This statement is made in response to the statement made by Deputy Inspector-General of Police Tan Sri Ismail Omar as was published in the STAR dated 20-7-2008, with regard to the law on the delivery of the police report made against Dato' Seri Anwar Ibrahim.

1.    Section 51A of the Criminal Procedure Code as referred to by the Deputy IGP is totally not applicable at this stage. The Deputy IGP should go back to his basic legal books. Section 51A only applicable if a person has been charged in court and the documents to be delivered before the commencement of a trial.

2.    The situation at present is that there is some unknown complaint, purportedly in relation to sodomy and purportedly made by one Mohd Saiful Bukhari bin Azlan. It's on the basis of these reports which have been suppressed from public scrutiny that a whole lot of people in authority have made all sorts of allegations against and demands on DSAI.

3.    It is elementary natural justice that any person accused of anything should have sight of the accusation, before being called upon to explain anything. How can anyone called in to give a police statement in relation to a criminal investigation know what exactly the police are investigating and be obliged to answer questions without having a copy or even sight of the initial documents that sparks off the relevant criminal investigation?

4.    How is a person under a police questioning to know whether the answer he is giving will incriminate him unless he first knows exactly what offence he is being accused of or the police are investigating?

5.    In any event, the Deputy IGP should know that the First Information Report is a public document and should be made available to all persons affected by the report.

6.    To continue to expect the target of a criminal investigation to answer questions, supply information, and provide evidence in total ignorance of the circumstances of the offence alleged against him, is eerily reminiscent of an episode where a prisoner was blindfolded and handcuffed, and therefore totally unable to defend himself in any way and was then viciously attacked by the police themselves.

7.    Can we therefore have the police report without any further waffling or prevarication?

Everyone is trying to use this case to gain some mileage by calling for DSAI to surrender his DNA. It really makes me wonder why none of these so-called righteous lot have asked the police to surrender a copy of the police report to the accused. And the PM says that this is going to be a fair investigation. It is anything but fair, and the speed of which the police carried this out, haven't seen such productive work from the men in blue in a long time. If only they were this efficient in every case except this one. The government probably haven't woken up from their slumber to really see that the general perception is that very people who are appointed and entrusted to uphold law and order have lost all it's credibility.

Finally, a legal view point. It's so hard to find truth in MSM (if any) or even blogs (since a lot of emotions are involved).

It is very much appreciated that those proficient in laws inform the readers what the authorities are allowed to do. Fed up with the bullshit from PDRM, IGP & AG.

the DNA samples they took fr DSAI is too old....they should tell tat to anthropologist who are able to extract Dna from millions of years ago. Plz watch the genetic trail in National Geographic....coz then u'll know how silly it is to say Dna from a couple of years back is too old

Deputy IGP, you have got two choices...Answer the above Section or as pointed out correctly by YB Sivarasa, go back to your basic legal books. Don't simple make statement and look like a damn stupid fool. You are a Deputy IGP for god sake...

The recent and many fumblings by various personalities, of the ruling political party, the police and even academia clearly reflect the very sad state of affairs in this country.Gone to the Dogs, as we say.

So how and what are we, as ordinary and every day citizen of this country, to do? Where and what this country is presently at, rest squarely on the political party/parties that has led this country since independence.For those of us who has been hoodwinked,threatened,bribed,ensnared into letting them rule this country without a break since independence must now seriously rethink their strategy and what they want; for their own and future generations.

We must realise that, at the end of the day, we are largely responsible, for what this country is today and also tommorrow.If change is what you want, then change you must.It's still your call.

The Deputy IGP has proved his naivety concerning the report. Did he get his promotion through the backside . . . ooppss . . . I mean through the 'back door'?
