Perak Govt Challenging Federal Constitution, National Land Code PDF Print

IPOH, Jan 1 (Bernama) -- The Perak government's decision to grant freehold land titles to residents of new and planned villages in the state was clearly challenging the Federal Constitution and National Land Code, said Perak Umno Liaison secretary Datuk Ramly Zahari.

He said the action contravened the provision in Clause 76 (aa) of the National Land Code which stated that permanent land titles should only be given for land to be used by the federal government for public purposes or under special circumstances.

"So, I hope the Attorney-General's Chambers could render the land titles invalid if issued or the plots of land as having no titles," he told Bernama here today.

He said the clause was included in the code in the spirit of population development in the long term in this country, upon realising that the land size remained the same while the number of residents kept increasing from year to year.

Ramly also said that the inclusion of the planned villages for the freehold land titles by the Pakatan Rakyat state government was a populist move, which eventually showed to be erroneous and led to bigger contradictions.

Meanwhile, Pangkor assemblyman Datuk Zambry Abdul Kadir questioned the state government's statement that the issuing of the permanent land titles could give economic returns to the state and increase the economic value of the land.

"If it's for economic returns for the state, why did the state government had only wanted to issue the titles to the new villages while there are many planned and traditional villages without permanent land titles?

"Realising the error and dubious motive, they quickly included the planned housing schemes (Rancangan Perumahan Tersusun) where Malays only make up 47 per cent of the residents," he said when contacted today.

Zambry also questioned the claim of receiving revenue for the state by issuing the freehold land titles when the state government would be giving 80 per cent discount on the land premiums.

He said the slyness of the state government in the land title issue was clear as the 30-year, 60-year and 99-year leaseholds had a high value and could be used as collaterals by banks, as was publicly known all this while.

"When I recently asked (state executive councillor) Datuk Ngeh Koo Ham about the matter at the state assembly sitting, he nonchalantly said that it was not a DAP agenda but the agenda of its partner (in Pakatan Rakyat) headed by the Menteri Besar," he recalled.

"I said how easy it was for the DAP to run away from a problem and placed the burden of facing the backlash on its partner in the pact," he added.

Zambry said he also could not understand Ngeh's statement yesterday that the Pakatan Rakyat-led state government did not discriminate the Malays, hence agriculture lots were also given to them.

"So, I wish to ask whether there was discrimination (against the Malays) prior to this that he (Ngeh) felt compelled to make the statement to allay their anger," he added.

Yesterday, the Perak government went against the decision of the National Land Council when it said that it would go ahead with issuing the freehold land titles to the new and planned villages.

Last week, the council decided that it would hold a special meeting soon to discuss a proposal paper by the state government on the matter.

For 51 years UMNO had a free hand in all their games with the Laws of the Land. They did not foresee that someday the same Laws they legislated for the benefit of their cronies, will hit them on their faces.

Sovereign Laws are like eating petek to the AG's chambers. No wonder we lost Batu Puteh. With a kind of brain we have as top Lawman who would charge all motorists on the highway for murder if one was killed in an accident . Now the music begins for all the half baked brains in govt to do some homework to give Malaysia back to its people.
Kudos to the Legal Advisor to the Perak Govt!

If the government of Perak wants to issue freehold land title so let it be. It is the prerogative of state government to do so. Federal gov have no say in this matter, that is why we are hearing all this hu-ha. If the state of Johore is selling land to foreigners and it is OK so why there is a fuss of what the Perak gov giving land titles to its own citizen??? Anyway how much land does a man need? When one die the "kubur" will only measured 6 feet dee and 3 feet wide even for Agong or PM for that matter. Think man think, thats your brains are for.

The only hopeful economic returns for the State or Federal Governments were from the Govt-Linked Companies (GLC) which statistically have shown loses of Billions of Ringgits since incorporation.

The loses of Billions of Ringgits could be translated to provide free housing schemes and freehold land titles to the Rakyats without having to rely on the economic returns to run the respective State Government.

You have an illogical lame excuse to justify the good deeds and intention of the PR Government. It clearly demonstrates that you do not work for the Rakyats who voted for you but work of the cronies of BN.

The current Perak Government grants freehold titles to its Perak residents - bravo. Dont forget, the former Selangor gomen simply granted land titles amongst themselves - e.g. the infamous Chiakaliau palace.
Malaysia is for Malaysians .... malaysia is not BeEnd (choy !!)

They talk about change after they lost heavily in the last election, but the behaviour and attitude of these UMNO politicians are still the same. Still trying to oppress the wellbeing of the people they once lead. Good, this will guarantee their demise in the coming election.

What Amno failed to do when they were in power is now being fulfilled by PR govt. That's why the Amno is jumping like 'kera kena belachan' because now the 'penduduk kampong' can see first hand who really their well-wishers and friends are. On the GLC's, it's only a front for Amno to siphon out money as though it's their grandfather's coffers. Otherwise, it doesn't make business sense why this GLC's always "loose" in billions. Only in boleland this can happen.

I was coming back from Singapore and there was this big advertisement of houses with caption " Freehold". If we are selling our freehold lands to Singaporeans, why can't we do the same to local? Why Johor can have freehold land for housing and not Perak or Penang? Come on...

Definition of real estate is Royal Estate. Lawyers you can correct me on this.
Some have claimed that the word Real is derived from "royal" (The word royal—and its Spanish cognate real—come from the related Latin word rex-regis, meaning king. For hundreds of years the Royal family / King owned the land, and the peasants paid rent or property taxes to be on the Royal's land. Hence the land belongs to the Sultans and Agongs, and is only given to the Federal or State for administration purposes, sthg like a real estate agent can find tenants for the landowner but the R/E agent does not posssess the rights of the landowner, no matter how good this agent is.

If the tenant-land-lessee does not pay cukai pintu (quit rent) then the agent (State/Fed) can actually evict the tenant-land-lessee, on behalf of the Sultan (landowner).

As such the State and Federal govt is ONLY THE AGENT of the Sultans. So who did the Sultan appoint as his agent? State or Fed? Ask the Sultan, not PM, Najib or UMNO to decide. In fact, the Sultan should sack his agent if the agent is found to have acted fraudulently if... "permanent land titles should only be given for land to be used by the federal government for public purposes or under special circumstances"... means for UMNO-cornies (pun intended) only and not for all Malaysians.

Perak govt did not act racistly, but UMNO is the one who acted cronily and THAT is unlawful!! smilies/angry.gif

For 50 yrs, the previous state govts. had done nothing for the Perakians. Along came PR and its offer of freehold titles; something the umno-led govt would never do, esp. for the poor.

Never mind if the illegal Federal gov threatens Perakian with the so-call Constitution or National Land Board. Come GE 13, we change the Federal Gov altogether, and wrest the remaining state seats from UMNO. No more dispute.
