Court Can Amend Charge Against Anwar |

KUALA LUMPUR, Aug 16 (Bernama) -- The charge against Parti Keadilan Rakyat (PKR) advisor Datuk Seri Anwar Ibrahim under Section 377B, which refers to voluntary carnal intercourse against the order of nature, can be amended by the court, said Bar Council deputy president Ragunath Kesavan.
He said the court was empowered to amend the charge to Section 377C of the Penal Code based on the appropriateness and requirement to ensure that the prosecution was carried out according to the provisions available. "In this case, every legal provision and process of prosecution can be adopted and amended if the need arises," he said when contacted here.
He was asked to comment on the charge against Anwar following the swearing on the Quran made by Mohd Saiful Bukhari Azlan Friday at the Federal Territory Mosque, declaring that he was sodomised by Anwar against his will.
On Aug 7, Anwar was charged in the Sessions Court, here under Section 377B of the Penal Code for allegedly committing carnal intercourse against the order of nature on Mohd Saiful on June 26.
Kesavan said Mohd Saiful's swearing on the Quran Friday was not considered in contempt of court.
The Deputy Inspector-General of Police, Tan Sri Ismail Omar, when contacted declined to comment further beyond saying that what Mohd Saiful did was his individual right.
