Human Rights Watch: Drop case against Fernandez PDF Print

(The Malaysian Insider) KUALA LUMPUR, Nov 23 - The Malaysian government should exonerate Irene Fernandez, a leading labour activist convicted in 2003 on politically motivated charges of "publishing false news," Human Rights Watch said today.

The Kuala Lumpur High Court has scheduled hearings next week in the criminal case against Fernandez,
which has continued for more than 12 years.

In July 1995, Fernandez, the director of Tenaganita, a non-governmental organisation that exposes the abuse of migrant workers in Malaysia, sent a public memorandum to the Malaysian government, titled "Abuse, Torture and Dehumanised Conditions of Migrant Workers in Detention Centres."

Fernandez was arrested at home on March 18, 1996. After a trial that lasted seven years, she was convicted on October 16, 2003, of publishing, with malicious intent, false news about the treatment of migrant workers
awaiting deportation in Malaysia's notorious immigration detention centers. Her one-year prison sentence is still on appeal.

"Irene Fernandez and her organisation documented the government's sadistic and humiliating treatment of migrants," said Brad Adams, Asia director at Human Rights Watch.

"These include random beatings in the middle of the night, HIV/AIDS detainees sleeping on a roofless porch, rain or shine, filth, food and water shortages, and totally inadequate medical care. Human Rights Watch has also documented such treatment."

Since her arrest 12 years ago, Fernandez has been free on bail, but the court holds her passport and she can travel only at its discretion.

The appeal process, which did not start until April 1, 2008, has seen a series of postponements. When it was discovered that 1,700 pages of the record, including witness statements, were missing, the hearing was postponed until May 12, only to be postponed again.

The papers were unexpectedly found some time later. The case was again postponed on Aug 5 when it was discovered a computer virus had wiped out some newly typed notes. In October, Fernandez's defense lawyer said that he had received almost 9,000 pages of handwritten and typed notes, but that portions were "incomprehensible." Nevertheless, the presiding judge said the case would be concluded and a verdict delivered by mid-December.

"The Malaysian government should say 'enough is enough,' and end the dubious case against Irene Fernandez once and for all," said Adams. "Malaysia's image suffers when it continues to prosecute people, especially respected voices, for peaceful expression."

This is the fate to those who speak the TRUTH about UMNO lead government which is full of corruption and bias persecution! Take note of how long this case is being dragged and selectively prosecuting Irene even when she in on trial!
God damn those power to be in UMNO!

In this country they release murderers and imprison innocent people.Release Fernandez and arrest Najis and RB instead.

Murderers, crooks in the Govt, the streets are filled on a daily basis .UMNO has nutured these forces as security for all their positions they are in . When have they been interested in uplifting the intelligence of the people. Arms bought with middle man , used against its own people, profits take flight to foreign lands. This is all they are up in power for , nothing more nothing less....... UMNO is now sitting on a Hydrogen Bomb-- it will implode anytime!.......

ONLY IN MALAYSIA....

- Those give/take bribe excape BUT those report the bribe will be "punished"
- Those acted in "PORN VCD" excaped and can be re-elected BUT those having his
porn vcd end up in prison.
- Those who're involving in murdering (C4) is free BUT those report the case end
up in Kamunting Prison.
- Thos stir the Racial Sentiment is FREE but those who wrote the news end up in
PRISON and the excuse given is for her safety smilies/tongue.gif

The word 'accountability' is still a foreign word in Malaysia whereas in USA or UK, that word which was taught to me has become a integral part of my everyday life.

You can call Fernandez's writing bluff but I have seen a documentary overseas about the mistreatment of immigrant workers in M'sia. You can hide but the Human Rights of the World already know. So kindly do not 'bodohkan' the public. You cannot hide anymore. There is flaw in this money-making scheme and it's better to come clean. Release Fernandez.

Dear God, I pray, please be with the right-thinking individuals who attempt the tough road of your teachings. Irene Fernandez did not think about herself and carried out her duty as her position and job description required her to do.
