered a way to open up Putrajaya which was a way again to make money for UMNO-linked cos.by to monetising cheap rubber land into expensive land for development. ALL WITHOUT TOO MUCH THOUGHT ON ITS ILL IMPACT ON THE PUBLIC). I recall that when Mahathir boasted about his directive to push forward Peninsular time by 1/2 hour, school children and workers from the country side suffered in the dark in moving about because the Govt, did not instruct LLN to keep the lighting on for another 1/2 hr. Mahathir was actually going agaisnst nature (i.e.the natural time zones) because we were already 1/2 hr ahead of our natural time zone before his order.
