Raja Petra trial: Prosecution wants to re-analyse PC PDF Print

A computer forensics investigator told the Sessions Court here that data on a notebook computer seized from Malaysia Today editor Raja Petra Raja Kamarudin had been deleted.

ASP Wa’ie Isqal Kria Abdullah, 38, said this was why there were no records of the computer accessing the Malaysia Today website between April 11 and April 26 this year.

Questioned by DPP Farhan Read on Tuesday, the seventh witness said he was of the opinion that the computer user had used the CleanIt programme to delete all temporary files.

“I found that the www.malaysia-today.net (Malaysia Today) website was accessed several times for the year of 2008 and it was done by the administrator user,” testified the officer who is attached to the Computer Forensics Investigation division.

Asked regarding the meaning of “administrator user”, he said the user has “full access to edit, delete and add”.

He said he had stated in his report that the user name of Raja Petra belonged to the administrator user.

The blogger had on May 6 claimed trial to publishing a seditious article on the Malaysia Today website on April 25.

In the afternoon proceedings, in an unexpected move, the prosecution applied to the court to allow ASP Wa’ie to re-analyse a CPU and the notebook seized from the blogger.

Lead prosecutor DPP Ishak Mohd Yusof said he was applying under Section 425 of the Criminal Procedure Code which stated that the court has the power to summon and examine any person at any stage of the trial if his evidence appears to it essential to the just decision of the case.

He said ASP Wa’ie had testified to have analysed both computers based on an application by investigating officer DSP Mahfuz Abdul Majid.

“The investigating officer just ordered him to find out about a seditious article entitled “Let’s send the Altantuya murderers to hell” and accessibility to the Malaysia Today website.

“ASP Wa’ie however has testified to have spotted several folders on both computers but he did not open and read those as he wanted to follow the investigating officer’s order,” argued DPP Ishak on the seventh day of the sedition trial.

He asked the court to allow ASP Wa’ie to re-analyse both computers and extract several folders found in them.

“The folders are important for the court to reach a just decision. It could give evidence for the prosecution or defence,” he said.

In stressing his points, DPP Ishak said he depended on a case law where a trial judge of a drugs case had allowed the drugs to be sent for re-examination for justice.

DPP Roslan Mat Nor argued that it was important for the court to evaluate the overall evidence in the trial.

In asking the court to dismiss the application, lead counsel J.Chandra said Secton 425 is not applicable as the seventh witness was still in the midst of giving his evidence.

“We have a report (on the examination on both computers) and the witness who prepared it is also here, in the witness box. It is also (a question of) justice for the accused,” he said.

Chandra argued that ASP Wa’ie had not been authorised to look into folders as his terms of reference were very specific on the request for his analysis.

“Besides, there is no evidence that these folders are relevant to the subject matter of the charge,” he said.

Chandra said the findings over the computers by ASP Wa’ie were very clear in the report.

Judge Rozina Ayob set Wednesday to deliver her decision on whether to allow the prosecution to re-analyse the computer and CPU.

This miracle of a computer forensics investigator concluded, by the grace of ingenuity bestowed upon him by Umno, that data on a notebook computer seized from Malaysia Today editor Raja Petra Raja Kamarudin had been deleted because there were no records of the computer accessing the Malaysia Today website between April 11 and April 26 this year.

This reminds me of an archaeological research carried out in Sungai Way where the team leader concluded that Petaling Jaya was already using cellular phones during the 1200s because their digging did not produce any evidence of Telekom Malaysia cables having been buried there.

Guys, I think he's lying on this. I think only with the server logs if the
site have any, can do this. Client browsers don't keep logs on the site it went unless it's been specifically set to remembers the site it visited and could
only keep the content for several days but not for a very long time. The cache
will be cleared normally in 14 days by default for IE. Cookies deployed
normally will expire in less that time. I hope he's not trying to fabricate
evidence in Pete's PC as we hate to laugh at their poor attempt in IT.

Oh yeah the administrator account, come on lah anybody who has a PC with Windows 2000 upwards could create a full fledged administrator named account. It's just to administer the PC and not some website lah. You guys in the IT forensics should know this too well. Unless you opted for telling lies and trying to implant
ridiculous evidence in Pete's PC. Hmm smells like another Anwar style prosecution eh? smilies/wink.gif

Are these guys able to be absolutely certain whether RPK 'loaded' the article from that PC? If they have analyzed the first round and cannot find evidence, they have to be very-very convincing evidence to make the new evidence admissible and not contradict the earlier findings. Otherwise it will make the already stupid police look more stupid or at worse incompetent and fabrication of evidence.

The police already had a chance to examine the pc. They even knew what they were looking for. They could make copies in fact. Unless there is a new information, they should not have the luxury to re-examine the pc. This should be the case to prevent abuses of the system such as to delay the trial. Examination of the evidence should be limited to the case at hand. It is specific and sometimes limits of the extent of the search can be strict. In this case I agree with Chandra's argument. It is the burden of the prosecutor that a re-examination is really needed such as new information coming to light, not to use the re-examination to get new information.

even rpk trial is entertaining. my theory is like this. The stupid police so called IT expert could not find anything in the laptop becos it was the decoy laptop placed in his house. So they tried to write in evidence into his hardisk like copying the offending articles somewhere.

But then they forget the PC has a clock running accurately so all the saved files into the hardisk are labelled with the latest dates weeks after the article originally appeared in the website. So they had to deleted the fabricated evidence, otherwise not only the case get thrown out by the judge on the spot, but also the police will be facing jail terms for fabricating evidence.

Why do we need to pay some expert to tell us the obvious ? Everyone reading this would have at some time or other deleted files and even some programs create temporary files and then deleting it when it is done. Red herring.

This is classic non-sequitur. One doesn't follow the other. If he doesn't know what file was deleted how did he knew that the files deleted were records for the access to malaysia today ? The prosecutor is on a fishing expedition. probably using a red herring.

He must have seen the CleainIt icon on the desktop. if he is of the opinion then what proof does he have that led him to such an opinion ? The trail that led to the opinion is more important than the opinion.

Another red herring. And he is bluffing. Administrator user of the machine or of the website ? Accessing the website is different from accessing the malaysian-today website SERVER.

This is fudging. Either he doesn't know or he is deliberately misleading the court.

Most people who maintains server never use the administrator account. It is like been an imperfect god and when you make a mistake, particularly with wild-card, you destroy and modify a lot of things that you don't know you have modified. For this reason accounts given to administrator of websites are never given super-user status. It is unlikely that RPK logged into the malaysian-today website server as "administrator". Either this forensic expert doesn't know or he is deliberately misleading.

Of what ? Of his machine ? or of the website.....if this is not made clear this is a deliberate attempt at misleading the court. The prosecution is on a fishing expedition and possibly planting evidences.

What a screw up job this computer "forensic" has done? It took so long to return the computer, yet it need to re-analyse the PC again. It only take me a few hours to recover and check through the data stored. Yet I did not study computer science and do not claim myself computer expert.

What has these experts been doing in the "forensic" unit?? Taking a sip of tea, chitchat, go home, come back again??
