Grounds of Judgment of Raja Petra bin Raja Kamarudin lwn Menteri Hal Ehwal Dalam Negeri PDF Print E-mail

The written judgment of Datuk Syed Ahmad Helmy bin Syed Ahmad dated 7 November 2008 the first three paragraphs of which are as follows:

Raja Petra bin Raja Kamarudin the Applicant herein seeks a writ of habeas corpus under Section 365 (1) of the Criminal Procedure Code on the grounds that his detention under the Detention Order dated 23.9.08(the Detention Order) pursuant to Section8 of the lnternal Security Act (the ISA) is unlawfufl or not having been effected in accordance with the Federal Constitution (FC) and the ISA.

On behalf of the Applicant two affidavits in support have been filed namely the affidavit of Mable @ Marina Lee affirmed on 28.9.08(Mable’s affidavit and the affidavit of the Applicant himself affirmed on 29.9.08 (RPK’s) affidavit.

In opposing the application the respondent have filed 10 affidavits including the affidavit of the Honourable Minister of Home Affairs Dato’ Seri Syed Hamid bin Syed Jaafar affirmed on 16.10.08 (Enclosure 15). In essence the basis of detention as appears in the grounds
of detention are as follows…

My opinion of judgement in simple rakyats term is as below:

Anti-ISA = Pro-Rakyats
Pro-ISA = Anti-Rakyats

Pakatan Rakyat = Ketuanan Rakyat
Barisan Dumno = Ketuanan Malayu

By the "Honorable" Minister? Does he deserve his own name itself before we can Honorably Honor him? He can go on with is appeal in his next life-- a total scoundrel and scavenger!

Hello, Raja Petra and Marina, how are you and the children?

It looks as though there are still plenty of things you need to sort out with the UMNO goons. As for hamid, he does not seem to change at all inspite of the fact that he has been given a slap on his face by the judge on the 7th Nov.

I sincerely wish you are in the best of health. On the 29th and 30th Nov, I was at the sham Alam stadium, hoping to meet you and your beloved wife once more, and warned myself not to pull your hand again, and hoping that this time around if I get to meet you and your family, I am able to shake your hand the proper way..he..he..

No matter what transpires, all of us are with you and your family. Please do pay heed that your sacrifice has not gone unnoticed, it is through your dedication to uphold justice and defend the rights of rakyat, that make us realize there are people like you who take it as their task to protect us. Freeing RPK is not part of our deal
Trust a judge to suddenly found his spine
RPK free to talk, for us is a bad sign

So far we are pleased to report:
Small crims are jailed & 2,681 People Imposed With Restraining Order
Big crims are given Tuns, Tan Sris and Datos, UMNO made them our leaders
"The restraining order is a method of rehabilitation and not a punishment”
We gladly appoint those who murder and corrupt to lead our government

Syed Hamid allowed small crims to work in restricted areas within our shores
But very important implicants of murders are licenced freely to use their C4s
To get an AP to commit any crime, first to UMNO lords you must pay
Suitably blessed, you can loot and steal; even killing is semua-nya OK!

We are all aware of what is going on between the government of Malaysia and it's desire to prosecute RPK.

When the Non Muslims and the world look at what is happening in Malaysia in relation to all the issues pertaining to Islam, one can help but to wonder, What is wrong here??

Is it the people that practices the religion or is it the religion in itself? This is just a question that is perhaps, mind boggling every other non Muslims. Please help us understand!

No one is challenging anyone's freedom of practice or religion, so don't start getting crazy and ready to wage a religious war right away, now!We just want to understand and comprehend the whole issue better, that's all!
